Dear tie. Bradshaw;
Who North Ar4over Planning Board hold a public hearing on
October 4, 1994 in the Senior Conter behind the Town Building, upon
the application of FM Incorporated, 881 Baot Street, Tewksbury, Xm
, regmestinq approval to a Site Plan Review under ftation 8.3 of
the North Andover zoning Bylaw. The legal notice was properly
advertised in the Lawrence Eagle Tribune an September 1, and
September 7, 1994 and all pa►rtion of intaract ware duly notified.
The following Board astbars were present. Richard Hardella,
chairman, Richard Rowan, Cleric, .Tahn Simons, and Alison Leecarbeau.
The petitioner .was request Site Plan approval for the
construction of a 5,619 asq.ft. , 1 story addition to the existincj
228,678 sq.ft. Market Basket.
Mr. Rouen read the legal notice to open the public hearing.
Mr, Steve Stapinoki, -Merrimack Engineering, presented the
Board with an overview of the proposed prajact.

lighting on back of building. Mr. stapinski stated than lighting
will not change.
Mr. Nardslla grants Planning Hoard to think about eliminating
some more parking along the front and expanding travel Lana -
review ghat can be done to delineate travel lanes better.
Applicant to mark edge of now building on pavement. The
Planning Board will roview on their own time.
Hr.. Simons asked f4hat are the future plane for the site. Mr.
Steppinaki stated the there was not enough apace an the site lox
additional expansion due to watland araas and the need for parking.
' Nr. Rmmn asked if there -was any outaide security planned for
sits. Mr. Stmpinuki stated that he was warrkinq with the Police
Department and may have unmarked cars at peak seasons. and hours,
have video Cxamarau, possibly a bicycle officer. Mr. Hardella
stated than 11e was looking for a commitment to security. _

on a motion by Rowan, seconded by Simons, the Board voted to
continua the public hearing to Ontaber 4, 1994.
On October 4, 1994 tha planning Board held a regular westing.
The following megmtborre were present. Joseph Mahoney, Vice Chairman,
Richard Rowan, Clerk, kTohn Simone and Alison Leacarbeau.
The Board continued their disausafons of the addition to
Market Basket.
Mr. Simona asked if there were any state permits raqui red.
Mr. Stapinski stated no because there is leas thou lot alteration.
Kr. Simons encouraged common parking, do not need all of the
required parking spaces.
There was a discussion of security issues.
Mr. Kattenbaok stated that he hss been talking ate working
with local police, marked and ur=rkmd security.

On a motion by Kr. Sinans, seconded by fir. Rowan, the Board
voted to close the public hearing and direct staff to draft
deciofon for October 10, 1994 meeting.
On October 18, 1994 the Planning Hoard 1ia1d a regular meeting.
The following members were present: Richard Hardella, Chairman,
Joseph Mahoney, Vice chairman, Richard Rowan, Clerk, LTchn Simons
and Alison Lescarbeau.
The Planning Board discussed the draft decision.
Set bond at $5,oco.
on a motion by Ms. Lescarbeau, seconded by bdr. Mahoney, the
Planning Board voted to approve the Site Plan Review for 350
Winthrop Avenue as discussed.
Attached are those conditions.

The Planning Board ktarei_n approves the spacial Perth/Sites Plan
Raviaw for the constructiQt% of * 5,619 square foot addition to
the exiating 228,679 square foot Market Bea et Building in an B-3
zoning District. This Special Permit was raquastad by Delta
Delta Realty Truest, 991 Fsat Street, Tewksbury, KA 01876 on
August 26, 1994.
The Planning Board makes the following findings as raquired by
the Zoning Bylaw Section 0.3 and 10.3:
MWINGS OF FACTx
1. The specific site is an appropriate loeetlan for the project
AR it is an addition to the axiating super market building;
2. The use, an developed, will not udveraely affect the
naighborhood as the mite is curratitly developed as a
Shopping center,
3. Thane will be no nuisance or eerioua hazard to vehicles or
padestrians as travel lanes in the parkin} lot will be kept
at the same width,
4. The landscaping plan approved as a part of this plan meets
the require mends of Section 9.4 of 'the Zoning Bylaw,

5. The site drainage system is designed in accordance with the
Town Bylaw requirements;

6. The applicant has met the requirements of the Town for Site
Man Review as stated in Section 8.3 of the Zoning Bylaws

7. Adequate and appropriate fetcilitiss will be provided for tha
proper operation of the proposed sage.
Finally, the Planning Board finds that this project generally
i complies with tha Town of North Andover Zoning Bylaw requirements
as listed in Section 8.35 but requires conditions it: order to be

4. Prior to the final release of security:

submitted for review to the Planning office 4rA

determined by a majority vote of the Planning Board.
b. The Planning Hoard will review the site. Any
additional landscaping ass may reasonably be required by

open the fact that the current parking lot in not filled to
capacity and the applicant has damonstrated that additional
parking can be added if deemed mecessary by the Hoard in the
future.
