The legal notice was duly advertised in the North Andover Citizen on May l8 -and Way 25, IS94 and all parties of interest-were properly not ifIed. The -followIny members were present: Richard Nardella, chairman, Joseph 3dahonayr Vice chairman, Richard Rowan, Cloak, John 'Simvrie and John Daghllan. Mr. Rowers read the aegal notice to open the public .gearing. Mr. Rowan read a letter from Merrimack Col7.i�gia, with conccrn8 abort drainage. A memo was -read regarlding a phone conversation with -Maarian Drive naighthGrs, concerns about tra ffbu, aesthetics - gateway to North Andover. Michael Coyne, 306 Hillside Road, expressed concerns with site as it is a gate way to North Andover, first impression of Town based on this site. Mr. Kennedy has made changes basea on comments made by the Town. Mr. Szreons asked Mr. Kennedy to look at Middleton center for an example of New England architecture. On a notion by Mr. Simons, seconded by Mr, Rowent the Board voted to continua the public hearing to Tune 21, 1994. H4 quorum on Jane 21, 1994, therefore public hearing was continua to Tuna 28, 1994. On June 26, 1994 the Planning aoard held a regular meeting, The following members were present: Richard Nardella, Chairman, Joseph -Mahonay, vice Chairman, Richard r-towen, Clark, John Siwris and Alison T-e&carbaau, Associate Member. Mr. Nardella had asked the applicant to come back to the Board with specific chances an the proposed asco Drug. Hr. Mr. Simons questioned the roof, Mr. syszosak stated that the material will be usad on the canopy and the facade, The roof will be flat with muQhavicals. - Mr. Nardella questioned the height of the buflding and if the mechanicals would be covered. mr. Mr. Hytszozak stated that what was being proposed was a block building with a steel roof. Mr. Simons would lime to see a more natural setting at a pejestrian scale with a Village concept, not a building in the diddle of the lot. Mr. UEtr a lla stated that the Dire Department needs a 360 degree access. Yr. Gene Joel, American Drug Stares, spo)ce on the general shapes of the Wilding. Mr, Niarde-Ila requested them to be more creative of the building shape. Kr. Mr. Nardella asked the Board for their ounments, Mr. Mahoney wants to review the traffic study Which was received today. NFr. Rowen agrees with Mr. Simons an the proposed building. Mr. Simons reiterated h- G concerns and personal preferences. Mr. Bowen questioinad the entranri le an Route 125, suggested moving it 25 to 30 ft. away from the intersectivn. Mr. Eennedy tried to answer questions and address concerns. He stated that the n traffic before the intersection travels at a higher speed, A blins cing light was suggested. Ns. Mr. Kennedy went on to say tha he has abided by the zoning bylaw and ho has the right to develop the Parcel. - Mr. Nardella stated that there were substantial improvements made and that the applicant may be in compliance with zoning but he was not happy with the results. Mr. Nardella stated that he and Ms. Colwoll mot with Mr. Kennedy last week to review the plat-, Mr. Kenneth Ilyszak, Cuhelia Associates, gave the Board the following presentation: - modified elevations added roof facade entirely around the building - added dcrners along front - 4 dormers on side O, 5 derm€rs on side A = enlarged cupola Mr. Nardella discussed dormers on side D. - 4 dormers clustered together at entrance to building leaving an expanse of building Mr, Mahoney and Mr. Rouen had no issues with plaoement of dormers. There was a discussion of cupolas versuw Steeple. Mr. Rowen said keep a consistent design, cupola with weatf3er vans. Mr. Mahoney was pleased, with d4asign, replaces church as a landmark, Mr. Simons said he appreciates efforts made by applicant. Fie read a letter reoaived from developer at time of rezoning stating that "in event that the town meeting votes in favor of the rezoning, the proposal- that we bring back to the Planning Board for Site Plan Review will be substantially in the farm tfxat was presented to you at your meeting of April 25th including the architect's and engines-r"s 3`enderinq of the site and buildings. . . . Additionally, in the event that a third party Should buy the property, we will, in detail, explain to this third party the above agreement and -make it a part of any purchase and sale agreement." Mr. Simons further stated that this goes to the integrity of thf� Planning Board and representations ]-lade by the Board at Town Meeting. Mr. James Towle, Andover By-pass, stated there was a problem with traffic, Chestnut Green looking for now parking and access. Vie Hoard should open discussion between OSCv Drug and Chestnut Greens regarding traffic. Ms. Colwell stated that the Board did address traffic issue. The applicant provided a traffic study. The Planning Sward had this traffic study reviewed by the Merrimack Valley Planning commission. The Merrimack Valley Planning commission reviewed study and felt that it. addres'ed all oil the issua5 aMd that further review or study was not required. Mr. Mahoney stated that the Board looked at traffic issue and believes that it has adequately been addressed. Mr. Nardella stated that the -Plnnning Board may put ocriditions regarding traffic on the site in the decision if approved. Mr. gowen questioned the issue DE pulli.ng exit onto Route 125 back away from intersection. Ms. Colwell asked traffic planner at the Merrimack valley Planning Commission about pulling it away. Traffic Planner advised against it bac&use traffic travels quickly down Route 125. Mr. Rowen had guestion5 about maintaining triangle of property owned by the state. -Mr. Nardella requested that the applicant provide a letter fray the state agreeing that ttse applicant will maintain the triangle. Ian Rosensky stated that Ule applicant has done a magnificent job in blending the building into the surrounding neighborhood, Mr. Nardella stated that the windows shown are the windows .that will be constructed. Tbare was a concern about late night deliveries. There will t be no late night deliveries. The store will close at 10:00 P.m. Ms. Lescarh2au questioned where shopping carts would be stored. Shopping carts are routinely colleated, customers generally do not bring shopping carts outside. Ms. Colwell asked tine Planning Board for consensus on waiver of construction of parking spaces alorkg Route 125. 'rho Planning Board's consensus was that constructiop should be waived. Mr. Scott cote, Merrimack College, stated that he was not there to here oe}=ants on rezoning, drainage problem currently exists in this area, drainage problem comes from an area including Chestnut Green. The culvart from the project site goes under Route 125 to Merrimack CD11ege and floods an area at outflow of culvert. Mr. Nardella asked Mr. Cote what Merrimack College was asking the Planning Hoard to do. Mr. Cote replied, require applicant to addr2 ss drainage problem in they area. Mr. Nardella request that O.P,W. look into the site drainage issue. D.-P.W. respond to drainmges concerns raised by Merrimack College's latter of June 29, 1994. The Planning Board makes the followinq findings as req;aired icy the Zoning Bylaw Section 8.3 and 10.3: FINDINGS OF FACT, a. Th12 specific site is an appropriate location for an Osco Drug store as the site is zoned for retail use; 2. The use as devaloped will not adversely affect the neighborhood as the site is adjacent is an office park. There will be nn nuisance or serieias hazard to vehicles or pedestrians as the applicant will comply with the recommendations of an approved traffic study. 3.
