This Memo is submitted in support of the above referenced Application setting forth the
facts relied upon in preparation of said Application under Section 8.3 of the North
Andover Zoning Bylaw.
1. Under Section 8.3, Part 2(i), a Site Plan Review is required for new 2,800 S.F.
building with more than five (5) new parking spaces.
2. Under Part 5, information provided as follows:
• Site Construction Plans dated 10/31/08 prepared by Mistry Associates, Inc.
Scale T'=20' for Plan Drawings.
• Field Survey conducted by Mistry Associates, Inc. October, 2008.
• Under Section 8.3, Part 5(e), the information shown on the Plans and Detail
Drawings was developed by Mistry Associates, Inc. specifically for this
project. The following is information related to the sub-sections under 5(e)
that is not presented on the drawings.
vii) Storm drainage calculations prepared under separate cover.
xi) Notice of Intent to Conservation Commission will be filed for the
Commission's Meeting on 19 November, 2008, (See Comment 4
below).
xviil) Drainage Basin Study is essentially included in the Storm Drainage
Calculations noted in (vii) above.
xix) The proposed 2,800 S.F. facility will generate approximately 250
Vehicle Trip Ends per Day (Restaurant = 190+ and Retail 60 f) and
will not meet MEPA Thresholds for filing ENF. Given that the
Restaurant's hours are 11 AM to early evening with the peak
operations being around lunch time, a Traffic Impact Study is not
warranted.

xx) Two (2) applications for Permit to Access State Highway (Route 114)
will be filed with MassHighway — one for the reconstruction of the
driveway approach sections within the adjacent paper streets (Booth
and Saville) and one for the construction of the 8 inch gravity sewer
and the replacement of the water service line within the State
Highway. A copy of said Application is attached hereto.
xxil) The proposed project will have a positive fiscal impact given that it will
create several new jobs; have private waste removal and snow/ice
control operations; does not require any Town funded infrastructure
improvements; should increase adjacent property values and will
generate no school students and minimal, if any, public safety
operations.
xxiil) The projects community impact is also positive in that it dovetails
neatly with the relatively new "Corridor Development District" Zoning
criteria.
3. Under Part 6 "Design Guidelines", it is believed that the proposed Plans and
Details conform substantially to the General, Environmental, Design and
Traffic/Parking Guidelines. Zoning variances will be required as follows:
• Minimum Lot Size (54,004 S.F. vs. 87,120 required)
• Minimum Parking (19 spaces on-site vs. 25 required with 25% allowable
reduction).
• Minimum Side Yard Setback (10 Feet at paper street side vs. 15 Feet
required).
4. A Waiver Request will be filed with the Conservation Commission with respect
to compliance with the North Andover Wetlands Regulations.
