During our niecting last wcek,, we discusseA the renovations to the above-referenced,
property owned by Ansel hie ully'Trust an A&C Realty Trust.(hereinafter referred to as the
"Ownens"). Under Section 2.301.1 orme Zoning Bylaw for the Town. of N011h. Andover, the
Plarming Board is, identified as the speoial perniit-granting authority fiorshal-edr driveways. The
above-referenced driveway, which currently services the husiziesses,of the Owners, is,
approximately twelve and one half(12 V2) fi�et wide, The Owners arc proposi ng to, widen the
driveway to twienty(20) felt in order to its the traffic flow entoing and exiting their
properties.
The shared driveway predates applicable zoning requ I irenaents; thcretb,re:, It is as legally
existing nonconforming stracture entitled to protection undicrSutiou: 9, of the Bylaw and under

also, reqmr�(l to, issue a special permit relative to the widening of the existing driveway. I

Thank you for meeting with me last week to review the requirements lb r thte
reconfiguration of the parking lot and driveway located at the above-referenced propeity owned
by Ansel Rcalty Trust and A&C Realty Trull(hereinafter referred to as the"Owners"}, As we,
discussed, tmdei`S edl on 83,2(a)(ii) of the Zoninp,B yl aw for the Town of m-th. Andover, site-
plan review may be required when a project involves a new commt�rcial building; the addition of
more than two thousand squ arc feet to an existing 5*-=ture,; or otherwise results in the need to
create five (5) or more parking spaces, meter Section 8.3.2(c), an applicant may seek a waiver
rrom the P1 anning Board of this requirement to the extant c i raim tatw-e,, (to-not require a public
hearing. Given the circumstances described be]ow, T respectfully rcq utst that the Planning
Board waive the rNu i rem ent o Fsi le-1)]aTi-r,-,vi ew for below-described Project,
Thte PrqJ ect involves the addition o f two hundred sev en ly-fivc (2 7 5) square feet of office
space within the footprint of the.existing baildings rind closing in of an existing covered porch,
which measures one hu ndred i i v e (105) sq tare feet; the wid cning of the driveway Front
approximately twelve and one b a If(12 Y2) fi-,N to twenty(20) fed; and the rec orp fi gmation of the
parking area and creation of six (6) parking spaces on the property of each Owner hereitnaftcr
referred to as the "Project"). Bee-ause the existing structures, parking area, and driveway were

Project t-eq U]nd the issuance of a special pcmiit by the Board of Appeals ('T OA") wider Section
9 of the B y1aw. On August 12, 2003, a fter a series of public hearings, the BOA voted to approve
the issuance o f th c Special Permits. Diirhig these hearings the BOA, public, and the abu(fing
I aiid-ownei-s had the opportunity to evaluate and make kiiown any concerns and
recommendations relative to the Project in au open public forum.
