In doing so, the applicant has caused a previous site Plan Review approval issued to Evergreen Associates, dated 7 2l 90, to become invalid. l have addressed this issue to Town Cou-nsel . Mr. Joel Bard informed me that any action on the property which changes a previously approved site Flan will reader that approval null and void. In this particular case, should the property owner want to construct the proposed addition as approved on 7 21 90, they would have to re-apply to the Planning Board for Site Plan review. The title to North Andover Office Park has been transferred to The Titled Corporation, who business address is 21 Custom House Street , Suite 500, Boston, MA, Hugh M. Beckett is the President of the Titled Corporation . My understanding is that you will deal with this matter at the meeting on November 21st . DATE: June 28, 1990 RE: North Andover Office Park Construction Issues At the Planning Board review of the North Andover Office Park Addition on June 7 , 1990, the Board asked for the following information about the actual construction process. Much of the information was provided by the Lee Kennedy Company of Boston. Construction Time Period Construction is estimated at eight to nine months. The exterior should be completed in four to five months and the interior in three to four months with some overlap. it is likely that construction would need to take place during the winter -months. $auipment List Attached is a list of equipment that will be present on site for muob of the construction process. Perimeter Fenainq The perimeter of the construction area will be fenced off with a 6 ' chain link fence in those areas where public acceee could be a potential problem. This would be all areas except the extreme north- western edge of the construction zone which is bounded b wetlands and the existing drainage ditch. please note the Plan of Preliminary Construction Space Requirements, which outlines in red the construction area. June 28 , 1990 North Andover Planning Board Page Two Parking Dislocation During the construction phase of the exterior of the addition, 119 existing spaces would be temporarily "lost" . However, parking would be needed for approximately S0 cars which are located in this area on most days. The remainder of the spaces are usually vacant. The existing lot can easily acco-mmodate this 89 car dislocation. The attached memo related to parking shows that the average number of vacant spaces over a period of one week, between June 11, 1990 and June 15, 1994, was 134 spaces during the morning and 16 spaces during the afternoon. There were no unusual tenant vacancip-s that week. If additional parking were needed for some unforeseen reason, Merrimack College has indicated that they would be willing to allow North Andover Office Part to create a parking area to hold perhaps 25 - 30 cars on the land adjacent to the right of way that exists between the two properties. T see no major impact to, M,errimack College and it's property. However, T would request the following stipulations be in by the planning board prior to the constroction, Phase. 1. At the request of Mr. Peter Johnson, Merrimack College will permit the temporary, use of a small designated area of our property for Construction managernent or staging during the course of construction. Dear Mr. S Lapinski, I would first lake to thank you -for appearing before the Planiii.ng Board at their June 7 , 1990 public hearing . At that nicetin g the Planning Board opened the public hearing with regard to the above referenced site plant review application. The board had the following Concerns which should be addressed prior to the next hearing: . The proposed buffer between your property and the abutting landowners should be properly landscaped so as to provide adequate screening to the residential neighborhood. 2 . All lighting shall be downoast so a: not to provide glary to any abutter. 3 . Some of the panting shown on your proposed site plan is across the property line and actually located on land owned by Merrimack College . You will be required to either receive an easement for that parkin} or remove the existing asphalt . 4 . Your rust provide the Town Planner with the appropriate breakdown of uses, and floor area associated with those uses, so that lie may determine the amount of parking needed in this location. This should be done for both stru�.:tures located on this site. k. 5. Prepare a detail of the proposed landscaping around the addition. 6 . Delineate on the proposed plan an area of canstaruQti.on activity, construction material and techniques , and a time frame for the proposed cony truction.
