It is therefore necessary that the drainage be recalculated and if newesary redesigned. Of Lessor concern ire the exposed side slopes in the wetlands along the northern edge of the property and the necessity that this area be stabilized , in addition to guardrail installations. Mc Las y: Responding to your correspondence of 12/20/86 we wish to advise that Mr . Wilbar has organized this company this company in a manner such that his direct involvement in problems of this nature is totally unnecessary. Construction rclated. problems are handled by the construction department as is the one presently in question and we would request that any future correspondence be directed accordingly . The drainaget system as designed by LEA Inc. , is functioning as it was intended. it is only as a result of the unanticipated high water lQvcl of the reservoir across Rt 114 that has caused the system to back flow into your yard . we also would like to correct your statement that the water is "several feet'''' deep but rather 6 to H inches. Pluase be advised that American Development is presently taking the appropriate steps to correct this condition . in fact prior to receipt of you letter LEA Inc . , had already sent out a survey cruw to check invert elevations and is now, in the process of designing a modification to the drainage system c um a to ircvent reoucurance of this problem. Rest assured that once the design modification is in hand it will be implemented immediatly . Responding to your request our engineer prepared a plan showing his proposed solution and sent it to your engineer on 1/ 19/87 . , Later that week when you engineer Joseph Cushing was contacted to review the proposal we were advised that since he had no purchase order from you he could not discuss the plan . Six weeks later, having received no response, your engineer was contacted again. We were told that he did not like the flap valve so the plan was revised and sent out on 3/27/87 . Although no formal written response was received we were: advised that the prope,sed fill and construction of a swale inns unacceptab% .
