The North Andovez Planning Board held a public hearing on Tumday evening, March 17, 1998 at
7-30 p.m in the Department ofPubdc Works Conference Room, upon the application of Bay HM,
LLC, 355 Eddleaex Street, Wilrningtor4 N11A 0 18 87 requesting a special penult under Ser;tion
8-3 Site Plan Review of the North Andover Zoning Bylaw- The legal notice was properly
advertised M the North Andover Citizen on Februwy 25 and March 4, 1998 and all parties of
interest were duly notified. The following members were present; Rickard Ro en, Chairman,
Alison Lc ;carbeau, Vice Chairman, John Simons, derk, Joseph - Mahoney, Alberto Amgles,
Associate lrfember and Richard Narddla- Kathleen Bradley Colwell, Town Planner was also
present-
The petitioner was requesting a special permit to construct a one floor 21,600 Sly light
=ufacturing business office- The location of the property is located on Lot 1- B-I Orchard M1
Road in the, (1-1) Industrial -I Zoning Dlstrict-
The North Andover PlaxmiRg Board held a regular meeting on April 7, 199 8. The following
members were present: Richard S. Rowe, Chairman, Alison Lescarbeau, Vice Chairman, John
Simons, Clerk, Joseph V- Ivlahoney, Richard Nardel[a and )Uberto Angles- Kathleen Bradley
Colwell, Town Plarmer was also present.
Steve Webster of Bay HM L-C-C. and Steve Poster ofDunon & arfield were present to
represent Lot 2A Orchazd H11 Road. 'M.9. Cclwedl stated that She does not have any input from
DPW coacerrting the cul-de-sac. r- Wtb ter stated chat thz�re is an 18" snipe that drains off the
site and IVir- Barker leas submitted a letter stating that is was 0-K- k1s, Colwell stated that we
need an easement for this and not just a letter. lffs- Colwell went over the rwo-foot separation
with the Board. 1%4s, Colwell stated that they need to add erosion control to the plan. [r. Simons
asked what buffers the sides of the property because it is very close to a resicfer�tlal area- Ir,
bster stated that there is about a 1,000 feet between the residential area- fir. 1Ro en stated

buffer is needed.
On a motion by Ms. Lescarbeau, seconded by fir- Tvfahouey, the Board voted unanunously to
close the pubfic bearing.
On a motion by TW. Mahoney, seconded by IVE, Angles, the Board voted unanimously to approve
the decision for Lot 2A Orchard M Road as amended-

01837, requested this Special Permit. T1vs application was filed with the Pkmning Board
ou February 19, 1998,
The Planning Board makes the following findings as required by the North Andover
Zoning Bylaws Section 83 and 10.3:
YMINGS OF FACT,
1, The specific site is an appropriate location for the project as it is located in an
industrial park and is zoned for industrial use.
1 The use as developed will not adversely affect the neighborhood as sufficient buffer
have been provided as well as conditions on the hours of operation, the location of the
HVAC units and other noise producing elements;
3. Where will be no nuisance or serious hazard to veHcles or pedestrians;
4. The landscaping approved as a part of this plan meets the requirements of Section 8.4
of the North Andover Zoning Bylaw;
. The sits drainage system is designed in accordance with the Town Bylaw
requirements.
6. The applicant has met the requirements of the Town for Site Plan review as stated in
Section 8.3 of the Zordng Bylaw;
7. Adequate and appropriate facilities wig be provided for the proper operation of the
proposed use.
