A. Dean Dynan—Appeal of Septic Installer's License application denial
Brian LaGrasse explains why Mr.Dean Dynan's license application was denied due to septic construction
issues with sand and the construction process. (Appendix A.) Dean Dynan defends himself against the
issues stated in correspondence. Brian recommends that the license be suspended for one year.
Motion made by Dr.Patrick Scanlon to uphold the one-year suspension of Septic Installer's License. Mr.
Dynan may reapply for a 2023 license. Seconded by Michelle Davis,all in favor. (4-0-0)
IV. COMMUNICATIONS,ANNOUNCEMENTS,AND DISCUSSION
A. Announcement—Board member Daphne Alva LaFleur has resigned from the Board of Health. Ms.
LaFleur will be missed.
B. COVID19 Updates—Brian LaGrasse and Carolyn Lam discuss the virus. There has been a small
uptick of COVID19 and influenza. Dr.Patrick Scanlon and Dr.Max Tilson discuss COVID19 in the
hospital setting. Unfortunately,the Town of North Andover is up to 94 deaths total over 2 years.
Wastewater data has been added to the packet of information from GLSD. (Appendix B.)
C. Public Health Excellence Grant Program for Shared Services—(Appendix C.)The Town of North
Andover,Health Department,has joined with 6 local communities to apply for a shared services public
health grant. The communities are North Andover,Andover,Reading,North Reading,Haverhill,
Lynnfield and Wilmington. The grant funds are for$300,000 for three years. If acquired,the funds
will be used to hire regional staff to help augment staff employment in terms of inspector backfill,
public health nursing assistance and regionalization trainings. The grant looks promising. The Town
of North Andover would like to hire a training coordinator to help standardize various inspections.
The Community Health Assessment has gone to bid.

Disposal Works Installer's Application #65198
Mr. Dynan:
Please be advised that we received an application to renew your Disposal Works
Installer's Permit in the Town of North Andover for the 2022 septic season. During the 2021
septic season,multiple issues were noted on a septic system you installed at 1010 Johnson Street.
The issues at this location include but are not limited to the following:
• The initial bottom of the bed inspection on June 17'h,2021 noted the excavated area was
not the correct length and width,requiring a reinspection;
• The final construction inspection on July 61h,2021 noted the septic tank did not have a
manhole cover to grade over the effluent filter;
• The final construction inspection on July 61h,2021 noted the pump chamber had floats
that were not adequately secured to the float mast;
• The final construction inspection on July 61h,2021 noted the distribution box needed
hydraulic cement at the pipe penetrations;
• The final construction inspection on July 61h,2021 noted that the sand installed under the
leaching field was not compliant with the specifications required by 310 CMR 15.000.
This was then confirmed by two separate sieve analysis and was ordered to be removed
from the excavated bed bottom;
• Notices of Noncompliance were sent to you dated July 141h, 2021 and July 28'h,2021
requiring you to bring the site into compliance by removing the sand fill that did not
comply with the standards listed in 310 CMR 15.000 and to submit receipts for all sand
to be brought into the site as well as receipts for sand that had already been brought on
site;
• The installation at 1010 Johnson Street was ultimately completed by another installer
due to the new homeowner's decision to move forward with them.
The aforementioned items noted are only from the last installation your performed in 2021
in North Andover. There have been other installation issues at other locations in North Andover
as well. These construction issues require additional inspections from the Health Department
and a delay in the completion of the septic system installation. These issues demonstrate a lack
of knowledge of and experience with the proper construction and installation of systems in
accordance with 310 CMR 15.000. Due to these issues and in conjunction and 310 CMR 15.019
(Title 5), you are hereby given notice in accordance with Section 7.5.1 of the Town of North
Andover's Minimum Requirements for the Design, Construction and Maintenance of Onsite
Wastewater Treatment and Disposal Systems that your Application 465198 - 2022 Disposal
Works Installer's Permit is DENIED.
You have the right to request a hearing before the Board of Health if you feel your
Disposal Works Installer's Application should be reconsidered for approval. A request for said
hearing must be made in writing and received by the Health Department within seven(7) days
from receipt of this letter. If you have any questions, corninents or concerns,please feel free to
call me between the hours of 8:00-4:30 on Monday, Wednesday and Thursday, 8:00-6:00 on
Tuesday and 8:00-12:00 on Friday. Any questions regarding this matter can be submitted to the
North Andover Health Department.

Hi Dean,
We are working on getting the Title 5 sand analyzed that was in question at 1010 Johnson Street. Do you have the
receipts showing where the sand was purchased from?The designer sent over the initial sieve analysis from R. Pepin
and Sons Concrete. If all the sand was all purchased from that location, we may be able to contact them to have them
conduct the sample analysis.
If not,we can use one of the other locations we have contacted.

Outline of septic installation
-6/17/21 - Bottom of bed excavation inspection (load of sand on site was approved). Dean noted he had more sand on
the way, and I allowed him to drop it in the street side of hole as this side was the correct width (25 feet). Hole was 5 feet
short in length and a couple feet short width-wise further down.
-6/21/21 - Bottom bed reinspection & pump chamber hole inspection (bottom bed size was fixed. sand on site was same
quality as 6/17)
-Final construction inspection completed by Dan. O (1 was on site)on July 6th, 2021 and, as usual, Dan dug into 3 areas
of the septic sand to check the quality. Questions arose due to large amounts of staining on our hands. It was decided
that a sample of the sand in question would be sent out for a sieve analysis.
-7/8/21 1 emailed Dean for receipts showing purchase of sand and total amounts (no response)
-7/9/21 1 dropped off a sample of sand from 1010 Johnson Street to Yankee Engineering &Testing in Worcester MA
-7/13/21 we received the attached letter and sieve analysis showing the sand on site did not meet Title 5 Requirements.
-7/13/21 (same day as results)emailed Dean and James Kavannaugh and attached sand sample analysis showing fail. I
also left Dean a voicemail regarding a timeline moving forward for the project.

Hi Stephen,
It is difficult to get a representative sample from an installed site. It can become contaminated with fines during
installation. The overwhelming majority of septic sand we get in the lab, is from the pit. But if you were to sample from the
installed system, make sure you are deep enough where the sand is uniform. Hand augers or post hole diggers work
best, but watch out for the side walls and soil stuck to the sides. A composite of 3 samples should adequately represent
the in-place sand.
Attached is an ASTM for sampling procedures by different methods.

Shared Services originally posted under bid number: BD-21-1031-OFFIC-OLRH-58664 to allow
for additional submissions. Proposals may be submitted for up to$300,000 annually;
approximately 12 additional awards will be made. Please see this link for more information:
The Office of Local and Regional Health (OLRH) of the Massachusetts Department of Public
Health (DPH) seeks proposals from qualified vendors to support public health cross jurisdictional
shared-service arrangements. DPH received additional funding from Chapter 102 of Acts of 2022
for grants to advance the recommendations of the Special Commission on Local and Regional
Public Health in its final report of June 2019—Blueprint for Public Health Excellence:
Recommendations for Improved Effectiveness and Efficiency of Local Public Health Protections
(Blueprint). The report is available at the fallowing link: www.mass.gov/orgs/special-commission-

The Public Health Excellence for Shared Services Grant Program (PHE) is designed to address
the Commission's recommendations to improve effectiveness and efficiency of local and regional
public health by expanding opportunities for sharing of public health services. As noted in the
Blueprint, evidence supports cross jurisdictional sharing to enable local public health to meet
statutory requirements, respond to emergencies, and plan public health improvements.
Only municipalities or regional planning agencies/regional councils of governments representing
local boards of health chosen by the applicant municipalities to serve as their programmatic lead
and fiscal agent or regional health districts established under M.G.L Ch. 111, Sec. 27 or M.G.L
Ch. 40 Sec. 4a, or by special legislation, or charter are eligible for these funds. Municipalities may
not participate in more than one PHE grant application, and priority considerations will be given to
the 74 unaffiliated municipalities plus regional planning agencies and federally recognized tribes
that are not yet already part of an existing PHE grant. To learn more about PHE and our

Eligible entities to apply for these funds are newly formed cross jurisdictional sharing
arrangements with five or more municipalities or federally recognized Tribes that have
demonstrated interest in establishing shared services in order to increase the capacity to carry
out the statutory powers and duties of boards of health.
OLRH anticipates awarding approximately 12 additional contracts with an annualized amount of
up to approximately$300,000 each in the initial award with the reopening of this procurement.
DPH reserves the right to determine the final amount for each award.
