Dear Ms. Bradley-Colwell:
We. would like to take this opportunity to review the constrnuetion that leas lnern completed as
well as the schedule that is projected; to complete the freez,er addition at the above referenced
facility.
T'lie site has been mostly^ graded to finished clevatilons with minimal work to be clone in the near
finure for final seeding or paving. This includes tlnc sound berth required along the west side
of the facility. i"lnc no•tlnertu portion of the berm Mill needs to be filled and graded but will not,
be per fbirtned until e,xcavation and, construction occurs for high vo l a e lines reloeat'ionn.
Site utilities will be excavated and installed unluon the exodus of txades associated with the
building envelope. `l'lnis may occur th second week. in April with the finish scheduled the end
of April. The excavation, placing and grading of paving sub—base and base is included in the
clue for a oniplet;ion. No paving had occurred in late olf' 1,91914 dine to winter conditions prevailing,
therefore leaving the contractor preferri:rng to do it at the e.nd of the building e,ortstrurction.

stabilization neat and crushed stone. A ,food ponWtiotu of this original :sne and its associated
drainage Nmern coupled with hydrostatic pressure built up by the new sound inet° ;t made
excavation of the site quite an, extended and difficult pu°oeedunrc, The Coraractor perf rnned quite
an effort to place the new foundations.

The Planning Board met this past l qr k to discuss the
proposed Bake IN ,boy addition. The Board did not have a quorum
and was therefore unable to rake to a decision. The Board will
be holding a special meeting on June 22 , 1993 at 7 : 00 pry at the
Department of Public Wol-ks to make its decision.

In responsc to your letter dtated May 2 5, 1993, please be advised of the following;
With regard to landscaping, we have not submitted a landscaping plan because
those, areas of the property wbich are visible from Willow Street are already
landscaped with are assortment of flowering shrubs and ornamental trees- Il leas
been my expectation that the suitability of the existing landscaping would be
confirmed during an inspection by either yourself or niembers of the Board.
With regard to exterior lighting, we propose to relocate two wall mounted exterior
fixtures from the present north wall to a similar location on the new moth wall
(facing Contact East). We further propose to add one adjustable floodlight of the
same type as existing over the new loading docks on that west rand of the addition,
and to add two pole mounted box downlights of the same type as existing axt thie
rear of the paved area as shown on sheet C-L 'These arrangements will not shine
any light off the property in the dircction of Route, 125 and adjacent horses,
Lastly, T have enclosed a copy of a letter from Tech Environmental, Inc. of
Waltham, CIA which addresses the issue of noise levels frown the plant and froin
the T-efrigeration trucks which are part of its operations. Oar team will be available
at tonight's continued Public Ilearing to answer any further questions which the
Board might have.

Re: Noise Levels at Bake en JOY
Bear Bob:
Teoh Environmental is pleased to submit this letter to Bake In Joy
Foods, Inc. regarding the expected noise levels in the residential
area aCroas Route 125 with the refrigeration units on trailer trucks
parked at Bake In Joyrs loading docks shut down at night.
Actual sound le,;el monitoring was dote on March 27, 1991 at the
closest property llne to Bake In Joy, This was approxinately 30 fast
south of Route 125 with an unobstructed lire of sight to the loading
dcCk3 at Bake 7--1 Joy. Noise n aeurements followed procedures
recommended by the MA DEP. Measurements were 'taken after it night
when background levels were loWast and used Precision Type 1
equipment. A Quest model 143-155 Sound LaVel Analyzer with octave
Bad Filters was used and all eqAipment was proporly calibrated. The
measurements were taken between 12 : 00 am and : 10 am during the early
morning of Wednea ay r March 27 . The broadband so nd level used by the
MA BEP is the which ,is the sound level exceeded 0 of the time
measured in A--weighted decibels (dBA) . All refrigeration trucks at
the Bake -In Joy loading dodos were ,shut off during one of the
measureaents exactly as they are tieing shut down today.
The -measured Jm "sound leVei was 38 .4 dBA which is considered the
ambient background level. This is a very quiet sound level and was
composed of small contributions from a variety of dispersed sources in
the area. The Bake In joy plant contributed little sound energy, if
any, toward the background level,. 1t is our opinion that the ambient
background level of 38 . 4 dBA is still representative of Conditions
today at that location if there are not any nO fo"Ildings at the North
A lover Business Park built since March 1991 which manufacture or
conduct operations during the early mot'ninq hours (between 12 am and
am) . it is our Understanding Phat there have not been any charges
at the Bake rn Joy facility in the last two gears which would
significantly affect nolae levels. Thereforee if the refrigeration
trucks are not running at the site then it is clear that the Bake In
joy plant is not in violation of any MA DEP noise standards. The shut
dawn of the refrigeration trmcks during the early morning hours is the
best possible sound level mitigation strategy. In the event that Bake

With regard to my letter of May 13, 1993, please be advised that the sound
attenuating berm and fence proposal referenced therein was discussed by Mr.
Robert Ogan of Bake ' f Joy and a group of abutters on Sunday everting at the
Monte of Steve Caron of 22 Katltleen Drive, Andover. It is my understanding that
the abutters will inforan. the Planning Board of their general acceptance of the
proposal at tonight's public hearing. However, there was one important point that
was not resolved. It became clear during the discosgions that the installation of the
betnVfence is for numerous practical reasons linked to the construction of the
addition, which is not scheduled to proceed until the 1994 construction season-
Accordingly, no relief would be provided to the neighbors for over a year. Mr.
Ogan recognizes that the neighbors concerns are largely with existing conditions
and therefore would like to make the following ot1'er:
"I'ltatt provided alI parties of interest agree that the principal source of noise is the
refrigeration units on the delivery trucks which have until now been loaded on the
west side of the facility during evcr ing and night hours, Mr- 0gan proposes to
limit the ]tours of operation of these units until after 5;00 a.rn. on weekdays when
the plant ordinarily opens. Bake 'N Joy will continue to limit the operation of the
delivery trucks in this manner until the addition is constructed.

The Bale 'N Joy Company in the North Andover Busim-, s Park is a 62,000 +!- square
foot facility that includes business offices and various food processing operations. It was
constructed in 1986 under a Special Permit, from the North Andover Planning Board,
issued in the Fall of 1995. Its products consist of dry and wet mixes for products such as
cakes, mums & icings which are sold to supermarkets, distributors, food service
distributors and bakeries. Bake `N .boy also produces frozen batters for the same market,
The company is proposing to enlarge the facility by construction of a 13,000 +/- square
foot freezer and related loading area, These improvements will enable the company to
consolidate operations. They are currently leasing space in Salem, NH
As concerns characteristics of use and operations, please be advised of the following,

Bake Joy employs 70 people on site; 25 are oflice workers and rnauageineart, while 45
work in the various food processing activities- With the exception of a sinall 5-person
second shift, all business and food processing work is done during normal business hours.

parking need is for approximately 65 spaces, although 84 spaces are available-

Daytime trick operations involve anywhere from 5-20 pickups and deliveries per clay by
tractor trailer or straight bodied trueks some of which belong to Bake 'N Joy, others to its
customers and suppliers, There are also occassional deliveries of bulk materials at the
southwest corner of the building-
The proposed addition would not increase the frequency of truck traffic beyond its current
level because an expected increase in out bound shipping will be off'set by elimination of a
comparable amount ofshuttfxng which now tales puce between the punt and SMein, NH.
N igliftime operations Consist of the load iPig, SuPiday - Tbursday, of up to six trucks owned
by Bake N Joy by are four-person crew. These trucks are equipped to carry dry and wet
mix as well as frozen products- They are loaded between 5:00 p-m. and ;00 a.m. They
depart the property at 5; 0 a.m. to make deliveries, returning later in the clay- Since it
opened, changes in its method of distribution have allowed the company to reduce the
number of trucks from twelve to the six that are currently its use. The company does not
foresee a need for niore tracks in the future-
In summation, the proposed freezer addition will not be responsible for any significant
clianges in the personnel needs or the intensity and characteristics of use of the Bake ' !

At the public hearing of January 22 , 1993, the Commission directed
site storm water detention to be provided to mitigate the effects of
increased runoff from proposed impervious surfaces on adjacent wetland
resource areas. Nee Associates proposes to accomplish this by routing
all additional runoff into the system of catch basins which presently
drains the paved (loading) areas on the rarest Bide of the facility and
modifying the outlet of this system to provide a
detention sedimentation pond with a sharp crested weir outlet
structure.
We have submitted calculations to demonstrate that the proposed pond
will store 4. 03 acre feet of grater for a 100 year storm event with a
peak elevation of 249. 3 feet and are outflow rate of 5. 6 cubic feet per
second. This rate is less than the existing cc-adition flow rate for
the 100 year storm of 7. 2 cubic . feet per second at the same design
point.
The proposed pond will also provide natural filtering and sedimentation
for the existing runoff from the total subcatchment that it serves.
