The Planning Board herein approves Ebe Site Flag Review Special Permit for the con Atudion of
3,672 sq. ft. retail hank with two drive-thru tellers and ors dxive-thm ATK 21 tots; patldng
spaces, draimage system network, grading atd landscape wmk witWn the General Busiuess
Zoning ( B)District and the Watershed Prot;xAon Di wGt. Thr, site is loeated at 1077 Osgood
St=t, Map 35, Lot 27. ` bs Special Pert was r mested by Angus Rralty Txvst, 1077 Osgood
Street,Noo Andover, . The applications were filed with the Planning Board Qn March 15,
01 . The applicant submitted complete applications, which were noticed and reviewed isu
accordance with Section .30.1, 4.136, 8.1, 8.3, SA, 10.1, and 10.11 of the Town of NoM
Andover ZQuing Bylaw and MOO CAOA, Sec. 9.
In amrdance with 4,136 the Plwwh£ g Board makes the finding that the inttnt oftl (,Bylaw, as well
as its sp ifia criteria, is met. This decision specifically stated by the Planning Board males the
following FINDINGS OF FACT:
1. The proposed project is a rosWt of discissions with the Pla g RwTd, Planning Staff
and outside consultants with respect to parking, clueing, site &a ign, lsz-Mdsaaping and
stormwater management. The resulting proposal limits site dist'ttrbance, pmvides
adequate paring and traffic queuing and provides for the least amount of impact on an
environmentally semitive a a.
, On Jannayy 8, 2013, the project received a variance from the Town of Forth Andover
owing Board of Appeals, as required by the Town ofNorth Andover's&nizg Bylaw, to
construct a new permanent structure in the Mon-Disturbance Zone. The Zoning Board
found that owing to circumstances related to soii conditions, shape of topography of the
land, that literal enforccment of the provisions of the Bylaw would involve subst ial
hWship,financial or otherwise.
3. The storm water manageuxent is tlesignod iu acoo c rn with the To Bylaw
requi=nents and Best. Management Engineedng and Prael!"s, and the most recent
veFsion of the MA DEP StDrmwateT Handbook, and has been -reviewed by the Town'a
outside consulting engineer, Lisa Eggleston. The appfi txt tilt ed the Agi W drainage
design to provide for s rmwater infiltration outside of Tone A (400 A. from the Lake)
and bas provided adequate safeguards to mitigate pollutants from entering the, Lake and
the surrounding area. See letters from L. Eggleston dated April 10, 2013, Tiny 15, 2013,
Alagnst 14, 2013 and September 12, 2013, The Plaming Board has determined that there
will not be any significant degradation of the quality acid quantity of water is or entering
Lake CocWcbewiek-
4. The applicant has provided aft nuatiomn for the volume of stonnwater for the 100-yam
storm event, to the maximum extent practicable. The design as proposed r€meats the
Deparftne nt of Bnvironmcmal Prote on's(DEEP) standards.
5. The plan refiocts extensive discussion with the Planning Boud and its consultants,

resWPing iz a desipi that provides for safe velucalar access througbout the site. See
letters froru the PL-aming Board's Traffic ConsWtnt, Vanam & Associates, Inc., dated
March 29, 2013 and der 15, 2011. Based on these and extensive discussion with the
Planning Board, the applicant m-desigaed the traffic pattern and provi&d cross allcs and
sidewAks for pedestrians. -ne pmject also includes a Truck. Citculatiou Plan (bated
August 10, 2013), providing access fbr safety vehicles as well as access for V4 -40
delivery trucks,using a pass ftoiagh lane outside of the drive-thru lanes in the rear of the
building. The North Andover Fim Department has approved the desi i—see letter dated
September 13, 2013.
. The applicant has provided architectural eievarions(Elevation plans A210 and A211, dwtd
April 5, 2013) and a landscape plan (flaked ;me 24, 2013). The architex, features and
Wseape design has been approved as wnsis# t with tie mmounding area.
7. The materials to be mM ja tho consp=don- of that building have been reviewed and
approved for use voidin the Watershed Zoning District.
8. The now bufding is corrected to the Town-saver and water systems.

1.1.Adequaw and approphate facilities will W provided for the proper operation of the
proposed use. The project will provide Town water, sewer, and affities on the property
to adequately ad&e s the needs of the project and has been reviewed by the Divii;iou of
Public Works and the outside consulting en& er,Hancock Engin wring Services,Inc.
U.his conditioned, the site is an appropdute location for the pmject use and proposed
str�sctures. -
Upon reaching the above fta&ngs,the PlanrAng Board appraves this Special Permit based upoa the
following SPECUL CONDITIONS-

2. The Town Planner shall approve any abanps made, these plans. Any changes deemed
substantial by the Town blamer would require a Public ear�ng and modification to the

3. Prior to the endorsement of the plan:

4. Prior to start of co5nstroction or site work and prior to the issnanee of a Building permit:
a) The applicant shall deai,gnaw an independent Construction Monitor who shall be zhostm
in consultation with the Plam Department staff. The Construction Monitor shall
atrriit weekly reports dung the entire diaon of the project and must be available
ti"n four 4) hour motive to inspect the site with th,Pia mi ng Board staff. The Flaming
Staff may educe the frequency of reports upon review of such a request from the
applicant.
b) All emsio n conwl ineame es as shown oa the plan must be in place and reviewed by the
Town.Plemner and Conscrvafion Deponent.
e) 'Thm (3) copies of the signed, recorded plans and the derision must be delivered to the
Plamdag Department.
