The Board of A~eals held their reg-~- moeting on ~onday evening, October
1966 at 7:30 P.M. in the Town Office Building. The folle~-8 members were preaeat
and voting: John J. Shields, Cheirmea! James A. Deyo, Secretary$ Dcaald J. Scott,
Daniel T. 0~Leary, Arthur Dr~w~n~d and A~soniate Me, her Howard L. Gilman.
There were ,~o beari~ ~heduled for this ~eeting. ~
The Beard members read the decisioas for Wilbur Earvey and ¥~ ] age Land Co.~ and
signed the =eeessary ~laas - also for Hoyt.
Charles Foster,~e~ ~iI~-g ~nspector and John ~lker were ~resent to discuss a
· a%ter with the Board. A Special Permit for a~artments cci ~ Street had bee~
granted to North Essex Realty Trust. Mr. Fo~ter explained ~t Mr. Walker had
a~lied for a building permit for almrt~en%s at %her location. The appliea%iow
~as for a different type of almrtmont building t~ ~as granted by the Board to
North Essex Realty. Trust. Mr. Fo~ter questione~ whether or ~ot he could issue a
per~% limes it was for a ec~aletely different type ~,~&~. Mr. Wn~er explained
the ty~e of building he would erect.
The Board ~mmber~ seemod to feel that a new hearing should be held since the original
permit was for a different type

The following ~-~tations and conditioma are made part of the ap~oval for the erection
of 20 units as heretofore outlined an~ evidenced by the exhiktta submitted.
a. That all conditions of the Z~-~,g ~y-Law, Section 4.7 thre~gh Section 4.74, shall

regulations set forth in Sections 4.~ through 4. ~4 tnclusfve of the Zo-~-S By-Law in ~11

Highway De~u~me. nt, the Police Department, and the Fire Dept. shall be ~t ~by the
applicant.
d, That the subject permit is issued to the applicon% and ~]]~ not be transferrable
or assigned;
e. That the number of units ~ be limited to 20 in number in accordance with the
pleading for this permit.

g. That this l~er~% is g~ted with the provisicas that the project md c~strue%ioa
s~.ll co~nce not later t~ 6 months fr~m the date of this approval, and that
failure of this eonditi~ +ehall came aut~tio x~ .seinding of this permitunlems the
Board of Appeals may consider an extension of this ti~ factor.
h. That the architectural design and layout shall Be adhered to, without deviatica,
in accordance with the architectural ~lans submitted and made part of the permanent
records of this permit.
t. That all future ~te~ce of roads and utilities so constructed and
stalled by the a~plic~t mb-l~ remain the responsibility of the applicant.
J. That a copy (re~rodueti~n) of the rendering of said complex shall be subaitted
to the Zon~-g Board of A}peals to be incorporated in the exhibits to which this
permit is conditioned.
That any propeaed feting, perimeter or t~herwiee, shall be referred to the
Zoaing Board of A~peals for their consideration and approval.
RULES AND REGULATIONS OF BOARD ~F APPEALS:
Ohai~n Shields showed copies of drafts of Rules amd Kegulstio~s of the Board of
Appeals. Several sections were ~is~sed by the members. A coFt bas already-bees
submitted to T~en Counsel. It ~as also brought out that Associate Members should
be appointed each for a 3-year term.
The necessary bills were signed.
