On July 1, 2008 upon a motion made by Jennifer l .usek, and seconded by Timothy Seibert, to grant a Watershed Special Permit to install two dry good storage containers and construction ofa refrigerated storage cooler within a portion of the 250' non-disturbance buffer zone located witbfn the -B zoning district within the Watershed Protection District, The original application was filed with the Planning Board on May 15, OOS_ The applicant submitted a complete application, which was noticed and reviewed in accordance with Section l 0.52 of the Town ofNarth Andover Zoning Bylaw and MGL Chapter 40A, Section 11. The Planning Board voted on the motion by a voice of 4-0 in favor_ A special permit issued by the special permit granting authority requires a vote of at least four members of afive- member board. The applicant is hereby notified that should the applicant disagree with this decision, the applicant has the right, urger Mai, Chapter 40A, Section 17, to appeal to this decision within twenty days after the date this decisions has been filed with the Town Clerk. I 1_ That as a result of the proposed core tructiorl in conjunction with other uses nearby, there will not be any significant degradation of the duality or quantity of water in or entering Lake ochichewick. The specific site is aR appropriate location for the proposed use as all feasible storm inter and erosion controls have been placed on the site; 2_ The use will not adversely affect the neighborhood as the lot is located in a General Business zorr ng district; 3. There will be no nci ante or serious hazard to vehicles or pedestfians; 4. Adequate and appropriate facilities are provided for the proper operation of the proposed use; 5_ The existing lot conforms to the inini mum lot area requirements for a lot within the neral Business District as Shown in Table 2 of the North Andover Zoring By-laws. 6, The Planiuug Board also makes a spcdfic finding that the use is in harmony with the general purpose and intent of the North Andover Zoning Bylaw. Upon reaching the above findings, the Planning Board approves this Watmhed Special Permit based upon the following SPECIAL ONDTT IONS- t.
