SPECIAL PERMIT APPROVAL, SECTION 8 .3 OF THE NORTH ANDOVER ZONING BY LAW. The Planning Board makes the following findings regarding this Special Permit a5 required by section 9 . 3 of the Zoning Bylaws 1. The proposed use and site design for this lot are appropriate, due to it's location in Town. 2 . Adequate vehicular and pedestrian access iTnto the surrounding site has been provided. 3 . The landscaping plan as shown and reprised, meets the requirements of section 8 . 4 of the Zoning Bylaw8 . 4 . The site drainage system is designed in accordance with the 'down Bylaw requirements . 5 . The applicant has met the requirements of the 'Town for Site Plan Review a� stated in Section 8 . 3 of the Zoning Bylaw. 6. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The planning Sward finds under section 8 . 35 of the Zoning Bylaw that the proposed site plan generally complio; with the Town Bylaw regoi,rei�nepts but requires minor conditions in order to be completely in compliance with 'Town Bylaws. Finally, the Planning Board finds that this proposal complies with the Town of Forth Andover Bylaw requirements so long as the following conditions are complied with . Therefore, in order to fully comply with the approval necessary tc construct the facility as specified in the Special Permit before us , the Planning Board hereby grants a Special Permit to the applicant provided the following conditions are met: 1. Any Plants , 'Trees or shrubs that have been incorporat-ed into the Landscape Plan approved in this decision, that die within one year from the date of this approval, shall be replaced by the applicant. . All drainage facilities including detention basins, shall be constructed and erasion co�itrolled prior to any 13uilding permit being issued on the site. 3 . All Planr�inq Board order of Conditions are to be placed upon the recorded Definitive Plan, ( Cover sheot ) prior to endorsement and filing with the Registry of Deeds . 4 . The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 5. Gas, Telephone, Cable and Electric utilities shall, be installed as specified by the respective utility cor�apa�Yies. f. All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lir. es dQring construction. 7 . No open burning shall be dome except as i� permitted during burning season under the Fire Department regulations. B . No underground fuel storage shall be installed except as may be allowed by Town Regulations . 9 . All buildings shall have residential fire sprinklers instaI1 d prior to the issuance of the Certificate of Docupancy, per order NAFD. 10. Primr to a Certificate of Occupancy being issued for any structures, this site shall have received all n ccssary permits and approvals from the Nerth Andover Board of Health. 11 . Prior to a Certificate of Occupancy boing issued for the structure, the site shall be reviewed by the Planning Board. Any screening as may be reasonably required by this Planning Board shall be added at the owners expense. 12 . Prior to endorsement of the plans, all off situ utilities shall_ be submitted to and approved by the North Andover DPW. 13 . Prior to a Certificate of Occupancy being issued for the approved structure, the Planning Board small review the ventilation structures placed on the roof. If the Planning Board clete=roil s t1lat additional screening (ie. fcncing or other structure) is needed then it shall_ Joe installed at the applicants expense.
