Pursuant to my telephone conversation with you yesterday I would
like to delineate significant points concerningthe land5c apin
at Willow Free Place .
Due to the fact that the finish coat of bituminous paving is being
applied on Wednosday, August 13th, along with bermin , where appropriate,
the finalization f out landscaping plan will teen be able to be
carried out. The finish landscaping ,, l am sure you will, find, will
exceed the original landscape Galan both quantitively and qualiti el„ .
These two tasks should certainly be completed to by September 5th.,
hopefully, this letter will serve to answer any outstanding aluastion
the Planning Board might have on the subject.,

n a November 21st ,site inspection during the rainstorm
it was clearly evident that the ekisting drainage structures
are At functioning . It is therefore necessary that the
drainage be recalculated and if newesary redesigned. Of Lessor
concern ire the exposed side slopes in the wetlands along the
northern edge of the property and the necessity that this area
be stabilized , in addition to guardrail installations.
The Planning Bead is providing you with a time period
f three weeks to meet
and discuss those issues with ass . The
matter has been placed on the December 1 th meeting. T encourage
you to schedule a meeting prior to that date to meet with me .

Dear Mr . Mc Las y:
Responding to your correspondence of 12/20/86 we wish
to advise that Mr . Wilbar has organized this company this
company in a manner such that his direct involvement in problems
of this nature is totally unnecessary. Construction rclated.
problems are handled by the construction department as is
the one presently in question and we would request that any
future correspondence be directed accordingly .
The drainaget system as designed by LEA Inc. , is functioning
as it was intended. it is only as a result of the unanticipated
high water lQvcl of the reservoir across Rt 114 that has caused
the system to back flow into your yard . we also would like
to correct your statement that the water is "several feet''''
deep but rather 6 to H inches.
Pluase be advised that American Development is presently
taking the appropriate steps to correct this condition . in
fact prior to receipt of you letter LEA Inc . , had already
sent out a survey cruw to check invert elevations and is now,
in the process of designing a modification to the drainage
system c um a to ircvent reoucurance of this problem. Rest assured
that once the design modification is in hand it will be implemented
immediatly .
Should you have any further questions or problems concerning
the above please feel free to contact this department dire ctly.

Dear Mr. Flanagan:
The Planning Board discussed the drainage of Willow Tree Place
at their meeting of February 2, 1987. We would like to be kept informed
of the action taken to alleviate the problem with the drainage on site and
off site (particularly McLay"s: Florist at 757 Tornpike Street) .
We are requesting that you submit to the Planning Board the plans
and the accompanying drainage calculations showing the current drainage:
and plans showing proposed action to be taken to correct:
1. the drainage off site onto McLay's lot;
2, the drainage on site, from the grean in the parking lot and
showing use of the designed retention ponds,
We would like to know at your earliest convenience the action to
be taken and a schedule of when and how you intend to correct the probldms.

13,ank on December 20th of last year you sent registered
letters out to all concerned parties regarding the flooding
problem which has occurred on your property since the
completion of Willow Tree Place . in this correspondence yolm:m.
expressed a concern to have " . . . something done to rectify
this condition. . . " .
Responding to your request our engineer prepared a plan
showing his proposed solution and sent it to your engineer
on 1/ 19/87 . , Later that week when you engineer Joseph Cushing
was contacted to review the proposal we were advised that since
he had no purchase order from you he could not discuss the plan .
Six weeks later, having received no response, your engineer was
contacted again. We were told that he did not like the flap
valve so the plan was revised and sent out on 3/27/87 .
Although no formal written response was received we were:
advised that the prope,sed fill and construction of a swale
inns unacceptab% . We again revised the plan addressing your
complaints and submitted it to your engineer on 3/27/87 ,
To date almost two months has lapsed and aftcr repeated
phone calls to both you and your engineer we have received
no response.,
