There have been two decisions in the past month;, a This week an indluelpendent third party arbitrator ruled that the I IE 'h ' ; communities should be chargedl a axed flat base fee of approximately $35.5,milllion fortheimprov,ement, MRI had sought to charge the NESWC cornrnunifies$42mjllicin. Significantly, the arbitrator heft enhanced design elements, Which I has proposed but ruled that NESW C should not have to pay for the enhanced design. This is,significant to North Andover since the proposed fabric filter"bag house" is the best technology available and should yield better emission performance at the plant, In June, a Superior Court Judge ruled that, as matter of Ian, the contracts which, the Gonirnunities have with MIRI may violatee the state constitution to the extent Page,1 that they might be read to require pubk dollars to be spent on a private venture, which wM continue in existence after the expiration of the NESWC contracts. The judge has ordered evidentiary hearings to determine what share of the total cast should be charged to the N ESVVC comm unRies.
