No. Andover, Massachusetts MEMORANDUM OF LAW FACTS The facts of this case are slightly complex and stated as follows . On April 11 , 1989, the Zoning Board of Appeals denied the Petitioners request for a variance from Section 7, Paragraph 7 . 1 , 7 . 3 and Table 2 of the Zoning By-law. According to the decision of the Board and the minutes of the meeting, the reasons for denial were, the Board did not hear from the massachusetts Department of Public Works and felt the premises would be too close to the highway and the petitioner failed to satisfy Section 10, Paragraph 10 . 4 of the By-laws . On Apx`j:L 12, 1989, the Chairman of the Zoning Board of Appeals received a response to his inquiry from the bistriet 5 Engineex', Massachusetts Department of Public Works . The Chairman forwarded the letter to the Petitioner' s attorney and the Petitioner' s attorney requested the Zoning Board of appeals to rescind its vote of April 11 , 1989 and reconsider the petition. The Board agreed to reconsider the petition and granted the variance on May 9, 1983, finding that the Department of Public Works' s letter contained pertinent information concerning the petition and further found that in light of this information, Section 10, Paragraphs 10 . 4 of the By-law had been satisfied. ISSUE The issue for the Planning Board to resolve is whether a specific and material change occurred between the two hearings before the Zoning Board of appeals . ARGUMENT The facts of this case and these proceedings clearly indicate the desire of the parties involved, (the Town no less than the Petitioner) to retrace a misstep and insure a proper and lawful procedural record. This case is not the "typical" case arising under Section 16 of Chapter 40A of M. .L.A or Section 10 . 8 of the North Andover Zoning By-law both of which sham identical language . (Appendix A) The "typical" case involves two petitions, first a petition is presented and denied; then, a second petition is presented within the proscribed two year period. in the instant case we are in reality dealing with the same petition. The circumstances changed between the two hearings before the Zoning Boaro1 of Appeals because new evidence was available for the consideration of that board. This now evidence showed the Zoning Board of Appeals that its previous assumptions concerning the location of the building, traffic impact and curb cuts were incorrect. The Zoning Board of Appeals found this new evidence to be a sufficient and material change and in so doing applied the statute as interpreted, correctly. The question of what constitutes a specific and material change, as that phrase is used in Section 16 of the enabling statute was explored by the court Ranney v. Board of Appeals of Nantucket, 414 NE 2nd 373 f 1961 ) The Court determined: "necessarily, then, the specific and material changes which Sections 16 requires must be something less than differences so radical that they obviate scrutiny under the statute altogether" (Rana—e . p. 376) The example given by the Court was a substitution of an apartment building for a motel . The Court found this would he " . . . so fundamentally different from Lhat first proposed as not to confront the barxier of Section 16" it follows from the foregoing that the matex'i.al and specific changes required by the statute are not major or significant changes . in fact the Court held : "the Board may give weight to diffei7ences which in the absolute sense are relatively minor" JRannev p. 376 ) The fundamental character of the project need not change, nor the factors which required the petitioner to appear before the Zoning Board in the first place . Therefore, the size of the lot and the set hack deficiencies which required Zoning Board action are not areas to look for for material and specific change because changes in these areas are beyond the peruve of the requirements. In Ranney supra there is a factor which exists in the ease at bar. .'The Board' s findings also suggest that the Board regarded itself as raving acted on ex-roneous information in concluding initially that the proposed motel would adversely affect traffic on North Beach Street and the value of residential properties . To. the extent that the Boax'd thought itself in error about underlying assumptions Concerning the proposal, this constitutes a change of _r. umstane.es ...w1i . . permitted the Board to entertain a second application for zoning_ relief". (nann y pp, 376--377 ) (emphasis - - -------------------- applied) In other words a specific and material change. The instant case presents a remarkably similar situation in that at the first hearing the Board relied on certain assumptions concerning the reaction of the State Department of Public Works to the project . These assumptions proved to be incorrect and the, Zoning Board of Appeals reformed its decision accordingly. The zoning Board of Appeals acted upon a legally sanctioned change in circumstances which they found resulted in a specific and material change pursuant to the by-law. In Ranney sg2ra, the Court held that flush mounting of outdoor lighting; installation of blackout drapes; installation of sound proofing insulation; and planting an eight foot privet hedge also constituted a specific and material change, although these changes were relatively minor. The Zoning Board of Appeals conditioned it ' s decision upon a State approved single access and exit from the site and site plan review. The purpose of Section 16 of Chapter 4OA, M.G.L.A. and Section 10 .8 of the By-laws of the Town of North Andover is two-fold: To prevent repetitive petitions and bring finality to the administrative process; and to allow local permit granting authority flexibility in reconsidering request for relief in light of altered conditions . (Ranney supra p. 376) Of course, the ultimate purpose of the sections is to insure locally controlled quality development. This cannot be achieved without some flexibility because unreasonable rigidity leads only to the court house . It should be noted by the Board that during all public hearings before the Zoning Board of Appeals or this Board, not a single citizen of the Town has ever voiced opposition to the project . in fact, those who spoke at the hearing voiced only support . This is a small project on an otherwise valueless piece of .and which has the potential to bestow benefits to the Town beyond its size by way of increased tax revenue and improvement of the quality of the lives of the citizens by convenience . There must be roam for this projeot within the town. CONCLUSION The Petitioner has demonstrated compliance with Section 10 . €3 of the By-law by showing specific and material change.
