Dear Chris This letter is to make you aware of what 3 consider a situation that should get immediate attention . I am in receipt of a certificate from the Secretary of Environmental Affairs . (Copy Enclosed ) I believe that the letter clarifies the intent r the State to suggest that Chestnut St . and or MD ' be used as an alternative to Fite 114 for access egress from the development now under constrcuc y the Hass Corp . This department had stopped Hass Corp. fall from using Chestnut St , for access to their site . we even went , as far as , putting up a snow fence barricade , to get our point across . Eventually , with conditions , we did give them a temporary curb cut to accommodate some of heir construction vehicles , but made them very much aware that Chestnut St . would not be considered , as far as this [department was concerned , for any permanent solution to their traffic flow. in my opinion , the only alternative that should be considered , at this time , is that the State ,should accept their responsibility of upgrading RtP_ 114 and get this antiquated highway up to the standards that will be necessary to accommodate the immediate and future trans- portation needs of this area . I think it is ridiculous that the State would deny access from Willows Industrial Park onto Rt 125 By Pass and then torn around and recommend putting this added traffic flow from the Hass Project , onto Chestrlut St . or Mill Road , which are both presently nothing more than country lanes with road widths of less than 20 feet . Impact Report P,2 . I would recommend that this be put on the agenda of all departments associated With the impact that this would cause within 0ur community and that we meet and plan out the proper strategy that the Iown s hDuld plan tO get the best solution possible. DATE NOTICED IN MONITOR: June 26, 1985 The Secretary of Environmental Affairs herein issues a statement that the Final Uriv i rGnMen ta 1 impact Report submitted on the above-referenced project does not adequately and properly comply with Massachusetts General laws , Chapter 30, Section 6 -62H inclusive, and the regulations imple�mnting MEPA. According to this report, the project will generate approximately 1960 Average Daily Traffic (ADT) , which will account for about a 9 percent increase in A€lT along this section of Route 114. Peak hour traffic has been estimated to increase by 17 per cent for the eastbound morning traffic and 14 percent for westbound evening traffic. It should be painted out that this project° s traffic generation estimates have varied considerably during the review of this development. The original E€ F filing showed 290 ADT, are underestimation of the traffic by a factor of about 7 . A comparison with the Route 114 Traffic turfy_,- May 1985 , by the Merrimack Valley Planning Commission s�i'll ^shows a discrepancy between the project traffic generation rates given in the FEIR, The MVPC traffic generation estimates are about 40 percent higher for the evening peak hour. r EOEA #5243 ROUTE 114 CURB-CUTAORTH ANDOVER PAGE 2 Despite some improvement, the final EIR has failed to address a key issue-- an alternate driveway onto Chestnut Street. Clearly , a requisite of the scope was , "(a ) thorough assessment of an alternative access/egress onto Chestnut Street and Mill Road. " The importance of that analysis was restated in .'-.the Secretary ' s Certificate on the draft EIR. Agencies , including MDPW, MUPC , and the town planner maintain that there can be significant improvements in traffic flow, if the developments in the area channeli�e their traffic through the Route 114/Mill Road/Willow Street intersection , when the intersection is signalized. Furthermore, the FEFR has shown that there is a need to improve the Route 114 site driveway, since traffic delays will be experienced by left-turning move3nents. (The draft. EIR shfewed are LOS E at the Route 114 , site driveway; the final E I R showed LOS D, C at the same locus . ) Therefore, it follows that a supplemental analysis of this possible alternate driveway is necessary before a state curb cut permit can be issued. Consideration should be given to a Chestnut Street driveway in addition to a Route 114 driveway. The possibility of limiting the driveways to right-turning movements could enhance traffic flow patterns. Further, this would restrict the volume and distribution of the traffic on local reads , which is objectionable according to the FEIR. The fall build traffic scenario incorporated the two existing buildings and the two proposed buildings (pp 10) . Table 3 shows that this project will not in and of itself contribute to the deterioration of the level of service along this section of Route 114. However, the traffic impacts of other proposed projects in the area do not appear to have been considered in the full build capacity analysis . Consequently, this report gives the impression that Route 114 capacity will not decrease under future conditions . The FEIR should have included the project expansions of the Willows Tech Park , the Willow Condominiums , the North Andover Business Park, the development at Watts Regulator and possibly the proposed commercial development at the present site of the Wok Restaurant. Conceivably , the compound effect of these developments and the proposed office park will result in a decreased level of service on Route 114. The final traffic report requires further clarifications of the commitments the proponent will be raking toward controlling and improving the traffic mvefents into and out of the site. The supplemental information should unequivocally state the mitigation activities for which the developer will take fall responsibility. These remedial actions should provide a basis for the required Chapter 30, Section bl finding. Finally, a general observation has been made that it has been a ,year since this project review was initiated.
