Dear Mr. Long :
The North Andover Planning Board held a public hearing on
Monday evening-, - July f , 1985 at 8 : 00 p. m. in the Town Office
Meeting Room upon the application of American Development Company
-- of Stoneham , MA. The hearing was advertized in the Nortb Andover
Citizen on June 13 , and 20 , 1985 . The i=oilawing members were
present at the July 1 , 1985 meeting , Paul A'. Hedstrom , Vice Chairman ;
John A. ,fames , Jr . , Clerk ; Erich Nitascha ; and John J . Burke .
The petitioner seeks a Special Permit under Section 8 , para -
graph 3 ; Site Flan Review of the North Andover Zoning Bylaw.
- The purpose of the Site Plan Special Permit is to review American
Development ' s proposal to demolish the existing Wok Restaurant at
733 Turnpike Street and construct a new restaurant , ' a bank and a
two Story retail office building with associated parking . --'The premises
is located on the southwest side of route 114 known as 733 Turnpike
Street . Said lot is situated in a General- Business District (GP )
possessing 2 . 227 aches of land area , witli frontage of 275 feet.

Conatjitant8 , the - applicant' s repre8entative- gavo tits following
presentations
- They are proposing a single building of 15 , 000 sty . ft .
- The property abets existing watlatnds which an order of
conditions dated Jejn� 19 , 1985 have been issued by the
North Andover Conservation Commission .
- There will be one accessfegreas from Route 114 and one
access from Willow Street with the possibility of speed
bumpa being i-sstalled to eliminate its use as a short cut
to Route 114 and Willow Street .
- It will be a wood frame , single story , colonial there build-
ing .
- proposed tenants : bank , restaurant ( 113 seats ) , sgerialty
stores , such as gourmet food , computer store , and Print
shop .
- Parking will accommodate 79 automobiles with appropriate
handicapped spaces .

Upon a motion made by Paul A. Hedstrom and seconded J�y
John A. James , Jr . , the board voted to grant the petition for
Site Plan Approval under the Special permit process for American
Development Company , plant dated May 3 , 1985 revised to July 12 ,
1985 by Linentthai Eisenberg Anderson , Inc. , Engineera , 75 Kneeland
St . , Boston, CAA 02111 subject to the following :
1 . The applicant shall comply with the requirements of
the hoard of Health regarding the discontilauance of the
septic system and associated structures ;
'2 . A driveway entry permit will be required for entry to
Willow Streets
3 . required written direction by 'the. Planu.ing Beard for. intsallation
of speed mumps to be determined in the fields
4 . The applicant shall be aware of the outstanding respon-
sibility to the North Aixdover Conservation Commission ' s
Order of Conditions dated ,furze 19 , 1985 ;
5 . The building must be fully sprinklered under HGL Chapter
148 Section 26C ;
G . A fire detection system is required and this aystem gust ;
be tied into the municipal fire alarm system through a
master fire alarm hoc ;
7 . Demolition of the existing Vok Restaurant shall comply
with all local and state regulations . The Planning Board
and Dire Chief shall be given 7 days advance notice .
8 . builders shall insure that tenants notify the fire
department prior to occupancy for any additional fire
protection reeds .
9 . This development must also include - a fi -Ke lane " the front
of the building from the area of the ]rank , to the handi-
capped ramp oa the curb in front of the restaurant. In
reference to recently passed article 53 adoption of a
Fire sane Bylaw . The Fire Lane should be marked in
striped paint.

12 . A do-not enter sign shall, be placed at the end of both
the bank iratary and egress to employee parking areas .
Parking shall be sufficient to service the uses permitted
in a General business DistT# ct . Any use requiring more
parking spaces than Shown on plan will require reviev .
In granting this Special Permit , , the Planning Soawd finds ,
pursuant to Section 10 . 31 - Conditions for Approval of Special
Permits of the Zoning bylaw , that the following conditions are
met :
- There will be no nuisance or serious hazard to vehioles or
pedestrians due to the following :
a ) Improvement to Route 114 as required. by the State
DPW which consists of an acceleration and deceleration
lane ;
b ) The traffic flow within the site consisting of a
bank rotary , speed bumps to maintain speed limit ;
one-way traffic along employee parking lot .
Adequate and appropriate facilities , such as town water
and sewer and adequate parking will be provided tot' the
proper operation of the proposed bask., restaurant and
specialty shops totalling 14 ,457 square feet .
Based on site visits , the hearing process , and reviews and
Input by town boards and departments , the aforementioned
allowed uses permitted under Section 4 . 128 General Business ,
is cousidexed to be in harmony with the general purpose
and intent of the Bylaw.
