NORTH ANDOVER SELECT BOARD MINUTES June 6, 2022
Call To Order: Chair Laura Bates called the meeting to order at 6:00PM in the Town Hall Select Board Meeting Room.
Attendance: Chair Laura Bates, Janice Phillips, Clerk Rosemary Smedile, Richard Vaillancourt, Town Manager- Melissa
Murphy Rodrigues, Assistant Town Manager- Laurie Burzlaff and Deputy Town Manger- Denise Casey were present.
EXECUTIVE SESSION
Chair Bates stated the Board will enter Executive Session to conduct strategy with respect to conduct negotiations with non-
union personnel, to discuss strategy with respect to collective bargaining and declared that an open meeting will have a
detrimental effect on the litigating position of the Board.
MOTION: Mr. Vaillancourt motioned the Select Board enter into Executive Session pursuant to Massachusetts General
Laws, Chapter 30A, Section 21(a)(2) to conduct negotiations with non-union personnel and Section 21(a)(3) to
discuss strategy with respect to collective bargaining. Ms. Phillips seconded. Motion approved 5-0.
The Board returned to Open Session at 7:00PM. The open session meeting was recorded.
RECOGNITION- NAHS Robotics Team
North Andover Robotics Team was present at the meeting.
PUBLIC COMMENT
None.
PUBLIC HEARING- Petition from Massachusetts Electric Company d/b/a National Grid to install underground
electric conduits-Brentwood Circle
MOTION: Ms. Phillips motioned to open the public hearing for the petition of National Grid to install underground conduits
on Brentwood Circle. Ms. Smedile seconded. Motion approved 5-0.
National Grid representative Chris Wellington was present at the meeting regarding replacing cables at the end of life on
Brentwood Circle using directional drilling which is less intrusive. Mr. Vaillancourt asked about the directional drilling,
when it will start and how long it will last. Mr. Wellington stated it will start around early August for 2 to 3 weeks and about
2000 feet. Mr. Wellington stated notice will be given to the neighbors. Joseph Gill 96 Brentwood Circle was present at the
meeting and asked what the recourse is if there is damage to the road. Mr. Wellington stated there is drilling occurring so no
digging of driveways unless there is a utility which is not usual and they will replace the end of the driveway. Ms. Rodrigues
mentioned there will be a bond for the project.
MOTION: Mr. Nobile motioned to close the public hearing for the petition of National Grid to install underground conduits
on Brentwood Circle. Ms. Phillips seconded. Motion approved 5-0.

MVRTA Shelter Location and Design presentation
Andrew Shapiro and Daniel Beckley gave a presentation about installing bus shelters and markers. Mr. Vaillancourt asked
about the commuter bus service from North Andover to Boston. Mr. Shapiro stated there is no current route to Boston from
North Andover. Ms. Smedile asked if it was shut down due to Covid. Mr. Shapiro stated yes due to Covid but also because of
hybrid work schedules with a need to go into Boston but it can be revisited if there is interest. Mr. Nobile asked about the
timeframe. Mr. Beckley stated the next opportunity is in December and it will be announced in July.

MOTION: Mr. Nobile motioned to open a meeting of the North Andover Licensing Commission. Ms. Phillips seconded.
Motion approved 5-0.
Application of Joshua Yaines of Psychic Readings for a Fortune Teller license at 163 Turnpike Street
Joshua Yaines was present at the meeting.
MOTION: Mr. Vaillancourt motioned approve the application of Joshua Yaines of Psychic Readings for a Fortune Teller
license at 163 Turnpike Street. Ms. Phillips seconded. Motion approved 5-0.
Application of Richard Green for a one day entertainment license for All Star Baseball Day at Drummond Field on
June 11, 2022 from 9:00AM to 10:00PM
Rick Green was present at the meeting.
MOTION: Ms. Smedile motioned to approve the application of Richard Green for a one day entertainment license for All
Star Baseball Day at Drummond Field on June 11, 2022 from 9:00AM to 10:00PM. Ms. Phillips seconded. Motion
approved 5-0.
Application of James Dumas of Trinity Congregational Church for a one day entertainment license on June 27, 2022
from 4:00PM to 6:00PM and request for waiver of the license fee
Jay Dumas and Pastor Deborah Adams were present at the meeting. Ms. Rodrigues suggested for Mr. Dumas to apply for a
yearly entertainment license.
MOTION: Ms. Smedile motioned to approve the application of James Dumas of Trinity Congregational Church for a one
day entertainment license on June 27, 2022 from 4:00PM to 6:00PM and waive the license fee. Mr. Vaillancourt seconded.
Motion approved 5-0.
Application of Colleen Hamilton of The Trustees of Reservations for a one day wine and malt license for a father’s
day bash from 5:00PM to 8:00PM on June 18, 2022
Colleen Hamilton was present at the meeting. Ms. Rodrigues asked Ms. Hamilton to clarify the date as June 19, 2022 rather
than June 18, 2022 where the alcohol will be delivered and removed on June 19, 2022. Mr. Nobile mentioned being sensitive
with regard to sound.
MOTION: Mr. Vaillancourt motioned to approve the application from Colleen Hamilton of The Trustees of Reservations for
a one day wine and malt license for a father’s day bash from 5:00PM to 8:00PM on June 19, 2022. Ms. Phillips seconded.
Motion approved 5-0.
MOTION: Ms. Phillips motioned to close a meeting of the North Andover Licensing Commission. Ms. Smedile seconded.
Motion approved 5-0.
OUT OF ORDER: Vote to ratify contract between the Town of North Andover and Police Chief Charles Gray
MOTION: Mr. Vaillancourt motioned to approve the contract between the Town of North Andover and Police Chief Charles
Gray for a term of July 1, 2022 through June 30, 2025. Ms. Phillips seconded. Motion approved 5-0.
Reappointment of Lyne Savage as Town Accountant
MOTION: Ms. Smedile motioned to reappoint Lyne Savage as Town Accountant for a term ending June 30, 2025. Ms.
Phillips seconded. Motion approved 5-0.

Vote to approve disbursement of $350,000 to provide grant to the North Andover Housing Authority for design of
Fountain Drive
MOTION: Ms. Smedile motioned to approve the request of the Affordable Housing Trust to disburse $350,000 from the Trust
to provide a grant to the North Andover Housing Authority for the design of Fountain Drive. Ms. Phillips seconded. Motion
approved 5-0.
Vote to ratify contract between the Town of North Andover and NEPBA Local 102 Communications Officers for a
term of July 1, 2022 through June 30, 2025
MOTION: Ms. Phillips motioned to approve the collective bargaining agreement between the Town of North Andover and
NEPBA Local 102 Communications Officers for a term of July 1, 2022 through June 30, 2025. Ms. Smedile seconded.
Motion approved 5-0.
Naming policy for town buildings and assets
Ms. Rodrigues mentioned need to have a process for naming buildings. Ms. Rodrigues stated this would be for over $500
donations. Mr. Vaillancourt asked what would trigger the request. Ms. Rodrigues stated anyone can submit in writing and
then it goes to Select Board for discussion and vote. Ms. Rodrigues suggested to postpone until next meeting to make a
decision.
Request of Ed Morgan to re-dedicate pond behind 228 Dale Street as Kelly’s Pond
Ms. Rodrigues spoke about the history of Kelly Long and the dedication of Kelly's Pond. This was discussed in previous
Board of Selectmen meetings in prior years but no action seems to have been taken. Ms. Rodrigues stated there is currently a
bench near the pond dedicated to Kelly Long.
MOTION: Ms. Smedile motioned to approve the request of Ed Morgan to name the pond behind 228 Dale Street as Kelly’s
Pond. Mr. Vaillancourt seconded. Motion approved 5-0.
Application of Monica Manning of Kind Senior Care to use the Town Common on June 17, 2022 from 2:00-5:00PM
for an employee gathering
MOTION: Mr. Vaillancourt motioned to approve the request Monica Manning of Kind Senior Care to use the Town
Common on June 17, 2022 from 2:00-5:00PM for an employee gathering. Mr. Nobile seconded. Motion approved 5-0.
CONSENT ITEMS
A. Accept donation for 20 physicals (value of $1,000) to the Youth Center from ConvenientMD
Urgent Care
B. Accept donation from Lowell Five in the amount of $2,500 for fireworks
MOTION: Ms. Phillips motioned to accept consent item. Mr. Nobile seconded. Motion approved 5-0.
APPROVAL OF OPEN SESSION MINUTES OF MAY 23, 2022
MOTION: Mr. Vaillancourt motioned to approve the Open Session minutes of May 23, 2022. Mr. Nobile seconded. Motion
approved 5-0.
Town Manager’s Report
- Received Community Compact Municipal Fiber Grant which will be used for the Senior Center project

- Mr. Vaillancourt congratulated the graduating Senior class
- Ms. Phillips mentioned the recent Poetry Celebration
- Ms. Phillips thanked all the members of the SOS overnight party for a great job
- Ms. Phillips mentioned the need for volunteers for the upcoming Farmers’ Market
- Ms. Smedile mentioned the banners are currently being returned to the families
- Ms. Bates thanked the Patriotic Observance Committee for the Memorial Day services
ADJOURNMENT
MOTION: Ms. Smedile made a MOTION, seconded by Mr. Nobile to adjourn the Select Board meeting at 8:41PM. Motion
approved 5-0.
