This is to inform yom that I h8ve discovered a vioiatiQn With
regard to the building height of the above referenced project.
Mr. John Todd submitted an application for WOW Permit , and
construction of a common drive for lot U-3, Salem Turnpike SBrent
on February 11, ' 1988. Paragraph 0 4 of that application, Nhich
was signed by Mr. Todd, notes thv height of the building to be
Thirty Four feet ( 341 ) . It has become glaringly obvicuo to this
department that Mr. Todd' s building is in excess of 34' .
I have been directed by the Planning Board to notify your
department to take the proper action to see that site is brought
within compliance.

1 would first like to thank you for appesri g before the Planning
Board during heir July 13, M9 meeting. The concerns that were
raised at that hearing mnd the oubBeque3nt site visit include tha
fol. lowingl
( 1 ) The hejght of the existing building excerods the height theLt
was approved by tho granting of tho special permit fOr this
Project.
(2) Because of conzervation ci rncarns the jandsscaping Galan cannot
be Anstalled as designed. The Plahninq Board ha$ agreed to
the following amendmentse
+� 2 1 !21° caliper lied Maple's (Peer Rubrum) at1r^e to bo planted
along thL- entry drive. Spacing shall bEi on6 tree over~
twenty feet.
�+ 4 - 51 Dark American Arborvitae are to be planted every 4'
on cantor along the inialde of the fence fcuhd at the
Northwest sidle of the property. AlsOt the Arborvitae shall
be planted avery V on seater at the Northeast co>nner of
thie farce, starting at the ogisting Red Mapla and r-unning
the entire length of the decant ions basin.
(3) The Planning and Conservation Departments slave agreed that
in ojr deY* to minimize erosion into the detentiorx area, a
boulder retaining wall must be oorrstructed w1lict, will, be a
minimum of 3* in height and shall rmn for a length of E001 .
The p�.�rpose of this wall is to lessen the grads of the
i mnibankment and to pro l d o a stabilized area for planting.
The wall al all be constr ur - !ed so aA not to encroach any
further into tho detention area, bQt Wall cut into ths'
eKis� inp emba4nkroent.
(4) A water sample test shall be condor t ed and resu l t o given to
the Planning and Conservation Dapar^tmenta* It io required
that tho Town Planner approve of the cOmPanY chosen to
psr{f'c�rhi the chemical analysis, and that a re presentative of
that company perform the My of col. la t i, the water
samples.
The public: teaming with regard to this matter has been continued
and l will notify you of the data sect for that meeting. As

All lighting shall be direQted down and not cast
any light on adjacent properties. A detailed lighting
plan stall be submitted tc the Planning Board for
approval prior to the issuance, of a build.i,riq permit.
