Deane Mr. Stocking:
The 1988 iYansportation Bond Issue contained a section which -clarii:ies and strengthens
the Massachusetts Department of Public Worts Curb Cut Statute.
Perhaus the most important change made by the 1988 Amendment is to clarify that a
new curb cut permit is required for a change in use of an existing curb cut, for
deveiapineslts which generate a substantial increase in or impact on traffic.
Furthermore, a development abutting the state highway that uses an adjacent local
street to access the state highway, instead of a driveway directly onto the state
highway may still have a substantial impact on the highway. 'Wherefore, a curb cut
permit is also required for major new or expanded developments abutting a state high-
way, whether or not the driveway actually enters the state highway. In aummary the
amendment allows the Department to regulate and require appropriate traffic mitigation
for all developments are state highways which will have a substantial traffic impact.
The,-efare, it is required that your building inspector, planning board or zoning
board inform the District, preferably in writing. of applications for- building permits
and building permits granted along state highways.
This request has become Ixecessary since many developers have performed work without
obtaining the proper permits.
I am also requesting that your planning hoard make the developers aware of this curb
cut palicy.

As a concerned businessmou and a tenant of Jasmine Plaza, I would life to express
my ntisgivings at the idea that a gate Would be installed to limit access to the
Plaza from the industrial Park. I agree that there can be a public safety hazard
created by cars using Jasmine plaza as cut through however, I believe that
restricting access would be detrimental to my particular business. Mail Boxes Etc.
offers a number of business services as well as shipping and packaging services.
"Phase services require the client to bring large item„ either prepackaged or loose
into the center for shiPping, documents to be copied or faxed, etc. Mail Bones
Etc. has often been described as a convenience stare for shipping, postal and
} business services. As you must know a convenience store is only viable as lout as
it's convenience and installation of a barrier to limit access would essentially
become a barrier to business . Mail Boxes Etc. nationwide, and this location in
Particular depends an accessibility and loss of convenience would have a major
negavive impact.
i have observed over the past six years that I have been a Want in Jasmine Plaza,
that the mokring "cut through" has little or no effect an the Plaza due to the fact
that most stares are not open at that time. The evening "cut through", at
approximately fire o'clock, appears to be the major problem. I can appreciate that
the easiest solution would be to erect a gate, but often the easiest is not the
best for those who would be effected. in this case the "easiest" would be a "lose
lose" situation for the Wusinesses of Jasmine Plaza.
I have thought about the situation and suggest that one alternative W lieu of a
gate could be that signs be placed indicating that there would be no through
traffic allowed during the "rush hour" times. I realize that this type of
restriction would be difficult to enforce, however, if an officer were present

Dear Mr. lsaksen,
Thank you for meting with the Technical review Committee
last week to discuss the access issues at the Jasmine Plaza. The
Town Staff is concerned with the number of people cutting through
the Jasmine Playa to get to the Willows office Park and the
traffic hazard that is created.
t the Technical Review Co-mmittee Meeting alternatives were
discussed. Additional speed bumps are not recommended by either
the Police Department or the Fire Department as they do not slow
the traffic down and impede quick fire access.
The 'Town Staff would like to have the owners of Jasmine
Plaza install a gate with ejaerqency access only across the
entrance to the Willows Office Park. Possibly a parking area
ando picnic area could ne created along Willow street to
encourage pedestrian access to the Jasmine Plaza. A parking area
would continue to supply the restaurants with the lunch customers
they rely on.
other issues discussed included the need for a larger
dumpster to service the Plaza. The Board of Health will review
your plans for a larger diimpster in more detail .

Dear Mr. Isaksen,
As discussed at the January Technical Review Committee
meeting, the Forth Andover Police Department conducted a traffic
court at the Jasmine Plaza during the morning rush hour. This
study counted forty 40) oars "cutting through" the Jasmine Plaza
to access the Industrial Park in a one half hour time period.
s The use of the Jasmine Plaza as an entrance to the Industrial
Para is of great concern to the Town due to the taffio and
public safety hazard it creates.
The Town staff anticipates that the use of this "short cuter
will increase this Spring and Sumter during the installation of
the traffic lights. The use of the short cut may continue even
after the traffic lights have been installed as there ,is a
tendency for drivers to avoid traffic sights if possible.
At the Technical Review Committee Meeting, the Town staff
discussed requiring your company to install are emergency acres
only gate across the entrance to the Industrial Park from Jasmine
Plaza. The TRC also discussed aiding you in obtaining parking
and pedestrian access from the industrial park.
I would like you to discuss your plans and tine table for
installing a gate with the Technical Review Committee at their
March 10 meeting. The meeting will be held at 10: 00 a at Town
Hall in the Library Conference Room. If you have any questions

1 am writing you regarding a possible plan to close an existing
egress from Jasmine plaza onto Willow St.
"phis alternative entrance and exit to willow St. facilitates
traffic congestion within the mall area as well as helping to
prevent extreme stacking and difficulty getting knack onto Route
1-14 . 1 believe more traffic problems , merging, etc. would lie
created if all traffic entering the mall was forced to re-exit p-111 ,
onto Route 114 .
In addition, 1 an concerned ak�out fire and medical emergency
vehicles being limited or detained by a single egress.
suggestion would be to wait until the installation of the traffic
light at the intersection, of Route 114 and Willowand examine
the effectiveness of this light to encourage more customers to exit
onto Willow St. for a safe entr&nce onto Ratite 114.

I as the one of shop-owners in Jasmine Plaza, worry about
that this issue might severely influence sty business because I 'ire
heard that the road to the Industrial Park from the Jasmine Plaza
will be blocked to prevent certain problems . Despite the certain
problems, the road is extremely important for my business because
it is the main entrance to the Jasmine Plaza. Therefore, it is one
of major factors which my business rely on
So, please concern the shops in Jasmine Plaza and try not to
block the road if you are planning to do so.
