SITE PLAN REVIEW APPROVAL
SECTION 8 .3 OF THE NORTH ANDOVER ZONING BYLAW.
FINDINGS OF FACT:
The Planning Board makes the following findings regarding this
Site Plan Review application as required by section 8. 3 of the
Zoning Bylaws:
1. The proposed use and site design for this lot are
appropriate, clue to it's location in Turn.
. Adequate vehicular and pedestrian access into the surroiunding
site has been provided.
3 . The landscaping plan as shown and revised, moots the
requ ire-mo�xts of section 8 . 4 of the Zoning Bylaws.
4. The applicant has met the requirements of the Town for Site
Plan Review as stated in Section 8 .3 of the Zoxinq Bylaw.
. Adequate and appropriate facilities will be provided for the
proper operation of the proposed use.
Finally, the Planning Board finds that this proposal generally
complies with the Torn of North Andove-c Zoning Bylaw requirements
as listed in section 8.85 but requires conditions in order to be
fully in compliance. Therefore, in order to fully comply with
the approval necessary to construct the facility as specified in
the Site plan Review application before us, the Planning Board
hereby grants approval to the applicant provided the following
conditions are met:
CONDITIONS OF APPROVAL:
1. Prior to the Building Per-nit being issued for the structure
the following items shall be addressed to the satisfaction of
the Planning Board:
A. This deeisE;ion shall be recorded at the Northern Essex
Registry of Deeds and a recorded copy delivered to the
Planning Office.
B. All necessary permits shall be obtained through the
Massachusetts Department of Public Works, District 5.
C. This site shall have received all necessary permits and
approvals from the North Andover Board of Health and Fire
Department.
D. The applicant shall satisfy both the Division of Public
Works and the Board of Health with reward to construction
of an appropriate Sanitary Disposal System. Said disposal
system shall not otherwise affect the approved plans. A
final set of approved plans shall be provided to the
Planning office.
E. The -material to be used in construction of the proposed
structure shall be of a red brick. Sample material shall,
be provided to and approved by staff_
2 . Prior to a Certificate of Occupancy being issued for any
structures, the following items shall be addressed to the
satisfaction of the Planning Board;
A. This site shall have received all necessary permits and
approvals from the North Andover Board of Health and Fire
Department.
H. The site shall be reviewed b the Planning Hoard. Any
additional landscaping as may be reasonably required shall
he added at the owners applicants expense.
C. The odte shall be reviewed by the Planning Board. Any
changes to the approved lighting plan as may be reasonably
required by the Planning Hoard small be made at the
owners/applicants expense.
D. The proposed Handicapped Parking space shall be relocated
at the direction of the Building Inspector, so as to not
black access to the rear of the structure_
3. No underground fuel storage shall be installed except as may
be allowed by 'Fawn Regulations.
4. The provisions of this approval shall apply to and be
binding upon the applicant, its employees and all successors
and as igns in interest or control.
5. All lighting found within the site rhall be down cast and
shall not project into adjacent properties.
6. In approval of this application the Planning board has
reviewed and approved the fol.l.owinq signs
A. Two individual wall signs to be placed on the front
facade of the proposed structure. The first to read
"MOBIL MART", and the second to read "MOBIL SERVICE" .
Both of these signs shall be made of wood, and shall in
no way be interiorly illuminated.
B. The existing primary ground sign located to the front
of the property shall be allowed to remain as is_
C. The second proposed around sign located on the
northerly side of the px'oposed structure: shall he
limited to 85 ' in height.
These signs, and any others located on the property, shall
in all other regards conform to section 6 of the North
Andover Zoning Bylaw.
7. Vehicles shall be prohibited from making left hand turns onto
Winthrop Avenue from the southern most access to the
property. Permanent signs shall be posted directing left
hand turns from the northern most access ❑only,
8. No outdoor storage of any kind shall be allowed for discarded
material. (ie: Tires, Mufflers, Batteries, Etc )
