HomeMy WebLinkAbout95 Old Cart Way - NACC #295 Small Project - Permits #NACC #295 - 95 OLD CART WAY 6/22/2022 CONSERVATION DEPARTMENT Community& Economic Development Division Mr. Thomas Murtha 95 Old Cart Way North Andover,MA 01845 July 1, 2022 95 Old Cart Way, North Andover Installation of Two (2) Pergolas Conservation Conditions of Approval, NACC #295 Pursuant to section 4.4.2 (A) of the North Andover Wetlands Protection Regulations, Thomas Murtha, filed for a small project for work proposed at 95 Old Cart Way, North Andover. The work involves one approximately 28-ft x 14-ft x 19-ft x 16-ft with pergola with six (6) 12-foot high 6"x6" vertical redwood columns, and another 12-ft x 20-ft pergola, supported by six (6) 12-foot high 6"x6" redwood columns. All columns will be mounted to concrete footings using sonotubes dug by hand. All sonotube holes will be dug to a depth of 3-feet by hand after removing 1-2 patio pavers. Proposed work is located approximately just outside of the 50-foot No-Build Zone (NBZ) to the Bordering Vegetated Wetland (BVW) and is located within a previously disturbed patio area. During the June 22, 2022 public meeting, the North Andover Conservation Commission (NACC) found this project to qualify as a Small Project Permit and voted unanimously to approve this project as proposed under Category"L" subject to compliance with the conditions listed below. The project is approved only as it relates to the Conservation Commission and any and all other approvals should be obtained by the applicant/homeowner. ** The applicant, Homeowner and their contractors are advised that NO other work on the property is allowed under this permit. The NACC has jurisdiction over all of the wetlands and associated 100-Foot buffer zones and 200 Riverfront Area to the Shawsheen River on site and any work that involves ground disturbance or changing the current conditions in these areas will require permitting with the NACC. This includes,but are not limited to,house additions,pools,patios, decks, sheds, fences,garden beds,landscaping and bridge installation, tree or vegetation cutting/pruning. These activities shall be held to the current standards under the Bylaw and WPA. but not limited to All work shall conform to the following_plans and conditions: RECORD DOCUMENTS: Small Project Filing Including: Application Checklist, Written Project Proposal prepared by Thomas Murtha, As-Built Plan prepared by Sullivan Engineering Group, LLC w/ two (2) pergolas scaled on, dated September 29, 2020 95 Ok1 ay 11,a e, 1 o l`2 The following conditions are hereby mandated: CONDITIONS: 1. All excess excavated soils shall be taken off site or moved to an area outside of the 100-foot Buffer Zone. 2. A site visit with Conservation Department shall be scheduled once the project is complete to verify compliance. 3. This permit shall expire one year from the date of issuance.
