In our on site discussion bath the towvj and Genesis expressed all intel'cst in resolving this problem and that th
town would got back to yot� wills a proposed resolution. To that end, subject to approvals from various state
agencies, town boards and North Apidover Town Mecting, our proposal is that Genmis will frilly restore the
FarnLim hoT,sc and then deed it over to t13e Town of North Andover•. We wiII then take over responsibility for
its maintenance and upkeep, By agreeing to thi's proposal, subject again to all necessary regulatory approvals,
Genesis-%viII pure its non-compliance with the site plan approvaI and be relieve# of responsibility for a
structure it clearly has no interest in keeping-

Dear Mr . Long
The North Andover Planning Board held a public hearing on
June 16 , 1 B8 in the Town Hall , Selectmen* s Meeting Room upon
the application of Alan D. Solomant, Partner, N .A. Associates ,
r, o ADS Management, Inc . , 360 Merrimack Street, Lawrence, MA.
The hearing was duly advertised in the Lawrence Eagle Tribune
on May 31 and Jute 7 , 1988 . The following members were preeerkt
Paul A. lledstrom, Chairman ; John L. Simons , Clerk and Erich
Nitzsch . Absent were George Perna and Michael Leary.
John Simons read the legal notice to open the public
hearing . Due to the fact that the Hoard lacked a quorum,
John Simons made a motion to c ontiriue the public hearing
until. June 30 , 1988 . The motion was seconded by Erich Nitzsche
and voted unanimously by- those present.
On ,Tune 30 , 1988 , the Planning Hoard continued the public
hearing on ADS Management . The following monibers were pre,enL
and voting: Paul A. Ftedstrom, Chairman; George Perna, Vice-
Chairman; John Simons , Clerk ; Erich Hitzsche and Michael Leary.
Jahn Simons read letters €rorn Mass . D. P .W. , Berard of health,
the Fire DepajetMent and the Building ln5pector ..
John A. James , attorney for the applicant spoke to the
Board and introduced Mr . Jeff Lewis and Mr . David Dunlop.
,Toe Borgesi also spoke to the Board giving them background
on the project and citing that State and local Boards have
reviewed the project. Fir . Dunlop passed out packets to the
Board members on the site plan . The purpose of the Site Plan
is to review the proposal to 4:.-en5truct a 142 bed, 85, 200 sq. ft . ,
4 story nursing arid retirement center on 4 . 2 acres ors the West
side of Route 114 near Berry Staeeet in a Village Residential (SIR )
Zoning District . Accessed from Routo 114 , the project would have
on-site septic system and a dry sewer . The applicant has net:
with the Technical Review Committee .

Shoe box type lighting will be used. Questions were raised
about the height of the building - 4 stcaries vs 35 tcnet. `,E'he mean
average height of the building is 161 . 34 . Erich Nitzsche asked
Scott Stocking, Town Planner , what the bylaw stated. Scott said
the the bylaw stated mean .
State D.P.W. said an acceleration lane was needed.
Questions were also raised on the septic system not complying
with Title V and also the drainage calculations . The sepLic system
will be reviewed by the Board of Health . Bill Hrouricak, D.P .W. ,
will go over the drainage calculations with Joe Boxgesi .
A motion was made by ,John Simons to close the public hearing
and take the matter under advisement , seconded by Michael Leary
and voted unanimoi3s by the, Board .
an July 21 , 19BO , the Planning Board held a regular meeting.
The following members were present and voting; Paul A. iledstrorn,
Chairman; John Simons , C14�rk; Erich Nitzsche and Michael Leary.
George Perna was absent . A draft decision was presented to the
Board by the Town Planner , Scott Stocking . Alter a. brief, discussion,
amendments were made to Conditions 42 . 3, #7 and #8 .
A letter was received and read from the D. P.W. aad their conce ns
will be incorporated into the decision. Also added was a condition
that states that "lea Certificate of Occupancy before the Plarxning
Board receives the As-Built Plans .
A motion was made by John Simons to approve the decision as
wrcitten and ajn4�nded, seconded by Michael Leary and voted unanimously.

The Planning Board makes the following findings regardin th
application foar a Special Permit as required under Se[�� � l
of the Zoning Bylaw .
A. The specific site is an appropriate location for such a use,
structure, or conditiun;
B . The use as developed and conditioned in this decision will
not adversely affect the sur.roundinq rxeighborhood ;
C. There will be no nuisance or seicious hazard to vehicles or
pedestrains F
D . Adequate and appropriate facilities will be provided for tie
proper operation of the proposed use,
E . The Special Permit application before us is in harmony with
the general purpose and intent of this Bylaw .
The Planning Board makes the findings as required under Section 8 . 35
that the site plan generally complies with Town Bylaw requirements
and still requires additional approvals from State agencies . 'Wherefore,
in order to fully comply with the approvals noi--essary to construct the
facility as specified in this special permit before us the Planning
Board hereby grants a special pexuait to the applicant provided the-
following conditions ate met :
I . Conditions to be inet prior to the plans being endorsed by the
Board and recorded with the Registry of Deeds Office:
1 . The proposed access design for this site from Route 11_4
shall be approve[ by the State DPW.
2 . The proposed radius for the acceleratio:a .lane shall be
revised to allow vehicles to tarn into the lane without
entering the traffic lane of Route 11-4 .
3 . Ce-ctificate from the Board of Health that the septic
syst( rn design meets Title V requirements _
4 . Revised set of drainage calculations be supplied and
approved by DPW.
5 . The site plan shall be revised to show the following
conditions received from DPW:
a . The proposed cry sewer should be exteztded to the edge
of the State Highway layout and a manhole Should be
installed at that location. The invert of the sewer
iri the manhole should be the highest elevation
possible without conflicting with other ors-site
utilities .
b. A separation of 10 feet shall be maintained between
the water and sewer pipes .
C. The proposed hydrant near the entrance to the property
should be installed on the east side of the water main.
d . At the rear of the building, the proposed water main
should take a more direct route toward its terminus
in order to eliminate unnecessary bend. The proposed
hydrant at the rear of the building should not be
installed adjacent to the dump ter .
e. The proposed 7 foot radius at an intersection angle
of 300 will rake it diffiQulf for traffic to exit
easterly onto Route 114 . The final radius desigTi
for the driveway shall be approved by the Board.
f . Suitable erosion control measures should be provided
on-site to mitigate the potential for damage to the
area at the outfall of the existing state drainage.
g . A complete set of approved plans with up-to-date
revisions mast be on file at the Department of PubliQ
works prior to issuance of any permits for this site.
6 . Revised landscaping plan to be submitted and approved by the
Beard which shows additional plantiTigs lncludipg , without
limitations, the following:
a. JunigeTs shall be placed along all parking areas iTi
order to screen the areas from Route 11.4 and adjacent
properties . The vegetation shall screen the parking
areas with four season screening .
b. Four ( 4 ) additional shade master locus trees stall be
platted along the six ( 6 ) space parking area adjacent
to the main entrance .
C. Additional trees and shrubs shall be planted in the picnic
area adjacent to the building .
d. Thy area adorn the north westerly bolondary Co remain
undisturbed to the extent possible. The area disturbed
to construct the fire access in the area shall be reforest
with pine trees upon the completion of the structure in
a manner acceptable to the Board .
e. The retaining galls which are visable on. the outside
of the structures ir� front of the building shall be
treated with wood, stone or other material and shall
not be expesed concrete. The retaining areas and
berms shall be landscaped with low lying slt �-ubs .
7 . Extend the- sidewalk in the front of the building to the
existi-ng house and adjacent to thie ambulance space .
S . Certificate needed , received from the Department of Public
Health for the Nursing Center .

II . The following conditions shall be filed with the Registry of
Deeds Office and adhered to by the Special PerMit before us :
a . Building shall meet all NA,FD requirements related to fire
safety.
b. An erosion control plan to be utilized during construction
shall be submitted to the Planning Board prior to construction
C. All permits from the State DPW for work within Route 114 shall
be obtained prier to any construction activitywithin UiL,
right-of-way .
d. All conditions placed on this dcnvelopment by the Baaird
of Appeals decision issued October 27 , 1987 shall be met
by this development .
a. The existing house will be utilized as administrative
offices for the facility as indicated on the site plaxri

f . No Certificate of Occupancy shall be .issued prior to a
certified As-Built Plart is presented and accepter) by the Board
which verifies that the project was constructed as shown in
the plan cited and contained in this decision.
