2022,have not been discussed. A chain link fence is proposed on the revised plan cutting off the peninsula.

• Rob DeRosa,Positive Start Realty states the area to the left of the fencing will be recycled asphalt, and the
peninsula area will be loamed. Most of the slopes are stable with the exception of the upper area where a berm
is proposed to control stormwater runoff.No work is proposed below the existing erosion control.
• Mr. Manzi expresses concerns with the site and states he would like to conduct a site visit to understand the
limits of work. He requests that either the Applicant or consultant be present for the site walk.
• Mr. Lynch expresses concerns that plan does not depict any form of protection for the catch basin on the far
left side of the plan,he believes an apron or pavement should be proposed. He notes that specific notations for
proposed slope treatment needs to be added to the plan.
• The Administrator recommends the NACC vote to engage a third party stormwater review.
• The Commission discusses slope stabilization and agrees a third party peer review is required.

• Mr. Manzi states he is an abutter to the project and recuses from the discussion.
• The Administrator states this is an after-the-filing for the construction of a wooden deck and stairs off the
west side of an existing porch. The deck and stairs received three(3)new footings within the lawn area,
approximately 39.8-feet from the BVW. The existing enclosed porch received five(5)new or existing
updated footings; a portion(95-sq. ft.) of the existing porch is within the 50-foot NBZ. They have proposed
288-sq. ft. of Buffer Zone planting enhancement as mitigation for the encroachment,which is proposed within
the vicinity of WF A3. This will result in a 3:1 ratio of enhancement vs. encroachment. A copy of the plant
list has been provided.
• Greg Hochmuth, Williams & Sparages believes the wetland boundaries have changed over the years. The
Applicants are proposing to keep a deck off the side of the three season porch to meet code requirements. The
previously existing porch had a set of permitted steps within the 50-foot NBZ. He reviews the proposed
Buffer Zone enhancement plan; no trees or shrubs were removed for the construction. The area is not mapped
for Priority or Estimated Habitat. A DEP file number has not been assigned.
• Mr. Mabon states he would like to see the mitigation area enhanced and expresses concerns with the shed
located within the 50-foot NBZ.
• Mr. Lynch states he would like the NACC to regain the 25-foot NDZ to protect the Resource Area.
• Mr. Hochmuth states based on research the shed was installed by the prior owner in 2017.
• Mr. McDonough states he is not in favor of the waiver request; he does not believe the deck was permissible.
• Mr. Manzi states as an abutter to the project he has no objections to the proposal.

• The Administrator states the proposal is to convert an existing three season porch to a four season room and
to convert the existing deck to a three season covered porch. There is no increase to the footprint proposed,
new diamond pier footings will be installed to provide additional support. The excavated soil from the new
footings and drywell areas will be distributed beneath the structures. Gutters and downspouts are proposed,
runoff will go to new dry wells within the existing lawn. One dry well is in the 25-foot NDZ,within the
existing lawn. Most of the house is within the 50-foot NBZ. Yard waste dumping and landscaping was
observed within the wetland. Flag adjustments were made, changes should be reflected on the plan. The
Administrator requested removal of the rotted tree next to WF A3 be added to the plan. A DEP file number
has not been assigned.
• Mr. Manzi states a waiver is required for the dry well in the 25-foot NDZ.
• Ben Osgood,Ranger Engineering states the structures are existing and are not proposed to be expanded. He
offers to move the dry well outside of the 25-foot NDZ.
• Mr. Lynch believes moving the dry well may have a negative impact on the foundation and Applicant's
basement,he is in favor of a waiver request,but it should be further expounded upon.
• The Commission discusses the proposal and agrees an alternatives analysis is required, and yard waste must
be removed prior to the next meeting.

• The Administrator states the proposal is in response to an EO issued in April 2022 and provides background
on the property. The Applicant has requested to keep the patio,which is under construction. A paver pathway
to allow wheelbarrow access is proposed,the remaining paver areas will be replaced with chip stone. The rear
porch staircase will be re-installed and the patio and walkway areas on the north side are proposed to remain.
Approximately 54-sq. ft. of patio within 50-foot NDZ is proposed for removal. There are two (2) sheds
located within the 50-foot NDZ, the smaller shed will be removed, and the large shed will be relocated
outside of the 50-foot NDZ. After-the-fact permitting has been requested for the screen house,raised
vegetable/garden beds and foundation planters; a small section of planters located within the 25-foot NDZ
will be removed. They have also requested after-the-fact permitting for a retaining wall and granite steps
which run along the northern side of the house.New proposed work consists of two (2)new planter boxes,
four granite steps with associated side block retaining walls. A formal waiver request has been provided for
the patio area. Approximately 1,165-sq. ft. of mitigation within the 25-foot NDZ is proposed.
• Julie Vondrak,wetland consultant for the Applicant states a detailed narrative has been provided to review the
existing conditions that do not meet the current by-law regulations. All of the work done by the Applicant was
done in previously disturbed areas, no work has gone beyond the existing retaining wall along the rear of the
property, the wall is stable. The original wetland delineation is depicted on the plan, a recent delineation was

done by Bob Prokop. The proposed plan has no structures located within the 25-foot NDZ. Half of the non-
permeable patio will be removed and replaced with chip stone.
• Mr. Lynch raises concerns that the screen house and patio are located over the septic tank and recommends
they speak with BOH. He states that although the new shed location complies with Conservation setbacks,
they should ensure it meets zoning sideline setbacks as well.
• The Administrator requests the plan be color coded to show new vs. existing/after the fact elements of the
project.
• Mr. Mabon questions if they are proposing polymeric sand between the pavers.
• Rich Mathers,the Applicant states they do not propose to use polymeric sand,to make the pavers more
pervious. All construction materials are on site, excess materials will be removed from site by hand.

• The Administrator states the proposal is for an in-kind replacement of an existing deck and provides
background on the condominium complex, a 40B development. Based on measurements,the existing deck is
located approximately 19-feet from the BVW; the wetland is at the bottom of a riprap slope. Per the project
engineer and the Building Commissioner the concrete footings need to be removed and replaced. The removal
of existing footings will be performed by hand; footings will be replaced with helical anchors.
• Paul Bergman,Bergman&Associates describes the process used to install the helical anchors.
• Mr. Manzi requests the disturbed areas be restored to their original condition.
• The Administrator recommends issuing a Negative Determination#3 with conditions requiring the pre and

• The Administrator provides background information on Small Project Permit NACC#288 issued in October
2021. A post-construction site inspection was performed in March of 2022 and found work to be in
compliance. In June 2022, a photo of the deck was uploaded to the Town's permitting system. The photo
depicted an unpermitted 335-sq. ft.paver apron/walkway within the Buffer Zone surrounding the deck and off
to the side of the house. After consulting with the Chairman, it was decided an after-the-fact RDA was
required.

• The Administrator states the project consists of driveway seal coating, securing existing fence posts,
replanting of two landscape beds with native plants and removal of invasive plants adjacent to the driveway.
One of the landscape beds will be reduced in size,the previously existing mulched area will be laid with sod.
Staff recommends that Asiatic Bittersweet and Staghorn Sumac be treated using a selective "cut and wipe"
application using a wetland approved herbicide and that Asiatic Bittersweet within the 25'NDZ also be
treated&removed. A non-coal tar based product will be used to seal coat the driveway, portions of which are
within the 25-foot NDZ and 50-foot NBZ.
• Greg Hochmuth, Williams & Sparages states due to the time of year seal coating of the driveway will likely
occur in Spring/Summer 2023.No driveway expansion is proposed,fence posts will be placed in the same
location and secured with concrete.
• Mr. Mabon agrees that treatment of the invasives within the 25-foot NDZ is beneficial.
• The Administrator recommends issuing a Negative Determination 43 with conditions requiring the pre and
post construction meetings,removal of invasives within the 25-foot NDZ, all invasive plant material to be
disposed of properly, inspect all new soil amendments to avoid introducing the Asiatic Jumping Worm, only
non-coal tar based seal coating will be permitted and dumpster to be placed in the driveway.

• The Administrator states the wetland was delineated by Seekamp Environmental. The front wetland was
identified as a vernal pool however it is not identified as a vernal pool by NHESP. The project consists of
installation of railings along the front walkway and stairs, selective treatment of Japanese Knotweed and
Multiflora Rose using a wetland approved herbicide. The homeowner is proposing a 3-year maintenance plan
for follow up treatments due to the aggressive nature of Japanese Knotweed; this work will be conducted by
an experienced contractor. Once the invasive species have been controlled,the area will be seed(native
NEWP seed mix) and stabilized with a biodegradable erosion control blanket. Two planting areas are
proposed with native species. A formal waiver request was submitted.

• The Commission discusses the proposal and agrees a waiver request is not required for Buffer Zone
enhancement.
• The Administrator recommends issuing a Negative Determination#3 with conditions requiring pre and post

• Jason Hill, TFMoran explains the reason for the Modification request.No changes are being proposed to the
cultec infiltration system as updated calculations show. He believes the shift in the parking spots will offset

Modification to change a section of the ramp from wood to concrete due to increased costs. The concrete

• The Administrator provides background on the OOC issued in March 2016. Cleaning of the stormwater
structures will be done in the next month or two. The performance bond was for$1 OK($7,500 for paving and
$2,500 for plantings). The OOC required mitigation plantings along the brook and a portion of the pond at
driveway 17. Staff inspected these planting areas and found the plantings along the brook to be in decent
shape.Not all of the plants in this area were present however it was filled in with native herbaceous plants.
The area around the pond is heavily invaded with invasive plants. She notes that the mitigation planting was
discussed at length during the public hearing process.

• Sean Landers,the homeowner,presents historic photos of the area before the work was completed. A copy of
the wetland resource map was provided. One grape vine was removed, and other plantings were installed.
Most of the removal was done by hand,machinery(1320 Kubota)was used to remove one of the concrete
support structures,no grading was performed. All work was stopped as instructed by the Field Inspector. He
states he spoke with his neighbor regarding the work and property boundaries. He lists the plant species that
were purchased and planted in place of the grapevine.
• The Commission discusses the violation and how to proceed.
• Mr. Manzi requests that Mr. Landers reconsider allowing staff on site.
• 9:57 p.m. Mr.McDonough leaves the meeting room.
• 10:00 p.m. Mr.McDonough returns.
• The Commission directs the homeowner to continue to cease and desist and to secure the services of a
wetland consultant to formally delineate the wetland by October 12, 2022. A Restoration Plan must be
prepared and presented at the October 12, 2022 meeting. They direct the homeowner to notify the neighbor of
activities which may occur on their property to bring the site back into compliance.
• Mr. Manzi requests that the homeowner reconsider allowing staff on site.
• Mr. Landers agrees to allow staff on the site moving forward.
• A motion to ratify the Enforcement Order as drafted is made by Mr. Mabon, seconded by Mr. Lynch.
