Dear Mr. Scott:
Regarding the subject property, please find enclosed herewith a copy of plans which depict a
proposed addition to the front of the Market Basket retail facility, and expansion of the
Market Basket retail facility into the adjacent liquor store. I have also enclosed a copy of the
site plans originally approved for the addition currently under construction (which was
previously approved by the Planning Board, and is not the subject of this correspondence).
The proposed addition, to the front of Market Basket, involves 464 square feet of building
area, which will be used exclusively for bottle return machines and vending machines, and for
an expanded vestibule. No additional retail area will result from this proposed addition.
Given the quantity of parking already existing at the site, and that expansion of the grocery
store into the liquor store would only require an additional 13 spaces (about 1% of exiting
parking - see enclosure), we propose those spaces not be constructed.
As a result of all of the above, and in accordance with Section 8.3.2.a.3, it is our opinion that
the construction, improvements, and uses in the existing structures will not change or result
in changes to the traffic circulation, storm water drainage onto or off the site. As such, in
accordance with Section 8.3.2.c.ii, we hereby request from the Planning Board a waiver for
Site Plan Review since the alteration or reconstruction of the existing structure will not have
a significant impact within the site and in relation to adjacent properties and streets, or
pedestrian and vehicular circulation, public services and infrastructure, environmental, unique
and historic resources, abutting properties, and community needs. As such, we request that
the Planning Board find that submission of a Site Plan Review Application is not required,
and provide to us correspondence indicating that such an approval is waived.

Dear Mr. Stapinski,
This letter is in reference to your letter of February 9th regarding a request
for a waiver for the Market Basket proposal. Acting in the capacity of the
Town Planner , based on the information presented I concur with your
letter that the 464 square foot expansion of the retail Market Basket store
into the liquor store will not require a site plan review.
This decision is based on the fact that the uses are similar in nature, the
use will not require any addition to the structure, and the extension will not
create additional traffic as compared to the two separate uses.
This waiver is provided with the understanding that any and all prior
permits jurisdictional to the Planning Board are considered extended to
the new space. Further this waiver does not waive any other requirements
of the Zoning By-law and or building code.

Dear Mr. Soucy,
Thank you for appearing before the Planning Board last night to discuss the proposed addition to
the existing Market Basket store. The Board discussed the following issues that will be addressed
at the August 18`h meeting:
1. The entire parking lot including the pavement in the rear of the building must be re-paved
and re-striped.
2. The Town has adopted a new parking space size of 9' x 18' with no provision for compact
cars. The Board questioned the size of the current parking spaces and the proposed spaces.
The Board will not support additional compact car spaces.
3. The abutters expressed concern regarding the hours of deliveries and dumpster pick up. The
Board of Health and Police Department have been working on this issue. The Planning
Board will be limiting the hours for deliveries and trash removal and would like your input in
setting these hours.
4. An elevation of the proposed building must be submitted for review and approval by the
Planning Staff and Board.

typically reviewed by Town Staff.

Dear Board Members,
This letter is regarding the proposed addition to the DeMoulas/ Market
Basket building, located at 350 Winthrop Street, North Andover. The Health
Department would like to offer information as to current issues involving this
property.
Since the fall of 1997 this department has received numerous complaints
regarding excessive noise at 350 Winthrop Street. The loud noise in question
was occurring between the hours of 9:OOPM and 7:00AM and appeared to be
caused by dumpster activity and/or deliveries. (please see citizen petition
attached).
Written correspondence to the dumpster permit holders and the dumpster
hauling companies was made to stress the regulations set forth by this
department. (see regulations attached) The North Andover Police Department
was also contacted to assist in identifying the violation source. However, since
that time, both the Health Department and the Police Department have
continued to receive sporadic complaints and have been unable to identify the
violator(s).
In addition, upon an inspection by this department the following
observations were made; the parking lot had many potholes, many of the
dumpsters were not kept closed, they did not have the ability to be locked at
night, and were also placed too close to the building. To assist in reaching
closure of these issues for the Waverly Road neighborhood, the Health
Department has the following recommendations.
1) Restrict store deliveries to the hours as put forth by the dumpster regulations;
No deliveries from 9:OOPM - 7:OOAM, with the exception of approved
individual vendors.
2) Resurface the entire parking lot to minimize truck noise. Presently, the
parking lot is in severe disrepair and is responsible for much of the loud
noise.

3) The Fire Department regulations regarding the placement of a dumpster calls
for a minimum of a 25 foot separation from any structure. In an effort to
comply, it is suggested that upon lot resurfacing, a permanent mark or
buttress be placed to identify each space.

DUMPSTER REGULATIONS FOR THE REMOVAL, TRANSPORTATION AND
STORAGE OF GARBAGE, RUBBISH, OFFAL OR OTHER OFFENSIVE SUBSTANCES
The Board of Health, Town of North Andover, Massachusetts in
accordance with, and under the authority granted by Sections 31A
and 31B of Chapter 111 of the General Laws of the Commonwealth of
4 Massachusetts hereby adopted the following rules and regulations
E at the meeting of February 10, 1994 .
This regulation shall take effect January 1, 1995.
Section 1 . 0 DEFINITIONS .._
Dumyster: Any container other than a -conventional trashcan
with _-lid intended_ for the _ outdoor storage of rubbish,
garbage or refuse of -any sort. --
Sectz`on 2 . 0 PRE-INSTALLMENT REQUIREMENTS : _ .
2 . 1 No person or property owner, authorized agent or corporate
entity shall maintain or operate a trash or- refuse dumpster,'..
- Hith a volume capacity greater than (three) 3 cubic yards,
-without first obtaining a permit from the Board of Health at '-:
} -�leasV three (3 ) days prior to installation.
2 .2- The nernit fee shall be $25 .00 per establishment per-
calendar year, and must be accompanied by a completed
application on a form supplied by the Board of Health.
2 . 3 Dumpster per-sits may be suspended or revoked by the Board
of Health for failure of the dumpster contractor or
property owner/owner ' s agent to comply with the requirements
of these regulaticns .
2 . 4 No contractor, firm or person shall supply a dumpster
service in the Town of North Andover, for the purpose
of storage , removal or transporting of garbage,
rubbish, offal or other offensive substances without
first obtaining a dumpster service license from the
Board of Health. All licenses shall expire at the end
of the calendar vear in which they are issued, but may
be renewed annually on application as herein provided.
There shall be a fee of $100 payable-- for said dumpster
service license, per truck.
2 . 5 These regulations apply to all dumpsters in the Town of
North ar:dover, w^ether for residential, commercial , or
industrial use .

Sec:ion 3 . 0 CONTRACTOR ' S RESPONSIBILITIES :
3 . '- The contractor shall have the dumpst-er(s) deodorized,
washed or sanitized as necessary at the time of
emptying, or as directed by order of the Board of
HeaIt .
3 . 0 The emptying of the contents of the dumpster(s) by the
contractor shall not commence before 7 , 00 AM and not
ccnzinue after 9 : 00 PM. The Board may modify these
hours, if, in its reasonable judgement, it is convinced
what :he public health, safety-or public welfare, would
be better served. The Board of _Health shall be guided
in th_s regard by the lccation, nearness to residential
property, frequency of emptying, . resulting noise and
other factors which it considers appropriate..
3 . 3 The contractor- shall have his/her name and. business
telerhone number conspicuously displayed on --each
dumps�::er. _--
3 . 4 No t~---ck that hauls dumpster contents shall be used to
transzort hazardous materials or- waste. --
3 . 5 The Board of Health may atta(i any conditions to the
license of a removal contractor- -th-at it deems would
} serve the. interest of . the: safety; -health, welfare or-
qual_ty of life of the citizens of .the Town .
3 . 6 Faill.:=e to comply with these regulations may result in
a fire of $50 . 00 , as well as suspension or revocation
of ner-mits as deemed necessary by the Board of Health.
Section 4 . 3 AUTHORIZED AGENT/PROPERTY OWNER' S RESPONSIBILIT`C
4 . 1 Each dumpster must be located at a distance from - the
lot line so as not to interfere with the safety,
convenience or health of _-abutter or residents .
Dumnster location must be approved by the Board of
Health.
4 . 2 When deemed necessary by the Board of Health,• it may be
recu_=ed that a dumpster site be enclosed or screened
byt:e property owner or authorized agent.
4 . 3 It ail. be the responsibility of the owner or agent
whose property is being serviced to maintain the
dumcszer area free of odors, scattered debris, and all
other nuisances, and to prevent overflow.
4 . 4 It shall also be the responsibility of the owner or I
agent whose property is being serviced by the
dumpster (s) to maintain the lid(s) in a closed
condition at all times except when actually in the
process of placing refuse in the dumpster.
4 . 5 Dumpsters are to be used only by those individuals who
are authorized by the owner or agent whose property is
being serviced. All unauthorized use shall be
considered a trespass of private property. The owner
or agent - may post a sign stating: "Unauthorized use is
prohibited by order of the Board of Health. "
4 . 6 No dumpster shall be used to dispose of hazardous
materials or waste: —
4. 7 Dumpsters are not to be filled after' 9 ; 00 P.M. or
before 7 :00 A.M. for residential property nor- after the
- - close of_the business -day for commercial property, at
which time the lids are to be--locked. - --
Section 5 . 0 TEMPORARY DUMPSTERS --
_ 5 .1 No person or property owner, authorized agent or
— _ corporate entity shall maintain or operate a temporary
dumpster (gondola or roll--off type) ' without first
% } obtaining a 3 0 -day permit from the Board of Health at
- least three (3 ) days prior to installation. Said -
Ferm 1-. may be renewed for an additional 30 days upon -
application. The property owner or authorized agent
shall comnly with al; the provisions of these -
regulations which are applicable to the operation of a
dumpster.
5 . 2 The fee for each temporary dumpster permit shall be $10 . 00 •
5 . 3 An inspection and sanitary survey of the temporary -
_ dumpster and surrounding area will be conducted by an agent
of the Board to verify compliance with Board of Health
standards.
5 . 4 Temporary dumpsters fcr on-site use by construction,
renovation, or repair firms will be - exempt from these
regulations. i
Section 6 . 0 ENFORCEMENT
6 . 1 Random inspections and sanitary surveys of in-place
dumpsters and surrounding areas will be conducted by an
agent of the Board to verify compliance with Board of Health
standards .

i. 6 . 2 All violations of State and Local Regulations shall be
remediated in accordance with said regulations.
6 . 3 If such corrective action, as ordered by the Board of
Health, is not taken by the authorized agent/property owner
within the time limit set forth by the Board of Health, the
Board of Health shall take such legal action as necessary to
remediate the violation.
6 . 4 The_ .Board of •Health, at. its discretion may levy fines upon
the authorized agent/property owner in accordance with
MGL Section 40 , Chapter 21D. Fines will-be no less than
$50, and no greater tharL $100 .
Section 7 . 0 SEVERABILITY
If any provision of this General Bylaw is held to be
unconstitutional or' in violation of state Law, it will not
- affect any other provision or the administration thereof . . -

North Andover Health Departme.nt.lhae recently been in receipt of numerous
complaints from abutting property Qw.ors Concerning excessive late night noise.
The complainants state-.thatA ere to rucks entering the rear loading areas at
inappropriate-hoursto either emptlthe dumpsters andfor load or unload trucks.
It also appears that the disrepair•of the parking lot is exacerbating the situation-
This'rssue had been addresbed by this department through written 4
correspondence in the falil of 1997 Some relief was felt at that time, but It Is now
reocourring. It had previously been determined that any continued violations to
the local dumpster regulations wok iId result In an order to attend a Board of
Health meeting. In addition, the violator could suffer possible revocation of
permits and/or fines. The police epariment is aware of the problem and has
been called to investigate on seve al occasions, however, at this time it is still
unclear who is causing thle disturb nce. A copy of this letter is being sent to all
known dumpster companies, wl7icT service this complex. Feel free to forward
