After thorough Wvuo8iont Mr. Drummoad made a motion to GRAN' the special.

area of the plot involved-
e. No structure will be built within 30 .feet of a si.delinn of any public x

7. There in an excess of the one pawed off-street parking space required per
unit and they are Located in accordance with the By-Law.
g. There is adequate provision for emergeney vehicles.
A. A letter has been reeaived from the Planning Board indicating conformance
with the req Irements of the appropriate Subdivision Control Regulations+ 1
pertaining to minor residaNi.al streets.
. from evidence presented at the hearing we find as a fact that the proposed
development will be beneficial to the neighborhood and that the Town can reasonab
provide the proposed development with all the necessary utilities and facilities f4
the following reasons:
The proposed develoynent consists of 75 acres of land on a numbered State €iig
way,' Route 114 directly acx•oss the street from Merrimack College. immediately to
the south of the proposed development in a substantial portion of land zoned far
gentral business. The nearest residences to the proposed development are located'
to the northwest and consist of foux• or five homes. Other residonces in the area
are 'located anywhere from FLOG to IF000 feet from the proposed development. Allot
the traffic entering iato and leaving from the proposed development will be serviv
by a Massachusetts State Highway whi oh has adequate: capability of handling the i0s;
creased traffic with no seriour, Ajipai.rnient of any of the safety factors reggi.red.
The parcel of land involved has available to it all aloe i.ts frontage o-t Foote 1-s
a l inch water main with tax adequate supply of water. Sanitary ,ewer•age farci.liti.e
are located on Route 114 at the northerly boundaiT of the; proposed development an
can bo extended to service the development planned. ` his is to be done at the
exponaea of the developer. We find from the evidence presented to us that the
develop pent will not cause any serious effect on the school population. We dete '
from the facts that the area involved is suitable for large developments and UK
apartment complex as presented would serve as a desirable transition bet5,woen the `
genp ral business sane to the south and the residential area to the north and east.:
Ue Arther find that Route 114 to the north commencing at the North Andover - La ,
Lind has over the past few years developed along the location of Route 114 into s
thing other than residential in character arrrd has became more or lass irx the natur
of commercial and institutional and it is our opinion that such developraelt will A
continue. We further find that the development as proposed represents the hijes.
I
and ,best use for the land involved, that the area and the Tovm would be henefitaw
