in response to your requuest, in your petition dated February 5, 1986
this Division has reviewed your application for a Wc°5A.ter Quality Certifi,catiott
on ;behalf of Elm Square Builders to place fill within s 3,000 square foot
area of bordering vegetated wetlands for access to an upland site located.

In accordance with the provisions of Section 401 of the Federal Water
Pollution Control Act as amended (Public Law 95-217) , this Division hereb
certifies that,, based on information and investigations, there is reasonable
assurance that than proposed osed activity will be conducted in a manner which will
not. violate applicable eater gpality standards adopted by this Division under
authority of Section 27 (5) of Chapter 21 of the Massachusetts General. Laws,
as codified in 314 CMR 4,0 ,
should any violation of the water quality standards or the terms of p:his.
certification occur as a result of they; proposed activity, the Division will

n February 25 , 1986, at 23 : 47 hours , we :responded to an alarm
at the Elm Square Builders office building site on Route 114 .
Upon our arrival, we found three piles of gush burning. I spoke
with Elm Square Builders and they stated that the fire was barely
burning when they left the site. They were sited for illegal
burning and l advised them that they would :not be able to build
for two weeks .
Usually, the Fire Department requests, in the order or conditien8
that the builder contact the department for permission to burn at
the site; but since I did not have the opportunity of reviewing
the site plane a second tine , I did not issue the Murder of conditions .
copy of my letter to your dated NOvember 13, 1985 is attached.
I would hope in the future, that the planning board would delay
action until all the information is reviewed; prier to issuing
the under of conditions .

I any requesting that the heaping on this proposal be deferred
until, further information is received.
According to the site pla&ly-law "Plan Requirements" , the
arrangement degign and appearance of the proposal-structures
are to be shown on the plans submitted.
I cannot make comment witbout knowing those ,building features
which would affect fire prgfection.
Having served on your By-law Committee and having been a supporhnT-
of this by-law, i felt that one of the intents was to have a
cansistant policy and set of criteria for developers to meet.
Thesc submitted plans fall short of that} criteria.
