DE ISION After discussion at the May 3, 2022 Planning Board meeting, and upon a motion.by 1. Simons and wconded by P. Boynton fie Planning Board voted to grant the Watershed special Pemnit- Wavier with conditions. A vote of 50 was wade in favor of the.waiver request. CONDITIONS The letter requesting the waiver, which was submitted by the Giving Garden Committee on April 2 8, 2022 along with Attachments A.through F are considered part of this Notice of Decision{"decisfoW. and shall be mcorded along with this decision,at the North Essex Registry of Deeds. The Corn rnittee leases land at the Foiling Ridge Conference Center, 660 Great Pond Road, in North Andover. We grow vegetables and fruits on the land and give them to loom food pantries ltrctuding Neighbors In Need, Lazarus House, and the People's Pantry. Portions of the site lie w1thin a Conservation Restriction Area. The boundaries of these site features are shown on Attachment A. Conservation Restriction Plan dated July 8, 2010, and Attachment 0;As-Built Plan dated July 30, 018. The Giving Garden COMrnittee files an annual soil COnservation report with the North Andover Conservation Commission and complies with their requirements for setbacks, organic and sustainable farming practices, and limits on construction. We have just received approval from the Conservation Comm issIon fa our 2022 report. The Giving Garden Committee would lice to Instati a greenhouse on the site to support our agricultural activities. The structure can be disassernbind and removed when r)o longer needed, The greenhouse would be located on an existing flat airea currently maintained as either Mowed sawn or a vegetable Planting hed, We would like to cover the flaor with a +weed block fabric and cover this with a lager of pea stone to provide a stable walking surface. The greenhouse Is equipped with gutters. We have cinnsidered two options for controlling the runoff. Oar preferred option is to collect the water in rain barrels and use it to Irr#gati� the crops, thus returning It to the ground by infiltration. Another option is to direct it into grass swaIes running parades to the sides of the greenhouse#or detent'son and Infiltration. Attachments E and F are mod fled versions of the Conservation Restriction Plan and As-RuiIt Para. Using the scale on each plan and making a series of measurements between the corners of the house near Great pond Road,the corners of the fence around the garden, and the wetland Just east of the garden, we have added the approximate location of the garden fence to the plans. Most of the garden lies within the unrestricted portion of the site. The garden Is more than 400 feet from the Lake and more than 25 feet from the nearest wetland. We have also added three potential locations for the proposed greenhouse to each site ptan, labeled A, B, and C, and encircled. Location A is Iust outside the western fence lime south of the cxist!ng gate. Location B is ins€€#e the western fence line south of the existing gate. Location C is outside the southern fence line. All three locations are snore than 40D feet from tyre Lake, more than 100 feet from the wetlands, and outside of the Conservation Restriction Area in the unrestricted portion, of the site, We would prefer site A or 8 because they are closer to the wash station and toolshed that support our operations. The Giving Garden Committee requests a waiver from tyre special perMit requirement for work In the Watershed Protection District for the proposed greenhouse. We can install and operate the greenhouse without significant disturbance to existing topographer or deleterious imparts on the drinking water suppler.
