and er Section 8.3 Site Plan Review ef~the North Andover Zoning Bylaw. The legal notice
was properly advef.ised in the North Andover Citizen on June f 7& June 24, 1998 and all
parties of interest were duly noti#:ed. The. following members were present, Richard
Ro en, Chahmian, John Simons, Clerk, Joseph V. Mahoney, and Alberto Angles,
Associate Member.
The petitioner was requesting a special permit to obtain approval to construct a 6,900 SF
2 floor wood franie office building-

Ben Osgood Jr. of New England Engineering was present to repm;ent Security fealty
Tnr st located off Rt. 1 5- Mr. Osgood stated that presently there is two office br�ildings
and they are proposlrig a 6,780 SF office building- M. f. Osgood stated that he has located
all existing parking and proposed parking on the plan. The whole site will be on the same
drainage and proposing a new service into in the building. Mr. Osgood stated that
basically they are add Ing a new budding to an existing site. Mr- Osgood stated that the
in rease of volume is about 800 cubic feet, Mr. Osgood stated that MT. Ohessla stated
that the impact was very sinall- -- Osgood stated that D.P-W. wrote a letter stating that
there Ss no problem with the drainage. Mr. Osgood stated that presently there is no
landscape on the property but, they are proposing landscaping around the property, fir.
Osgood stated that there is two proposed lights at the two entry ways- Mr. Osgood stated
that there is an existirkg sign can the property and there might be signs on the doors. Mr.

Osgood went over the design of the building with the Board. Mr. Mahoney asked ,ghat
the r amber of proposed o ffices there would be- Mr. Osgood shied that there will be 4
offices- Mr. Rowen asked if it is tiny going to be office space. Ms. Colwell stated that
the old parking spaces don't meet present. requirements but, the new spaces do m ct the
requirements. r- Simons asked what the Boor ratio is. Mr. Osgood stated that it. is
33%, Mr, Bowen asked what the building height is- Mr. Osgood stated that it is 3 ', Mr-
Rowen asked if there was any new drainage. Ms. Colwell statedt'hat there wasn't. M1%
Angles asked if there were any external HVAC units, Mr- Osgood stated that they will
probably be put along the side of the building with screening. Nfi-- Osgood stated that the
existing buildings have electric heat and is very The applicant would like to use
propane but, will screen the tank with trees. r1{ir, i o erx asked if they will require a Fence
around the tank. Ms. Colwell stated that what ever the Fire Departrnient requires they will

Mr. Osgood stated that with regards to the rnaintenam;e of the road these buildings are
part of a condo and does not know if they can do that.
On a motion by Illy. Mahoney, seconded by IMT. Angi es, the Board voted unani mou sdy to
close the PublicHearing-
On a motion by Mr. Angle , seconded by Mr- Simons, the 13aard voted unanimously to
approve the draft decision for 33 Walker Road a; arnen&l I.

Site P[an Review - Special Permit
The Phuining Board herein approves the, Special PcnTWSite Plan Review for (lie,
construction of 6900 SF office building located in the General Business (GB) Zoili ig
Di-strict. This Special Permit was requested by Security Realty Trust, 33 Walker Road,
North Andover, MA 01845 on land owned by F. Scott FoIlabsbee— TMs application was
filed with the Planning Board on May 20, 1998.
The Planning Board makes the following find}ngs as requited by the North Andover
Zoning; Bylaws Section 8.3 and 10.3:
FINDINGS OF FACT.
1. The specific site is an appropriate location for the project as it is adjacent to an
existing office building;
The use as developed will not adversely affect the neighborhood as suffleitmt Wfft!r
have been provided;
3. There, will he no nuisance or serious hazard to vehicles or pedestrians;
4. The landscaping approved as a part of this plan meets the requirements of Section 8.4
of the Forth Andover Zoning Bylaw;
S. The site drainage systvTn is designed n7 accordance with the Town Bylaw requirements
and has been reviewed by the Depamient of Public Works;
6. The applicant has rnet the requirements of the Town for Site Phin Review as stated in
Section. 8.3 of the Zoning Bylaw;
7. Adequate and appropriate facilities will be provided for the proper operation of the
proposed use.
Finally the Planning Board finds that this project generally complies with the 'l'o n of
North Andover Zoning Bylaw requirements as listed in Section 8.35 but requires
conditions in order to be fully in compliance. The PLuming Board hereby grants an
approval to the a►pplicauit provided the following conditions are met,

must comply with the following conditions:
a) The propane tank location and design mist be reviewed and approved b

b) The fine plan must be reviewed and approved by the drainage consultant,
DPW and the Town Planner and subsequently endorsedi by the Planning
board. The final plans must be subnm ttcd for review withirt ninety days of
wing the decision with the Town Clerk.

c) A bond in the amount of five (housand dollars ( 5,000) shall be posted
for the purpose ofinsufiug that a Enal as-built plan showing the location of
all on-site utilities, structures, curb cuts, pau•Uig spaces dnd drainage
facilities is subrnitted. The bond is also in place to insure that the site is
constructed in accordance with tllc approved plaB. Tl�s bond shall be in
the form of check made out to the Town of North Andover. This check
will then be deposited into an interest bearing escrow account.
. Prior to the start of eoastruction:
a) A construction schedute shall be submitted to the Planning Staff for the
purpose of tracking the construction amd infi)nung the public of
anticipated activities on the site.
b) All erosion control must be installed as shown the approved and endorsed
pi uIS.
3. Prior to FORM U verification (13uildtng Permit Issuance):
a) The final site plan mylars rest be endorsed and three (3) copies of the
signed plums must be delivered to the Planinirzg l partmtmt.
b) A certified copy of the recorded decision roust be submitted to the Planting
Department.
4. Prior to verification of the Certificate of Occupancy.
a) The applicant roust submit a fetter from the w6iitect or eugineer of the projmt
stating that the bi"ffir& signs, land.scVing, fighting and site layout substantially
comply with the ping referenced at the end of this decision as endorsed by the
Planning Board.
b Tlbe li&,htnig for the new building must match the existing lighting on the site.
c) The landscaping; must be planted as shown on the approved and endorsed
plans.

d) The Planning St fI shall approve all artificial lighting used to illwuinate the
site. A_ll lighting shall Nave imdergro td wiring and shall lie so arranged
that all direct rays froin such lighbug falls entirely wit!hin the site amd shall
be shielded or recessed so as not to shine upon abutting properties or
streets. TIe Planning Staff shall review the site. Arty cha rgcs to the
approved lighting plan as rmy be reasonably required by the Planning Stall'
shall be made at lbe ovmer`s expense.
e) The buRding must have com merciul fire sprinklers installed in accordance-
with the Noffli Andover Fire Department.
5. Prior to the final release of security:
a) The Planning Staff shall review the site. Any scrceaing as may be
reasonably requircd by the Planning Staff will be added at the applicant's
expense.
b A fnal as-built plan slowing Enal topography, the locatiotY ofall on- site
utilities, stracturcs, curb cuts, parking spaces and drainage facilities gust
be submitted to and reviewed by the Planning Staltand the,Division of
Public Works,
6. Any stockpiling of materials (dirt, wood, cc�nsiructiork leri�tl, etc.) must be
shown on a plan and reviewed and approved by the Planning Stall: Any approved
piles must remain covered at all limes to Ftiufuruze any dust problcsns that may
occur with adjacent properties. Any sto& piles to remain for longer than On,-
week must be fenced off and covered.
7. In an effort to reduce m)ise levels, the applicant shall keep in optirnum working
order, through regular maintenance, any and all equipuacnt that shall ein.,aroate
souuds from the structures or site.

not create miy glare or project any light onto adjacera residential properties.
9. Any giants, trees or Awkiiss that have been incorporated into the Landscape Plan
approved in this decision that die withiii.one year from the date of planting �diall be
replaced by the owner.
10, The contractor shall contact Dig Safe at least 72 hours prior to commencing any
excavation.
11. Gas, Telephone, Cable and Electric utilities shall he installed underground as
specified by the respective utility companics.

the Fie J DcpaEtment regulations.
13. No imdergrotuad fuel storage shall be imlalled except as may be allowed by Towrl
Regulations.

applicant, its employees and all successors and assigns in interest or control.
15. Any action by a Town Board, Commission, or Department that m.quires Ohanges in
the plawi or design of the building as presented to the 1 Lum ng Hoard, may be
wbject to modification by the Planning Board.
16, Any revisions shall be subrriittcd to the Town Planner for review. if these revisions
are deeriied substantial, the applicant must submit revised plans to the Phmning
'Board for approval.
17. This Spec' Perinit approval shall be dceroed try have lapsed after
„m (two years I�orn the date permit granted) unless
subktandal use or construction has commenecd. Substantial use or construction
will be determined by a majority vote of the Phum7mg Board.
