'3 1s . 62H), and Section 10.04(19), of the regulations, ations, Implementing E (3101 CMR 10.00) , I hereby determine that the above project doss not require the preparation of an Environmental Impact Report . Three outstanding, issues requiring further remedial, action, subsequent to the Environmental Notification Form review are; sewage treatment, ambient 'kiss, and driveway' alignment . Sews ae Treatment The sewage flora from this nursing and retirement facility necessitate the installatiOn of an awn-si,te wastewater treatment system. Since true consultation meting, an -ad itional parcel of land has been acquired to provide sufficient area for the leaching beds. This preliminary information suggests that Title requirements May now be, et . TherHefors , no further MEPA review of -this issue is necessary. However , in, the event the proponent opts for alternative sewage treatment, a,. . septic systems or a municipal sewer line hook up„ Ethan this office should be notified o a 'Project Change, pursuant to, i ►. Y, . i BOEA #6101 BNF Certificate September 24 , 1986 It is recommended that a dry sewer line be installed during construction in anticipation of a► sewer hook up at a future date. Ambient Noise This facility - is a no#se sensitive receptor with proposed siting in close prox1mity to a noise generator - Route 214 . The Massachusetts Department of Public Works (MDPW) has been asking that residential developments abutting state highways take measures to reduce nolse imparts (see attached MDPW letter dated June 4, 1986) . Even though the BBN Laboratories Inc. Environmental Noise St rvey, August 18 , 1986 doesn' t show exceedances of the Housing and Urban Development (HUD) noise standards , it is expected that the developer will review a noise attenuation plan, including building alting, climate control system/acoustical treatment of the building and noise barriers with the MDPW prior to is,Nuance of the state curb cut permit. It should be demonstrated that the proposed noise mitigation will minimize the noise impacts generated by expected traffic increases and future highway widenings . Driveway Alignment The driveway location along the frontage of the parcel should remain indeterminate until such a time as the Town of North Andover anid MDPW establish the future location of berry Street an the northbound side of Route 114 , opposite the nursing dome site . The consultant for the proponent has agreed to being flexible with, respect to the driveway in order to consider the advantages of an alignment opposite berry Street , when it is realigned. Miscellaneous The North Andover Conservation Commirslon has alerted this office that a Determination of Applicability as per c. 19-1 ,9. 40 is required for the proposed development . They should be consulted for further details , _ September 24 , 1986 DATE JAM S. ROYTE, SECRETARY JSHfNBfbk DWTRICT *5 QFFMIE r %4APL9 srarEr, awr,r 01937 # vax Run Condos, Danvers I t VED AL.K.A. Nancy Baker Executive Office of ErLvironmeutal Affairs 100 Cambridge Street Bostont mass. 02202 Dear Ms. Baker: Regarding residential development adjacent to State Highwaps, this office is concerned about existing and potential highway wise itlkpacts On the proposed projects. We would like to use the MEpA process to make, the developers aware that the problem exists, and that it is iacumbert upoa 'th m to take measures to mitigate the existing noiag as well as any potential increase caused by increasing traffic or future highway Inprovemeuts or midenings. This r-oul.d be accomplished by allowing a vider buffer sane between the high- vay and the development, by the use of properly designed noise barriers, and by construction of solid walls of sufficient mass Ito windows) faei.ng the highway. HOWE SlEaREFARY CERTIFICATE OF THE SECRETARY OF ENVIRONMENTAL AFFAIRS ON THE ENVIRONMENTAL NOTUICATION FORM ' PROJECT DAME Nuraing and Retirement Canter PROJECT LtOCATICN = Forth Andover EOEA NUMBER 5101 PROJECT PROPONENT : Alan SolomOnt DATE NOTICED IN MONITOR : June 24 , 1986 Pursuant to the Massachusetts Environmental Policy Act (G .L. ,cm30 ,s . 62-62H) and Section 10. 04 (9) of tregulations implementing MEPA ( D1 OMR 10. 00) , 1 hereby determine that the above project does not require the preparation of an Environmental Impact Report . Three outstanding issues requiring further remedial action, subsequent to the EnviroMental Notification Forty review are: sewage treatment , ambient noire, and driveway alignment . Sewage Tjeatment ' the sewage flows from this nursing and retirement facility - necessitate the installation of an on-oitwastewater add#tionaltparcelnof ,t system. since the consultation meeting , an land has been acquired to provide sufficient area for the 4 leaching beds. This prellminnrY information suggests that 'title 5 requirements may now be met , Therefore , no further META review of this issue is necessary. However, in the event the proponent opts for alternative sewage treatment , e .g. septic systems or a municipal surer line hook UP; then this office should be notified of a project Change, pursuant to 30l CMF 1 . 1fi. 1 { EOEA # 6101 F.NF Certificate September 24 . 1956 It is recommended that a dry sewer line be installed during construction ,in anticipation of a sewer hook up at a future date. Ambient Noise This facility - is a Noise sensitive receptor with proposed siting in close proximity to a noise generator - Route 114 . The Massachusetts Department of Public Works (MDPW) has been asking that residential developments abutting state highways take measures to reduce noise impacts (see attached MDPW letter dated June 4 . 1986) . Even though the BBN Laboratories Inc. Environmental Noise urve , August 13, 1986 doesn' t show exceedancee of the Housing and Urban Development (HUD) noise standards , it is expected that the developer will review aG noise attenuation plan, including building siting , climate control system/acoustical treatment of the building and noise barriers with the MDPW pr'lor to issuance of the state curb cut permit . It should be demonstrated that the proposed noise mitigation will minimize the noise impacts generated by expected traffic increases and future highway widenings. Driveway Alignment The driveway location along the frontage of the parcel should remain indeterminate until such a time as the Town of North -Andover and MDPW establish the future location of Berry Street on the northbound side of Route 214 , opposite the nursing home site. The consultant for the proponent has agreed to being flexible with respect to the driveway in order to consider the advantages of an alignment opposite Berry Street, when it is realigned . Miscellaneous The North Andaver Conservation Commission has alerted -this office that a Determination of Applicability as per c . lal ,s. 40 is required for the proposed development . They should be consulted for further details . September 24 , 1985 DATE JAM S . 40YTE, SECRETARY .ASH/NB/hk Di kFIIC AYOFFICEri a*e MA►49 *YR<sY. DANVERS 01737 River Run condos, Danvers IVED A.K.A.
