SELECT BOARD MINUTES MAY 13, 2022
Call To Order: Chair Laura Bates called the meeting to order at 8:45AM. The open session meeting was recorded.
Attendance (roll call vote taken): Chair Laura Bates, Janice Phillips, Richard Vaillancourt, Chris Nobile, Rosemary Smedile,
Town Manager- Melissa Murphy Rodrigues, Deputy Town Manager, Denise Casey, Town Counsel, Suzanne Egan and Assistant
Town Manager, Laurie Burzlaff were present.
Chair Bates read the following:
“Pursuant to Chapter 20 of the Acts of 2021, this meeting will be conducted via remote means. Members of the public who wish to
access the meeting may do so on their televisions by tuning to Comcast Channel 8 or Verizon Channel 26 or online at
www.northandovercam.org. No in-person attendance of members of the public will be permitted, but every effort will be made to
ensure that the public can adequately access the proceedings in real time, via technological means. In the event that we are unable to
do so, for reasons of economic hardship and despite best efforts, we will post on the website an audio or video recording, transcript,
or other comprehensive record of proceedings as soon as possible after the meeting.”
Executive session pursuant to M.G.L. c.30A, Section 21(a)(3)- to discuss strategy with respect to collective bargaining
Chair Bates declared an open meeting may have a detrimental effect on the Board’s negotiating position.
MOTION: Mr. Vaillancourt made a Motion, seconded by Mr. Nobile that the Select Board enter into Executive Session pursuant
to Massachusetts General Laws, Chapter 30A, Section 21(a)(3) to discuss strategy with respect to collective bargaining. Motion
approved by roll call vote 5-0.
NEW BUSINESS
Vote to sign development Agreements with Trinity and Merrimack College
Town Counsel, Suzanne Egan, reviewed the terms of the development agreement with Trinity and Merrimack College. The terms
were voted on at a previous meeting and were incorporated into a formal agreement. Attorney Egan went through the differences
between the term sheet and the final agreement. Ms. Smedile indicated her disappointment with the Merrimack College agreement
and that the amount should increase by 2.5% each year. In response to a question from Ms. Smedile, Ms. Rodrigues stated the vote is
majority.
MOTION: Mr. Vaillancourt made a Motion, seconded by Ms. Phillips, that the Select Board authorize Town Manager, Melissa
Murphy Rodrigues, to sign the development agreements with Trinity and Merrimack College, as presented. Roll call vote:
Vaillancourt-yes, Smedile-no, Nobile-yes, Phillips-yes, Bates-yes. Motion approved 4-1.
Ms. Smedile indicated there were some additional items she wanted to see in the agreements, particularly with Merrimack given their
purchase of the abutting property. Ms. Bates indicated that Merrimack is not required to pay us anything and the Town Manager and
others spent a long time negotiating the agreements.
Town Manager Rodrigues left the meeting at 9:00AM
Vote on collective bargaining agreement between the Town of North Andover and police lieutenants for the term of July 1, 2021
through June 30, 2024
Deputy Town Manager, Denise Casey, reviewed the terms of the agreement. The lieutenants will be leaving civil service (provided it
is approved at Town Meeting), the agreement is in line with others in Town, and it will allow the Town to create 3 lieutenant
positions (replacing 3 sargeant positions).
MOTION: Mr. Vaillancourt made a Motion, seconded by Ms. Smedile that the Select Board approve the collective bargaining
agreement between the Town of North Andover and Police Lieutenants for the term of July 1, 2021 through June 30, 2024.
Motion approved by roll call vote 5-0..
ADJOURNMENT
MOTION: Mr. Nobile made a MOTION, seconded by Ms. Phillips to adjourn the Select Board meeting at 9:15AM. Motion
approved by roll call vote 5-0.
