When a snow or ice condition exists during the progress of this work, the Grantee shall keep the highway well sanded to a point not less than two hundred ',200) feet beyond the limits of the barrier® and signs. The Highway surface all be kept clean of debris at all time and shall be thoruughly cleaned at the completion of this permit. The drive/drives shall be surfaced with Bituminous Concrete, Type I and shall be comprised of a 311 Class I Bituminous Concrete Base Course and two (2) 1 1/21, courses of class i Bituminous Concrete Pavement for a total depth of 61, with a foundation of at least 6o of compact gravel , The finished surface shall butt into and not overlap the existing highway grade at the road edge_ Thedrive/driv8s shall be so graded that no water shall enter the layout nor pared or collect thereon, including the roadway. The curb cD.-ners or radii may be painted at the time of installation. Said c-irb shall be painted yellow only. The Grantee shall construct an island between the driveways. The leland and the drives shall be defined by bituminous curbing six (6) inches above the grade of the hardeaed surfaces. Said curbing zhall be our (4) feet from the edge of the highway. The curb shall be placed in conjunction with or immediately before the completion of the driveway surfacing. That part of the drive/drives located within the limits of tre State Highway shall be maintained by the Grantee, at his own expense and to the satief action of the District Highway nirector or his representative, wheelchair ramps shall be constructed in accordance with the provisions of the Architectural Access board Regulations. (Sections 21 . 1 and 21.1.2) All utility companies whose services are located within or adjacent to the propceed installation areas shall be notified in writing of ,the propoaed installation at least 48 hours prior to the start oE ally excavation in said areas. After being mechanically compacted thoroughly, the foundation shall be at least 8 inohea in thickness and parallel to the proposed surface of the walk. At driveways, the sidewalk shall be 6 inches in depth. If applicable, the bituminous concrete sidewalk surface shall be laid in 2 courses to a depth after rolling of 2 1/2 inches. The bottom course shall be 1 1/4 inches in thickness and its surface after rolling shall be 1 1/4 inches below the parallel to the proposed grade of the finished surface. The top course shall be i 1/4 inches in thickness after rolling. it shall be the responsibility of the Grantee to replace all pavement markings which have been disturbed by this permit. The site is mostly developed with the McLay' s Florist & Garden Center and an N.E.R. Construction office located on site . Surrounding land uses include a gas st(.tion and office complex located to the south, a small strip retail center to the north, more office space across Route 114 to the east and an industrial park located behind the site to the west . The existing 15, 000 sf McLay' s retail building, 22 , 000 sf of greenhouse space and the 6, 000 sf N.E.R. office building will be demolished and removed from site . Primary site access is proposed via a signalized intersection where McLay Road intersects Route 114 .1 Secondary access and delivery truck access will be from town-owned Willow Street located along the northwest quadrant of the site . According to the proponent' s calculations and assumptions it is expected that the project will generate approximately 6, 770 new vehicle trips per day (this is in addition to the existing 2 , 904 vehicle trips to the site) 2 . The project calls for a total of 1 - McLay Road is a small cul-de-sac located between the gas station and the existing greenhouses and serves as access to N.E.R. 2 - Because of the existing land use (florist and garden shop) , time of year (seasonality) is a major factor in the amount of traffic that is generated. It is likely that the approximately 100%RECYCLED PAPER EOEA##11037 DRAFT Record of Decision March 28 , 1997 301 on site parking spaces . Categorical Inclusion The project is categorically included for the preparation of an Environmental Impact Report (EIR) pursuant to 301 CMR 11 . 25 (19) in that the project is likely to generate in excess of 3 , 000 new vehicle trips per day. Jurisdiction The project will not seek state funding or financial assistance . MEPA jurisdiction therefore extends to the subject matter of the state permits and approvals required or potentially required for the project . A Highway Access Permit from the Massachusetts Highway Department (MHD) is required for the project . As currently proposed, the project includes mitigation involving changes to the state highway layout which requires MHD approval as well . As explained in more detail below, the need for this approval establishes MEPA jurisdiction over traffic and related air quality impacts . In addition, in regard to the proposed demolition, the following notifications to DEP may be required: Notice of Demolition and Construction ; Notice of Limited Removal Action; Notice of Asbestos Removal and a Limited Plan Application. The project must also comply with the conditions of the federal National Pollutant Discharge Elimination System (NPDES) General Permit for construction activities disturbing in excess of five acres . Waiver Request A request for a waiver from the requirement to prepare an Environmental Impact Report was included with the ENF submitted on February 18, 1997 . The waiver request was discussed fully at the public consultation session held at the site on March 13 , 1997 . The following circumstances were put forward to support the waiver request : 1 . The proponent argues that the impacts of the project are insignificant and that the existing site is served by substandard, uncontrolled, wide open curb cuts onto Route 114 . Furthermore, the proponent argues that the proposed land use will improve the aesthetics of the built environment . 3 , 000 existing vehicle trips more accurately reflect spring weekends rather than average daily vehicle trips . 2 EOEA#11037 DRAFT Record of Decision March 28 , 1997 2 . The proponent argues that ample and unconfined infrastructure exists to provide an adequate supply of potable water and to treat sewage . Also, with the proposed signalization of the Super Stop & Shop site drive (and coordination of existing signals within the area) and the widening of Route 114 (see below) , ample and unconfined infrastructure will exist to accommodate the proposed use . 3 . The proponent argues that the terms agreed to as a condition of the waiver will bring about environmental benefits in excess of those that could be achieved in the absence of the waiver. The proponent will reconstruct Route 114 over an approximate 1, 200 foot length, from Willow Street to Jasmine Plaza, to include five full lanes . Roadway widening will occur on the southern (or McLay side) side of Route 114 . The timing and phasing of the Route 114/Willow Street/Mill Road intersection will be modified to correspond with the proposed site drive signal and result in an improved level of service (LOS) from LOS F to LOS C. The proponent will 'fund a corridor planning study, to be administered by the Town of North Andover, in which the Route 114 corridor from Jasmine Plaza north to Route '125 will be analyzed. The study will be of sufficient detail and expertise to provide' the Town with the information necessary to apply to the MHD for Transportation Improvement Plan (TIP) funds . 4 . The proponent argues that requiring the preparation of an EIR would not serve to minimize damage to the environment beyond what has already been accomplished through the preparation of the Traffic Impact and Access Study (included in the ENF) prepared in conformance with EOTC/EOEA guidelines for traffic impact assessment . In addition, the proponent states that " [t] he project planning/design team has met with various town departments with the current plan receiving conceptual approval from the town subject to final review of engineering plans and specifications . " Criteria for Waiver The MEPA Regulations (301 CMR 11 . 18) provide that a waiver may be granted upon a finding that strict compliance with the regulations will result in undue hardship and will not serve to minimize or avoid damage to the environment . This finding shall be based on one or more of the following circumstances : 1) the impacts of the project are insignificant; 2) the aspects of the project which cause it to be categorically included are not within the subject matter jurisdiction of MEPA; 3) ample and 3 EOEA#11037 DRAFT Record of Decision March 28, 1997 unconstrained infrastructure exists to support the project ; and 4) the terms agreed to as a condition of the waiver will bring about benefits in excess of those that could be achieved in the absence of a waiver. Findings I have carefully reviewed the ENF and supporting documentation, comments received at the scoping session, and comments received in writing on the ENF. Based on this review, I make the following findings : 1 . The potential traffic impacts from the project are significant (as is explained further below) but have already been analyzed in the Traffic Impact & Access Study accompanying the ENF. The proponent has committed to fully implementing the traffic mitigation outlined above and the local Order of Conditions will no doubt formalize commitments to minimize and mitigate wetland resource impacts . I find that the proponent has demonstrated that, when implemented, the traffic mitigation measures will serve to minimize the actual traffic impacts from the ,proposed development . All roadway work must be completed prior to the opening of the Super Stop & Shop 2 . Not all infrastructure is in place to accommodate this project . While adequate water and sewer facilities exist, an entirely new drainage system will need to be constructed and the aforementioned road work must be completed. The proposed on site drainage system will consist of subsurface infiltration and detention facilities . Two underground concrete basins will be constructed. One will be utilized for compensatory flood storage and the other for storm water attenuation. The basins will be constructed above groundwater level (to allow enfiltration around the dry wells) and the periodic flooding that currently occurs on site will be stored under the parking area and mitigated. All catch basins will be equipped with gas traps and sediment sumps which should significantly improve the quality of storm water currently leaving the site . The proponent is required to supply the Town of North Andover with an operation and maintenance plan for the storm water and flood storage facilities . 3 . Storm water and erosion control measures will be implemented to mitigate potential adverse construction impacts of the project . The project will be developed in accordance with North Andover Conservation Commission and Planning Board approvals . 4 . The terms agreed to as a condition of the waiver will bring 4 EOEA#11037 DRAFT Record of Decision March 28, 1997 about benefits in excess of those that could be achieved in the absence of a waiver. While the majority of mitigative road work and on site drainage improvements are necessary to make the project site workable, the commitment to conduct a corridor study along Route 114 will be helpful to the Town of North Andover (in that it represents a fiscal savings and will allow them an opportunity to apply for state aid) and the Commonwealth '(in that the study will address a long standing need to accurately assess and mitigate traffic congestion in this area) . 5 . As a condition of this waiver and to be consistent with the provisions of the State Implementation Plan (SIP) ' for ozone ' attainment, the proponent must conduct an indirect source review (mesoscale) analysis . This analysis must include both an estimate of the volatile organic carbon (VOC) emissions associated with all project-related vehicle trips and a demonstration that the VOC emissions associated with the preferred alternative will be less than those from the no-build case in both the short and long term; in case hydrocarbon emissions from the preferred alternative are expected to be greater, the analysis should include identification and review of all reasonable and feasible reduction/mitigation measures (including all travel demand management strategies alluded to in the ENF filing) . Prior to proceeding with the analysis, consultation with the DEP' s Division of Air Quality Control is recommended for guidance as well as confirmation of the study area. The mesoscale analysis (including commitments for implementation of travel demand management (TDM) strategies) must be distributed to those on the ENF distribution list and to those who commented on the ENF. The Final Record of Decision will not be issued until the mesoscale analysis is completed and circulated. 6 . The project appears to generally have the support of the Town of North Andover, and the Massachusetts Highway Department has indicated that it believes "the waiver request has merit and that the proponent has adequately documented the project' s traffic impacts . " Based on these findings, it is my judgement that the waiver request has merit, meets the tests established in 301 CMR 11 . 18, and will serve to advance the interests of the Massachusetts Environmental Policy Act . Therefore, I propose to grant the waiver for the Super Stop & Shop on Route 114 in North Andover, subject to the aforementioned findings and conditions . This Draft Record of Decision shall be published in the April 10, 1997 5 EOEA$#11037 DRAFT Record of Decision March 28, 1997 issue of the Environmental Monitor for a fourteen day comment period, after which I shall reconsider, modify, or confirm the waiver. This permit is granted for the specific signal installation described herein and for its operation in accordance with the conditions set forth below and with the requirements of the Massachusetts Highway Department. The details for any material alterations or any continued* or substantial departure from the provisions of this permit must be submitted to the department for approval with data sufficient to justify such modification. Failure to comply with these requirements automatically voids this permit during such time as non-compliance exists. I. STANDARDS OF INSTALLATION The traffic control signal installation and all auxiliary sign and surface markings which are used in conjunction with such installation shall conform with the requirements of the Massachusetts Highway Department and with the sketch which is attached. II. (f) Flashing Operation: Whenever a signal is not operating as a control device (stop and go), it must Flash Yellow or Flash Red as set forth in the signal sequence and at the rate of 50-60 flashes per minute unless otherwise specified in Part II(d) of this Permit. (g) Manual Operation: Signals may be operated manually at any time irrespective of the hours designated in Part H(e) of this permit. (h) Discontinuance: Signals may be discontinued at any time. When this is done signal faces must be turned away from traffic, taken down or hooded, and the District Highway Director notified.
