The Plaintiff owns a parcel of land located at 1077 Osgood Street, at the intersection} of {great Pored Road in North � Andover, Massachusetts , containing approximately 9 . 2 acres . R The premises affected by this appeal are in zoning districts General Busine$s (G-B) and Business-2 (B-2 ) and comprise an area of approximately 5 . 3 acre: . The balance of Plaintiff ' s land is zoned residence- ( R- ) and is not part of the site for which site plan approval .is sought . a 7 . On January 15 , 1988 the Plaintiff filed an application .for a � Special Permit with ' the 'down clerk and the Planning Board seeking site plan approval under ectio�i 8 . 3 of the zoning by-law. A copy of the Application is attached hereto and ; marked "A" . Sections 10 . 3 and 10 . 31 of the by-law set forth the pertinu[, lt provisions for Special Permits and establish the Planning Board as the Special Permit Granting Authority . No distinctiorn is made between a Site Plate Review special permit and other special. permits . The Planning Beard never adopted rules relative to the .issuance of such permits, and never filed a copy of such rules in the office of the Towrk Clerk . The Plaintiff ' s application included plans for the construction of a 320 foot by 128 foot two story retail- office building on the 5 . 3 acres of business-zoned land. The Planning Board gave notice to all interested parties ( by publication, and certified mail } that a public hearing would be }geld on Thursday, February 4 , 1988 at 8 : 30 p .m. in the 'town Offioe, Selectman' s Meeting Root. On the evening of February 4 , 1988 , the hearing was postponed by the Planning Board for lack of a quorum and re-scheduled by posting to February B , 1988 at 7 : 30 p.m. 8 . At the February 8 , 1988 meeting , the Planning Board opened the Flaintiffks public hearing and received information from the Plaintiff and from certain interested parties . After extensive discussion, the public hearing was continued by the Board to March 2 , 1988 . on march 2 , 1988 the Planning Board resutned the public hearing. The Defendants, Hedstrom, Nitzche, Simons alld Perna were present and participated in the meeting, receiving additional information from the plaintiff and from -certain interested parts s . Member Burke was ah!�ent. After extensive discussion, the Board voted to Qonduct a site visit before the next meeting and to continue the public hearing to April 14 , 1988 . g , on Saturday, March 19 , 1988 , Defendants Nitzche aid Simons met representatives of the Plaintiff at the site and oonductec a site visit . The Board tten +otedo close the public hearing and to take the matter under advisement . on April 28 , 1988 at a public meeting, the Board voted to dewy the plaintiff ' s application for a Special Permit. Defendants HedstrOm, Nitzche and Simons voted to deny the application. The Defendant , Leary, who had not been a Board member a1 the time of the two earlier public hearing sessions, abstained. C . 40A , section 17 , b the decision of the Planning Board to deny its application fox a Special Permit. 14 . The Planning Board members present on April 28 , 1988 aQt-ed without a quorum present and lacked jurisdiction to decide tht Plaintiff ' s application at that meeting . 15 . The plar "09 50ard failed to take final action upon the Plaintiff ' s application fox a special permit within 90 days f011owing the date of public hearing . J-6 . The decision of the Planning Board to deny the Plaintiff ' s application for a Special, Permit exceeded the authority of the Planning Board. 17 . The Planning ]hoard ' s decision is based on legally untenable grounds and is unreasonably, whimsical, capricious or arbitrary. 18 . WHEREFORE, the plaintiff respectfully prays that the Court : A . Hear all pertinent evidence and determine the facts . B . Determine and adjudge that the Planing Board' sc vision to deny the Plaintiff ' s application for a Special Permit was in error as a matter of law and fact and that the Planning Board exceeded its authority- C:_ Annul the May 4 , 19 8 , decision of the Planning Board . On or about May 21 , 1985 , the Plaixltiff filed an application with the North Andover' laming Board of Appeals requesting a 9 ccial Permit under Section 4 , paragraph 4 . 133 ( d) of the Zoning Fay-law, so as to permit construction of a retail - office building within 2501 of Lake Caohichewick . The Board of Appeals gave notice by publication and mailing and set the matter down for a public hearing ork .pine 10 , 1985 at 7 ; 3O o ' clock p.m, at the Town Building. On June 10 , 1985 the Zoning Board of Appeals at a public hearing received information from the Plaintiff and from various Town Agencies and officials and from certain interested parties . Tn particular, the Planning Board , by written memorandum, rccornmended to the Zoning Board that the portion of tho proposed building Within 250 " of the Lake be removed and the building enlarged elsewhere. The Zorni.ng Board voted to continue the pudic hearing to August 12 , 1985 . 28 . Oil August 12 , 19B5 the Zoning Board re=aumed thc: public hearing and received further information from tj�a plaintiff, various Town officials and agenc,ie8, and certain intcrested Parties. At the conclusion of tjoe3 public hearing the Board voted to grant the Special Permit and to authorize the Building Irispcctor to issue a permit to the Plaintiff for construction of the work sought ,used upon certain specific conditions . 29 . On September 24 , 1985 the Zoning Board Filed its decision With the `Powrn Clerk. A certified Dopy of said decision if�L attached hereto aild marked " W' . 30 . Oil October 21 , 1985 a certified copy of the Zoning Board decision was duly recorded at the North Essex Registry of Deeds at Book 2064 , Page 155 . 31 . Condition 8 in the Zoning Boacd' s decision of septe}mber 24 , 1985 provided. "8 - that the planq be revised and submitted to and approved by the Board px-i.or to any constxcuction on the site" . 32 . On February 10 , 1987 the Plaintiff at a public meeting of the Zoning Board of Appeals sx�bmltted to the "Zoning Board its revised plans for construotiOn at the zite . The: Zoning Board voted to approve the revised plans and to sign the revised site plan, 33 . Can January 19 , 1988 at a public heai'inr ,, the Zoning Board of Appeals voted to extend to September 24 , 1988 the plaintiff ' s Special Permit dated September 24 , 1985 , a copy of said vote is attached hereto and r.iarked "E" . 35 . The Defendants , Paul A . Hedstrom, ,loh;n L. Simons , Erich W. Nitzsche and Michael Leary, in their cijpacjty as members of the north Andover Planning Board, denied the Plaintiff ' s application for a Site Plan Special Permit on May 4 , 1988 { see copy of decision attached hereto and masked "B" ) . 36 . One of the reasons gi'vell by the Planning Board for denying the plaintiff ' s application four a Site Plan Special Permit was the following "There is no evidence in the file, nor has the applicant presented evidence at the public hearings that there exists a special perDlit for construction activity within the watershed district as contemplated by the applicant in the application ). -fore us . The Pla.�rnx)jg Board has no authority to approve a site plan under a special permit application which on its face does not comply with the present regulations contained in the Zoning By-law. " 37 . The Planning Board has erroneously determiried that the Spccz.al Permit granted by the zoning Board of Appeals ( No. 39-95 ) oa September 24 , 1985 , does not authorize the construction activity withii-� the watershed district as shown on the plan submitted by the Plaintiff with its application for a Site Plan Special Permit. 38 . The Planning Board has also erroneously determined that the site plan submitted by the Plaintiff with its application for a Site Plan Special. Permit on its face does not comply with the applicable regulations contained in the 'LOn jlg By law. 39 . The Plaintiff says that the site plan submitted with its application for a Site Plan Special Permit complies in all respects with the applicable Zoning By--laws and the construction activity shown on said plan is authorized by the Special Permit granted to the Plaintiff on September 24 , 1985 by the Zoning Board of }appeals ( see 11D11 ) . 40 . An actual and serious controversy has arisen between the plaintiff and the Defendants t Paul A. Hedstram, John L. j. ens , Erich W. The Planning Board gave notice to all intcrest.ed parties ( by publication , and certified mail ) that a public hearing would be field on Thursday, February 4 , 1988 at 8 ; 30 p.m. in the Town office, Sclect_man ` s Meeting Room. On the evening of February 4 , 1988 , the h ari-ng was postponed by the Planning Board for lack of a quorum and re-schadulad by pasting to Pebruary S , 1988 at 7 : 30 p.m. 8 . The Board of Appeals gave notice by publication and ,nailing and set the matter down for a puhltc hearing on June 10 , 1985 at 7 : :30 o ' clock p.m . at the Town Building. On Junc 10 , 1985 t-he 'Zoning Board of Appeals at a public hearing received information from the Plaintiff and from various Town Agencies and officials and from certain interested parties . In particular , the Planning Board , by written memorandum, recoirmendcd to the 'Zoning Board that the portion of the proposed building within 250 ' of k_he Lake be removed and the building enlarged c1newh€ire . The Zoning Board vote d to continue the public: hearing to August 1.2 , 1985 . 28 . Uri august 12 , 1985 the Zoning Board resamed the public hearing and received further information from the Plaintiff , various Town officials and agana i_es , and certain interc:stad parties . At the conclusion of the public hearing the Board vok_ed to grant the Speoi.al. Permit and to authorize the Building Inspector to issue a permit to the Plaintiff for const-r.uc Lion of the work sought_ based upon certain specific conditions . 9 . on September 24 , 1985 the toning Board filed its decision with the Town Clerk .
