The Planning Board herein APFROWS the Modii"icatica to the Site flail Review Special Permit approved

Industrial 2 (1-2) Zone. This Special Pcrrnit was requested by Wlieelvbrator North Andover, (nc. The
Applicant submitted a watpiete application,which was noticed and reviewed hi accordaace with Section 6.3,
10.3, and 10.31 of the Town of North Andover&n ing Bylaw and M L Chapter 40A,Section 9.The motion
to approve. was suh*t to the F1' lMIKG OF FACTS and SPECIAL CONDMONS set Earth in this
decidon.
The Applicant is hereby notified That shouid the Applicant disagree with this decision,the Applicant has the

In accordance with 8.3 the FIann4tg Board makes the finding that the intent of the Bylaw, as well as its

FMING OF FACT
1) On !August 19, 1998 the North Andover Planning Board approved a Site Plan Revsew Special
Permit for the construction of a 21,493 of new grass floor area.
2) Because of the unique nature of the Site the spooific project is an appropriate loc4atiott for such a
use,structure,or condition.
3) Because of the urxsque characteristics of tho Site the use as developed wi4i not adversely affea the
neighborhood.
4) There will bs no vjx twice or serious hazard to vehicles or pedestrians,
5) Adequate and appropriate facilities wil L be provident for the proper operation of the Proposed use.
6) The use is in harmony with the general purpose of the Zoning Bylaw.
7) The Health Depar rmt has mviewed the proposed imptovements with the Towrr's
Environmental Monitor, T ECM Environmental, and has approved of the construction including
malliwi ng reports to be sure that each phase is executed to inutual satiafacticu befom mother co-

8) The North Andover Fire Depamnent has reviewed the Ash ifouse variance request fresm the
Applicant and has&ranted a varWite to exciusde the instaiiation of sprinklers for the newly
constructed precast concrete structure.In lieu of providing sprinkler protection within the ash
house as required by Massachusa% General Lew,fart 1,Title XX,Chapter 148, Section 26C and
to address the fire departments concerns of providing fire deteotion and preventing fire spread

Finatly the Planning Board finds that this pro*t generafty complies with the Town of North Andover
Zoning Bylaw regnitements as listed in Section 83.5, but requires condifionss in order to be fully in
compliance. The Planning Dowd hemby grants an approval to the Applicant provided the following

wet scrubber t=.Jeswe and filling in out of service basin up to existing asphalt. The project is
located in the Industrial 2(I-2)Zoaxe.

these revisions are deemed substamial, the Applicant must submit revised plans to the Planning
Board for approval.

Board of Health as part of the original hermit. The monitor shad make w"kly inspections of thee
project and provide reports to the Planning Department, and detail any areas of non-
compliance-mid coxrective actions. The monitor must also be available upon notice to inspect the Site
accompanyhig a Planing Departmcnt designated official.
19) A detailed construction sattedule shall be submitted to the Phiwiag Staff for the pnrpose of
tracking the construction aad inforn}ing the public of anticipated activities on the Site.

insuring thAt the Site is constructed in accordance with the approved plan umd that a final as-built
plan is prnvided, showing the loratlotr of all otu-site structuares. This bond shall be in tha form of
a check inade out to the Town of North Andover. This check will then be deposited into an
interest bearing bond awortnt.
