frame pump house attached to your bar ding, The pump house is rusk secure, €ackcs insulation
and appears to be structurally and environrrterltaLly unsound based on rot, mold and method of
construction. The wet well coutd not be accessed to inspect the interior conditions of the
chamber-or the pumps however openings in the top of the %vet welt.a[(Owed the rrleasur-eMQ.nt
of stariding water anti the tankcs overfali dep(1). I'he top of the wet weLL is expon;ed at grade wv th
two (2) 3" Polyvinyl.ChLoride (PVC Schedule 80) discharge pipes extending v�!rtLcaRy out of the
wet weLL. There is no insulation or other 1)rotection from fFeezLnq condWons. The diwhar-ge
pipes connect at a tee jtinction and then travel undcrground before exiting the pimp house,
The discharge pipe connects to ail older 4" cast 4rork pipe in a nearby c lea nout manhoLe-
Measurerrlcrtts a the manhote indicate there is unly 18" of cover over the buried pot Lion of the
force main between the pump house and the nearby clearrnut manhole. As you reported, the 4"
fame main discharges at a manhole locatcd at the intersection of €'airs Street and 2n,# Street,
According to a Letter prepared by tacks McQui€kern, PE on November 11, 2002, the force main is
approximateLy 665 feet Long with a grade change of approximately 38 feet between the pur-np
and the sewer discharge in Main Street according to a '1909 Work Order"- We have reviewed

The buiIding is part ofarE old ini11 coinplex located between Osgood Pond and Sutton
Ilond, The complcx has beeFC developed as the Sutton Pond Cond omin i ki in. Must cif Elie
coinplox is Iocated on the east hank of the, stream connecting the ponds. lvlr- Smith has a
long-tend lease ofa 3-story buildi119 on a small parceI on the west bank of till', stream.
The lease inc Ides tic building and 2' of(lie land on each side. On one side of[lie parcel
is an earthen dam hoIding back Osgood Pork]. One side of the bLEifding is built into the
darn. The entrance to the buildhin is located in the tcklx story- The da€n slopes down
steeply to a 11aI area surrounded on two sides by wed ands a€3d The third by the stream.

There is an ongoing legal dispute botween Mr- S n)ith and the condo association} regarding
who is rest onsible for Ili pump station that Ied to a state cotirl lawsuit several years ago.
Piecing together inlbrrnation fro Mr. Smith and his attorney, Kovi€r Brander of
lvlassDEP, rind lyric K fbijq, DIrC=L:tor of Nmlh Andover's Division of C:omtr unity and
Econorni€;Development, the €our t ruled that the condo arssuciation had to fix the ptrn-r1)

necessary ivpairs and upgradcs and that M r. Sinith is responsi1)le. Mr, Sillitil bclicves
