Long : The North Andover Planning Board held a Public Hearing ors Monday evening , July 29, 19B5 at 8:00 P.M. in the Town Office Meting Room t)pon the application of O rod Mill Assooiate(Benjamin 0. 0sgood/C . Bradley Richardsof North Andover , MA . The hearing was duly advertised in the North Andover Citizen on July 11 and 18, 1985. The following members were present at the July 29, 1985 meeting: Michael P. ' Roberts , 0hairman ; Paul A . Hedstrom, Vice-OhairMan ; John A. James, Jr . , Cleric ; and John J. Burke. Member Erich W. Nitzsche was present at all preliminary plan discussions as they relate to Osgood Mill and will listen to the tape of the Public Gearing and be supplied with all sub- mitted material . - The petitioner seeks a Special Permit under Section 11 - Plannied Development € strict of the North Andover Zoning Bylaw, governed by Section 10.31 0onditions for a royal of ecia-1 Permit . This section of tEe Zoning Bylaw permits a mixed use in an Industrial-S District by Special Permit. The purpose of this Special Peftit is to allow the conversion of existing building and construction of a new four-story build- ing into 188 residential housing units and an office/restaurant facility. The premises is located on the Westaide Of Elm Street and known, as the Osgood Mill Complex. Said lot is situated in are Industrial-S Zoning District possessing 13. 2 acres of land area. Ins additions the premises is located in the Town' s designated Commercial Area Revitalization District BOARD) and Historic District. At the hearing, Dick Osottschneider, the applicant ' s representative presented the following information concerning the project : - - - Brief overview of the plan and landscaping. - An adult comm joity . - 109 single bl cdroGm units out of a possible 188 units ; all others are -bedroom m8ximuffl. - Price range - $110,000 to 120,000. Meets all building codes . Will preserve the historical status of the area . Developer plans to preserve and restore all buildings on the property. T The units will vary from 515 to 1700+ square feet;. - The proposal utilizes all three natural resources of the land ; all it8 waterways , all, its pond: , and all its streams. Thy applicant is currently in negotiations with the owners of the D & F property to assist their in any way to help in the -process to construct a new road to Sutton Street . The following members were present and voting at the September 3 , ,1 85 meeting when the board rendered their decision : Michael J. Roberts , Chairman ; Paul A. Hedstram, Vice- Chairman; John A . James, Jr. , Clerk * John J . Burke. Upon a motion made by Mr. James and seconded by Mr . Burke, the Board voted unanimously to grant the petition and plan for a Planned Development District (PRD) by Special Permit for the Osgood Mill Complex subject to the following: 1 . The applicant shall file for a Notice of Intent with the local Conservation Commission in accordance with M.0.1, Chapter 141 , and loom. Conservation Commission. . In accordance with the Board of Health' s recommendations: a. All underground storage tanks that are not used waist be approved by the North Andover Fire Dept. ; b. prior to sandblasting, the contractor and applicant must submit a plan detailing methods to be implemented to }prohibit dust from affecting the surrounding neighborhoods; c . Prior to asbestos removal , a permit shall be obtained from the Board of Health and gone in accordance with state regulations ; d . All residential units located in the old mill buildings must be certafi4cd lead free prior to occupancy; e . The project shall be connecters to the municipal sewer as proposed. . The Main Street access road will be limited to one-way travel into the sita. Said roadway and bridge shall be f .tl ly upgraded to permit safe travel . . In accordance with the r`ire Department ' s recommendations a . The access road from Main street and the two existing bridges bL, grade suitable for Fire Departmc?nt access; b . The new water main shall be metalled per Board of Public Works specifications. c. Fire hydrants shall be added off of the municipal mains to provide water for fire protection on all sides of the existing and proposed buildings ; d . All buildings and units should be fully sprinkled; e . The existing dry hydrant to Osgood Pond shall remain ; f. A fire protection connLctor for providing water to support the sprinkler systems should be installed . The Fire Department connection should be at a cerytrai location to reed all buildings and be next to fire hydrant on a city watermain g . Fire protection and supervision shoOld be planned-:for -`.' the occupancy of the two stone building,5 . The use has not been specifx�2d and should be defined in the defini- tive stage; h. The present master fire alarm box will be taken off line from the internal systems and a new strict pedes- tal box shall be installed in the courtyard between the existing and new buildings. . A fire alarm system must be installed with the following equipment; a . Turd-wired smoke detectors in common areas and hallways tied to the fire alarin central panel and zone indicator; b. Each unit will have smoke detectors as required but will be only for that unlit and not connected to the central panel ; c . A double action pull station shall be installed- within .feet from an exterior door from a common aria ; d. An exterior indic-ator light shall be placed on the corner of each section of the bui ldingo ( 4 in wtotal ) , visible from the courtyard to give fire apparatus the location of the problem. 7. The fire alarm control panel and zone indicator panel and Zone indicator panel should be installed in an accessible central location , preferably the community building, 8 . A flow switch should be connected to the sprinkler system and the fire alarm control panel to give an alarm if there is a flow of water. -4- . The Forth Andover Housing Authority will be allowed to construct a maximttm of thirteen elderly housing units on the land provided f*r that purpose . 10. All relative material concerning the historic preservation of buildings dvring the remodeling- process shall be sup- plied to the local and State Historic. Commissions for compliance. 11 . The designated open space required under the PDD which comprises at least O of the land Shall be protected by a conservation restriction under G. L. Chapter 40-A , Section 9 for common open .apace in cluster developments . 12 . A covenant shall be placed on the land such that no part of the PDD ran be built , sold or occupied until such time as a satisfactory written .agreement has been executed for protection of open space. 13. The proposed plans for building #11 - Stone Building and Building #16 snail be subniittted to the Planning Board in accordzmoe with the requirements of Section 8. 3 F3ite Plan lbeview. 14. The Site Flan of Osgood Mill dated September 20, 1984 and April 1985 shall' be endorsed by the Planning Board and recorded at the Registry of Deeds . 15 . The dec is ion will be recorded at the Registry of Deeds prior to the issuance of a building perwit . Copy to be forwarded to the Planning Board . In granting this Special Permit , the Planning board finds, pursuant to Section 10.31 - Conditions for Approval of Special Pet` lts of the Zoning Bylaw, that the Following conditions are met: _ a . The Osgood Mill site is an appropriate location for--a PDD use- due to its proximity to the downtown and more densely populated areas of North Andover ; b . The use as developed will not adversely affect the neighborhood due to the proposed mixture of uses ( i .e. , residential and commercial vs. industrial ) ; G . There will be no nuiisance or serious hazard ,to vehicles as a result of the existing and proposed access improve- ments , or to pedestrians due to the proposed walkway improvements ; d , Adequate and appropriate facilities (water and newer ) will be provided of the Site to oervlce the proper and efficient operation of the proposed uses . Based on site Visits , the hearing process, and review and Input by town boards and departments the allowed uses permitted ender Section 11 is considered to be in harmony with the ganeral purpose and intent of the Zoning Bylaw.
