Section. I - Authorit
The North Andover Board of Healtl,i adopted these Keepin,g of Anima,15 Rules and Regulations
Under the authority granted by M.G.L. Chapter 111, SeGbon 31.
Section 2 - Purpose
Whereas rnininILIM standards for keeping of animal's protcction of'tl"m publk; health, arlinial
welfare,, and the environment are considered necessary for tIm welfare of the cornmunity, these,
regulations, have been adopted by the North Andover Board of I-lealth on September 22, 2022
and are effectilve on Septernber 22, 2022
Section 3 - Definitions
Unless otherws e noted below, the folIowing ternris shall have, the foll'owing definitions, 9110,Ugh

3.11 AbILItter: shall) mean the owner of properties within 30,0' of the parcel(s) that is applying
for the Keeping of Anirnals Perrnit as certified by The North Andover Assessor's ffice,
3,�2 Accessiory StruCtUre: A building or structure which is inci!dent4l to the primary or
principal building on the sarne Ilot and which, is devoted exclusively to an accessary or,
sleciondary use to the principal biuildinq,
3.3 Animal-. shall mean the keeping and raising of Ilivestook including, horses, the keeping
and raising of poultry, swine, cattle, an(] other dornesti'�cate,d aninial'S used for food or
farming purposes as defined in MG-34. Chapter 111.
3.4 Applicant: shall mean any person, on behalf of themsellves, a business or corpora ion,

3-23. Manure Management Plan: shelli mean a plian for the handling of manure. This Iplan
sknalll address cleaning, composting, storage, utifization, and riernoval of manure.

3.24 Nluiisance:,sliafl mean any condition including, but not limited to, noise, offensive odor,
attraction o,r- breediag of ibsects, an environment supporting growth of vermin, presence
of rodents, or any other conchtibn havibg public health or environni�iental significance,
3,25 Permit.,,, shall mean a permit that is issued by the Northi Andover Board of Health arid
appointed' agertts for the keeping of one or more animals in amordance with the
provisions of this regulation.
3.26 Permit Applicant; shall meart any person, an be,,hialf oftheniselves, a. business or

3.28 Petit: rrwan a structure for time keeping or housing one or more animals,,
3.29 Person,. shall mean a person, persons, association, partnership, trust, company,
corporafion, or other legal entity, owning property carrying on an activity regulated by
this rogulation.
3.30 Pest Managen'ient, Plan. shall mean a plan:, which adequately defines the measures
that sha,111 be taken by the owner to mibilrnize the presence of rodents, insects, and pests,
and to, rninknize throe creation of oldo,rs and other nuisances-
3,311 Plot Plan: shall nileani the plan that shiows the dimensions of the lot and area,where
aninials will be kept.. A plot plan must also include the locations of the primary residerice,
alt structures, fences, corra[s, septic systems, private wells, and wetIands, A hand-drawn
plotpl�ian is acceptable so long as it is of: sufficient detail and quaffty to, allow for review by
the North Andover Board of Health and a.ppointed agents.
3.32 Poultry: shalll mean the follbwing but is riot lirriJted to,, chickens, ducks, geese, guinea
fowl, pleafowl, pheasants, partiridges, quail and ItArkey.

3.35 Stable: shall mean a biailding or structure used for the shelter and/or feeding, of one or
more animals,

3.37 Swine, shall mean livestock suck as pigs, hogs and boars but Shall not sinclude
domesticated pigs kept pdrinarily indoors as, companion aninials-

Section 5 — Permft Requirements,

Section 6 - Application Requireirinents

,11 The permit holder is. responsibl'e to submit, and implement a Pest Management Plan for
the, facility and property. This plan requires approval by the Bozaird of f fealth and will be
performed by a licensed pest control company whenever required by law.. A written Pest,
Managernent: Man shall be SUbmitted with all permit appi[ications,

9A Any violations of these regulations may result in a nionetary fine and a written Order to
Correct,
9.2 Any owner or person in charge of a facility covered by these regulations who does not
comply with this, regulation or an Order to Correct: shaH be issued a fine Lip to three-
hundred dollars ($3010). Each day or portion thereof in whicli a violation exists shall
,constitute a separate offense.. Daily fines will continue to accrue Until all violations, are
rectified and the property and facility is, in full cuiipliance with these regulations.
