After a public hearing given on the above date, the Planning Board
voted to. Approve the Site plan Review - Special Permit
based upon the following conditions:

`Phis work mast be cam 1)lefed by May 31, I998. A bond ofS2,000 must be
pasted to ensure compliance with this condition. When the re-striping is eompiete,
the applicant may request the release of this bond.
2. The Plauuiug board agrees to postpone the cousiructiork oGitwen PaIckiRg spaces
noted as "spaces not to be built at this tirne" on the Re-striping plan referenced in
Condition 20 below.
3_ Prior to tit endorsement of the plans by the Planning Board, the applicant
must comply with the following conditiorts:
a) The following must be added to sheet 4 of approved the plants per the
Department of Public Works:
i) "Mass 5 " added at the end of Note 2 line i.
ii) "Type IC' added at the end of Note 2 line 2.
b) Idenitification of the location and landscape schedule of all perimeter and
interior landscaping must be provided. Landscaping required by the
Zoning Bylaw must be indicated on the plan in tabular loan with the
amount required and species shown,
c) The final plan must be reviewed and approved by the drainage consultant,
DPW and the 'Town Planner and subsequently endorsed by the Pkuming

Board. The final plauls must be subtrdtted for review within ninety days of
Iiling the recision with the Town Clerk.
d) A bond in the anioimt of$3,000 shall be posted for the purpose of insariDg
that a final as-built plan showhig the location of all on-site utilities,
structl re5, curb cats, parkjug spaces and draimgc l`acllltIes I subn ted.
The bond i� also i a place to insure th4t the site is constructed in accordarnce
with the approved plan. This bond shall be in the fumi of check rnadc out
to the Town of North Andover. This check will then he deposi Led imo an
interest bearing escrow account.
4. Prior to the start of construe fort:
aj A construction schedule �ftall be submitted to the Planning Staff"li>r the

anticipated activities on the site.

and reviewed by the Town flamer.

installed as shown on Sheet 5 of the approved plans.
5_ Prior to FORM U verification (Building Permit Issuance),
a) The final site plan mylars must be endorsed by the Plawiing .Board and
three 3) copies of the signed plans rntist be delivere-d to the P€ate ing,
Department.
b) One cerlified copy of the recorded decision must be submitted to the
Planning Department,

a) HVAC: equipment or other equipment 1h4t will emanate noise shall be
placed on the exterior of the structure as shown on the plans.
b) The applicant must s€tbinit a letter front the anhitect or engineer of [he project
stating that the building, signs, landscaping, liglift and site layout substantWly
comply with the plans referenced at#lie end of this recision as endorsed-by the
Planning Beard,
c) The landwaping must be planted as shown on Sheet 2 of the approved and
endorsed plans and as required in Condition 3(a),

(1) A11 ail ificial lighting used to illuminate the sits: shall he approved by the
Plwuii ag Staff. All lighting shall have underground wiring and sha11 be so
auzinged [hat all dIrecI rays fZom such lighting f&entirely within the site
and sha11 be shielded or recessed so as not to shim upon abutting
properties or streets. The site shall be reviewed by the Plaruting Staf. Any
changes to the approved lighti ig plan as may be reasonably required by the
Planning Staff shall be made at the owmer's expense. AU site fighti ig shall
provide security for the site and structures however it must not create any
glare or project any light onto adjacent residential pwpe�-ties,
e) The building mast have cornmercial fire sprinklers installed in accordance
with the North Andover Fire Depmunent.

a) The site shall be reviewed by the Planning Staff. fury screening as may be
reasonably required by the Planning Staffwill be added at the applicant's
expense.
b) A final as-built plan showing fmal topography, the location oFall on- site
unities, structures, curb cuts, parking spaces and drainage facilities must
be s,ubmiaed to amd reviewed by the Planning Staff and the Division cif'

S. Any stockpiling of materials (dirt, wood, corrstrtsction InateriaL etc) must be
shown on a plan and reviewed and approved by the Plamting Staff. Any approved
piles must rerr in covered at all times to m'trttmi e any dust problen-is that may
occur with adjacent properties. Any stock piles to remain for longer than one
week must be fenced off arid covered.
9. In an effort to reduce noise levels, the appheant shall keep in optimum working
order, through regular Tfaintenauce, any and ah egoipment which shall eiramate
sounds froni the structures or site.
10. 'The hours for trucks entering the site, Ior shipping , receiving and waste hauling
shall be Hmited to between the hours of 7 asn and 7 p,rn. Monday through Friday.
Snow ploy ing may occur during operating hours and no more thaw t ( ) hours
prior to the opening of the facility and four Hours after the closing.
11. Any plants, trees or shrubs that have been imorporakted into the Landscape Plan
approved hi this decision that die within one year from the.date of planting shall be
