Conservation Conditions of Approval,NACC#293
Pursuant to section 4.4.2 of the North Andover Wetlands Protection Regulations,
the homeowner/applicant Jose DeJcsus filed for a Small Project permit application for work proposed at 58
Empire Drive,North Andover. The work involves:installation of a vinyl privacy fence along the easterly
property line,containing 13 posts,which will hold eight(8) 6'x8'panels,two (2) 6'x3'panels and one (1) 6'x4'
gate. Post holes will be dug to a depth of 2-feet and will be backfilled-with gravel.Based on the submitted ss-
built plan and Conservation Department site observations,a small stretch of the fence will be located just
within the 50-foot No-Build Zone,and the remainder of the fence will be located between the 50-foot No-
Build Zone and the 100-foot buffer zone.
During the April 27,2022 public meeting;the North Andover Conservation Commission (NACC) found this
project to qualify as a Small Project Permit and voted unanimous) two approve this project as proposed under
Cate�;ory"H" Fences&stone walls that do not alter the—flow o surface waters nor alter wildl�e habitat or movement-
subject to compliance with the conditions listed below.The project is approved only as it relates to the
Conservation Commission and any and all other approvals should be obtained by the applicant/homeowner.
All work shall conform to the following:

The following conditions are hereby mandated:
CONDITIONS:
1. A pre-construction meeting shall be held with the Conservation Department to review conditions
herein.
2. All excess excavated soils shall be taken off site and the new fence shall maintain at least 4-inches of
space between the ground and bottom member of the fence to allow for water flow&wildlife
movement.
3. A post-construction site visit with the Conservation Department shall be scheduled once the project
is complete to verify compliance.
4. This permit shall expire one year from the date of issuance.

**The agplicant,homeowner and their contractors are advised that NO other work on the property, is
allowed under this permit. The NACC has jurisdiction over all of the wetlands and associated 100-Foot
buffer zones and 200 Riverfront Area to the Shawsheen River on site and any`work that involves ground
disturbance or changing the current conditions in these areas will require permitting with the NACC.This
includes, but are not limited to,house additions,pools, atios,decks, sheds, fences,garden beds,landscaping
and bridge installation,tree or vegetation cutting/b�uning.These activities shall be held to the current
standards under the Bylaw and Wetlands Protection Act.**
