NAPB-Correspondence 1990-1998 January 8, 1998 Mr_ Tort Yanicen Butcher Boy Market & Mall 1 077 Osgood Street North Andover, MA 0 184 5 Dear Mr_ Yameen From a on site investigation conducted by staff'from the North Andover WaterlSewcr Dept, and Greater Lawrcnce Sanitary District on November 12 11`, 1997 we have found strong evidence that substantial and damaging amounts of the grease generated from your inaH complex, concentrates itself at the To n owned Bincher Boy Sewer Pump Station (SPS) located on lit_ 133. Evidence being, large amounts of grease buildup within the collection system and rnan�iole chambers prior to the SPS_ Further invest€gaticil slowed [it tle grease corning in from Joe Fish and the Lo[l Restam-ants_ Orr November Ie' €997 dye tests were conducted at Butcher Boy Market as we]l as tenant restaurants within the mall complex to see if sewerage-effluents are connected to thee large hi ground grease trap ow side, prior flowing to the Butcher Boy SPS) on Rt_ 133. The dye tests were performed by Ray Mahoney and Mark Lundy of the Cireater Lawrence Sanitary District (GLSD), Waste Water Treatment Facility. OIliciais present from tine Town of North AMover to witness the tests irk order to evaluate the results were Sandy Starr fFom the Board ofNblic Health, Myself and Jerome Welch from the Water Dept. and P1uMbing hispector Jinn Dio-rzi. /Uso present was Davc Barry, Bu6ncss Manager T-epresenting your mall complex. Two dye tests were made from Drzo's, one f"Fora the sink were a grease trap is located bene-alh and another from a doniestic sanitary sewer sink without grease removal related work. Both dye tests indicated that sewerage fto rn these two points flowed directly to a manhole just prior to entering the Butcher Boy SPS. Another dye test was conducted from the Butcher Boy Market kt#chen sink Dye tests proved wastewater flow from this area did go to the onstside, in ground grease tank bill maintenance (grease removal by septic pump truer by a profession outfit) was at a 6 nimunn_ This meant that in ground collection tank has not been cleaned down often enough to prevent grease escaping to the receiving Butcher Boy SPS. According to Sandy Starr, only domestic. waste Mows are allowed to go direcdy ButcN-j- Boy SPS, not the [low from the sink- with the grease trap built under it. This requirement. will also comply with in house grease traps within Butcher Boy Restaurant kitcfreri and meat preparation areas as well- - Arrange for the professional removal of grease from the large in ground grease containment tank outside_ Also arrange for scheduled removal of grease from the in ground lank by a reputable, professional business frequently enough to prevent a lurel of buildup which could escape the tank. Keep record of all grease removal undertakings or design alterations and make diem easily available to the irespectable Town of North Andover Staff mentioned In thus report. - Arrange for the complete removal and disposal of grease buildup withria the wet well at the Butcher Boy SPS by professional outfit at no cost to the Town of North Andover- The Town of I or#h Andover will provide a official fo allow access to Butcher Boys SP wet well amd witness the operation until satisfied with completion of rernoval. - An-ange with professional contrac:tur to conduct another dye test with all the grease removal systems clean tc> see clearly if sewerage flow from the tenant restaurants is flowing into the in ground grease pit to confirm initial dye test findings, This test will be of importance to yourselves hi order to prevent a costly mistake, such as tearing up your- parking lot . The Town ofNorth Andover Water Department is responsible for the proper operation and maintmnce of the Butcher Boy SPS. We have been experiencing large grease accumulation there for quite some tine now. The trees that were planted offer, ad,solutely no screening since they were planted four(4) feet lower than the finish Mall grade. The headlights from vehicles driving at night to the rear of the lull building from the new Butcher Bola store side shine directly into may house even through drawn shades. Additional screening should be planted in the 81 wide, dirt area above the wall . Kathleen was told by, the developer that the roots of a white pine would affect the wall. integrity, therefore the trees were plarxted at the old finish grade four(4) feet below the tap of the wall, however a Maple tree whose root system is more invasive than that of a White Pine was planted wave the wall in the 8 ' dirt area. This fabricated eXcuse is a direct contradiction of what the developer has done. It is essential that some type of impervious screening hedge be planted at the finish grade at the top of the wall to afford me 84ume privacy because of the finish grade differential . Thy Zoning By Law in 8.4 addresses lighting in Section 5. Planning Board condition # 3 also addresses lighting. It is critical, that all sights in the near of the project and on the southerly side, bath on the building and on the poles, are shielded. So far the developer has not allowed the pale lights on the southwesterly side to be turned on. The reason being that the Mall site will be illuminated lake a football field during a night game. My residence will also be the recipient of this illumination. Zoning By Law 8. 4, Suction 5 is very clear in its definition and enforcement to the adherence must he in its strictest form. Condition ten(10) of the Zoning By Law Special Permit, is yet to be started and the importance of that fulfillment can be appreciated considering the proximity to my residence. I have enclosed the Zoning Board of Appeals decision. Once the Special Permits were granted the critical conditons which have an impact only on me as an immediate abutter have been taken very lightly and without concern to the negative impact to me. When do ray legitimate interests become protected as spelled out in the Towns By Laws' The Null was allowed, by the town and the Mall developer appeared before the Planning Board for the site review process after many attempts of trying to exempt himself from that process- Please don't cave in to Political pressure being applied and allow these conditions not to be fulfilled after they were agreed to as part of the Special Permit granting process and as part of the Zoning By Laws. As the new Buwtthnerboy Mall_ enters into the final phases of building and nears completion, I am requesting the opportunity to address the Planning Board at its October 17thn meeting regarding certain conditions that are part of the Planning Board's approval for this mall. Having attended aa.l,l meetings regarding this Mall before various town boards, i voiced my concerns to no avail. Now that the Mall is hnausioiy complete my tonc.ern8 have become realistic! nightmares. Since I am the only party impacted by Town approval of this Mall I am requesting that a strict adherence to the conditions imposed be carried out. The Towann' s decision to allow this Mill has adversely impacted the value of the property imm whnichn I: reside. After more than six months on the real estate market not xa single offer was made. The majority of the viewers objected to the Mall cowering over the house and being so close to the house. ,assula,t a mn l states that prior a certificate of occupancy being issued for any structures, the site SHALL be reviewed by the Planning Board.. any screening as may be reasonably required by the Planning oa.trd SRALL be added at the owners expense., Q discussing the fulfillment of this condition with Ms. Kathleen Bradley Colwell, her response indicated what the developer has planned to do rather than. what the Town wants done to fulfill this condition.. i don' t believe that asking for proper screeniph; in view of that has been granted by the Town is an unreasonable request. (2) An extension of the stockade fence by about six more sections is also warranted. The tree planting with closer spacing and larger size is addition to the fence extension represents a pittance in the overall cost of the protect. Lost importantly it represents the only solution for groper fulfillment of Condition 16. 1 am also requesting an on-site inspection from the house by the P.1ark-iiitiig Board. This does not cover from Blue Ridge to the existing roadway, Hoax Hill. A motion was made by John Draper to approve the Tri-Party Agreement, subject to receiving a detailed list of items covered under this agreement. Staff Resignatign Christian Huntress told he Board that he has submitted his resignation as Town Planner, beginning in September. Hopefully Chris will be working in the Planning Department for ten hours per week during his time at school.. This will waive his tuition and provide hits with a stipend. The Board expressed their regret. Chris asked the Board for their support to the Town Manager on being able to work for the ten hours per week. A Motion was made by Join Draper to instruct the Chairman to speak to the Town Manager on this matter.
