DATE May 14, 11997 4WI RE„ WETUND RESOURCE AREAS @ PROPOSED STOP &'SHOP s you may be aware, the appllicant for the above referenced project has filed a Request for Determination of ,pplicabilict with the Norttn Andover Conservation Commission ( A ) Specifically, they are seeking confirmation of"all wetland boundaries jurisdictional under the Massachusetts Wefland Protection Act and NI arktn And ver Wetland t a+ „ n-site jurisdictional vmetlands include: 1., Bordering Land unbject to FIloodlin (i,e. wflaiodplairn");, . Bordering Lamed Subject to Flooding: lloodplain elevation of 2 .74' 1 D 'has been proposed by,the applicant and subsequently approved by the NA,C C at a public hearing on M ay 7, 1997. I i erfro t Area. At the time of inspection, Mosquito Brook was observed to be flowing by this Department and time appliicant"s irepresentative, Mr. Curt Young of'I PI, Inc; thus it may be interred that thin stream,is pereunnia] and subject to,juris"diction under time Rive&ont Act. The burden is on the applicant to prove otherwise and as a means of facilitating this review I have requested additioinal supporting data from WPI per the NACCI 'Riverfront Area Guidelinesm, As a result, no dleterrnirnation was made under this fling Mosquito Brook is almost 200' away and should the Riverfront Act apply, this Department does not anficiplate significant iissues. Borded ng Vegetated Wetlannd ( )& 'Bantu: Time B 'arnd Bank delineation as depicted on time plans currently before the Planning Board its accurate. No modifications were rnade to,time fagged live by this Department. traater arnaeu ,ernt: It Is assumed that time appliicant will file a Notice of Intent with the NACC for future work.on the subject parcel, While I do not foresee "major" problems, specific to wefland setbacks I do anticipate a detailed and complicated review of the proposed storm water management system. The applicant with be expected to clomply with DER"s "Storrrmmvater Management Policy"'which hich a tempts to address both neater qualit (pollutants), and water quantity(hood control) problems by establishing time level of required controls through(lie use of PMP's. The,applicant has repeatedly stated to this Department and the NACC that his, representative is designing the drainage system according to DEP pol'icy. If this is accurate and the work is correct, than a lengtimy review process with the NACC its not likely..
