The North Anddver Planning Board bold a Public Hearing on Monday evening,
October 22, 198 in the Town Offite Meeting Room upon the application of Sandra
Lane Realty Trust. The hearing was duly advertised in the La.awrenu;me Eagle Tribune
on OtLober 7 and 14, 1984. .all abutters were notified by mail . The fallo ipg
mohbers were resent: Michael P. Roberts, Vice Chairman; John J. James,, Jr. , Clerk;
John J. Burke; and Erich W. , itzsclue.
The petitioner seeks as Special Permit under Section 48 13:`.l(d) of the North
Andover Zoning Bylaw which requires as Special Permit toallow construction Lo occur
within 100 feet of a tributary in the Lame t:a:aaelaia_lauwi„ck Watershed. The: premises
is known as Lot 30B Sandra Lane; bordered on the north by Clon Road/Sutton Hill Road,
south by F Levine, cast. by NIP Na arian and R/1* Nelson. The lot is both situated
in the Residential - 3 R-3) and Watershed Zoning District. Said :tot possesses
100,768 square feet of area and 125 feet of froarata,ge. on Sandra Lane.
At the hearing, the applicant, her. James 1Philhitn, informed the Planning Board that
his engineer, Mr. Al Sbaaboo was not available for presentation unapt evening. M r .
Phillnian did inform the board that the. dwelling will be connected to thae :ewer line,
-Several abutters spoke in opposition voicing their concern paver the necessity of
locating ng the house: so close: to the WeLlaaand tributary.,
-The Planning Board continued the bearing to. their November 5, 1984 meeting and
requested the following information;
- Status of Glenn Road,
Use of Glen Road as as Common Driveway,
Revise: plans to include locus, contours, locations of ponds: and distances,
to dwellings,
ALLeunalennee of engineer for proper presentation and review.

The November 5, 1984 public hearing was € pened with they same members present
at the October 22ncl mecting.
-W. Shabou, Project Engineer, stated he had only met briefly with the owner to
discuss Ke even Ls of the previous maeting. His discussion continued regarding
the reason for locaLing the dwelling within 100 feet of the tributary as shown
on the revised plans dated 11 f 2 f 84. The major reason for locating the structure
in the buffer zone is to minimize the aesthetic impact on abutters and to preserve
Me larger trees on Lot 30B.
-Several abutters to the property stated thati they preferred -.encroachment in order to
minimizo the impact of construcLion can the ponds and utli=tety Lake Cachichowick.
-Mr. Nitzscbc, member of the board, made a request Lo Lhe engineer:
- Shaw the sewer and water line an the plan
- Pull Lhe house ouL of the 100 foot buffer zone
- Have these plans ready for the next meeting
-The Planning Board mdtionbil to continue the hearing to November 26, 1984
in order to review reprised plans showing dwelling locations out of tba Special
Permit jurisdiction.
The November 26, 1984 public hearing was opened . All me mbers of the Planning
Board were present: Yawl A. Hedstrom, Chairman; Mlehael P. Wbeu8, Vice Chairman;
Jahn A. James,''., Clerk; John J. Burke; and Erich W. Nitzsche.
-New plans were presented Lo Lhe board showing the change in house location which
would not necessitate a Special Permit from the Board.
-The Planner informed the Planning Board mambers that the Tree Warden, Leo Lafond
inspected said premises and reported the following;
1 . The worth of preserving the pond area ire: the Watershed far outweighs LhaL
of keeping; the trues on the site.
2. If the trees remained and the house contructud in tho proposed location, the
change in Me water Lable dua to landscaping and alteratinns would destroy the trees
within a short period of time.
3. The trees are rather old and large, and not a species unique Lo the area.
-The hearing was closed and Lhe matter taken under advisement.
The Planning Board rendered Lheir decision on Monday evening, December 17, 1984
with the following members present :
Upon a motion duly made by and seconded by
the Planning Board
VOTED: TO DENY THE PE'1MON AND PLAN ENTITLED 'Proposed mouse Location on
(30B) Sandra Lane in North Andtaver, MA by Flynn Assoc. , dated 124/84 , revised
11 f 2 f 84 and 11 f 13 f 84, FOR THE FOLLOWING REASONS:
1. The applicant has not demonstrated that the construction of this dwelling,
within 35 fEct of the tributary, wil.i. have lees of an impact on the tributary
and watershed than if the &welling was located outside Lhe 100 foot hufter zone.

. The 100,768 Squara fact of land area clearly exceeds the 25,000 minimum
area requirement in the -3 zoning district, and therefore cap accommodate
the dwelling in another locaUun.
3. The applicant has not exercises! Me various options of relocating this
dwelling on the site.
4. Information and legal dockimentation has not been submitted to the Planning
Board as requastcd regarding the status of COn toad.
5. The lecation of the high water mart or 280 fool conEour has not been verifed
as the edge of a wetland tributary.
6. Drainage and flood calculations have not been submitted and the board is of
the opinion that the dwelling does not provide proper pautectinu from a 100 year
storm or any rojor stoma.
In devyfug this Special Permit request, the planning Board, pursuant to Section
10.31 - Conditions far Ap avrai of Special Permits of the Zoning Bylaw, Unds the
fallowing:
A. The proposed dwelling as shown on Lot 30B Sandra mane is not tale appropriate
1ouatioq for such a use;
B. The use as developed within 35 feet of the tributary will have adverse affects
ou the neighborhood and in the Watershed District. The :applicant }has failed to prove
otherwise;
C. Based on site visits, the public hearing process and testimony from tuon boards
and departments, the location of the use is not in harmony with the general 'Purpose,
and ' intent' of the Town's Zoning Bylaw, specifically Section 4 , 133.

function of the land, the ground water table, the purity of the ground water
and the lake, to conserve the natural environment and to protect the public
