Dear Ms. Enright,
This letter is to describe the proof that the current location of the proposed above
ground pool is the only place that is available for the construction.
The lot at 35 Dale Street is on the South side of Dale street, wedged between the street
and a feeder brook to Lake Cochichewick. The feeder brook is flanked by low lying
wetlands.
The lot falls within watershed protection district as shown on the North Andover Zoning
Map dated 2017.
The watershed buffers for a structure built before 1994 are 100 feet in the Non-
Disturbance Zone, and 325 feet for the Non-Discharge Zone. A large portion of the lot at
35 Dale street falls within the I 00-foot buffer zone, and the entirety of the lot falls within
the 325-foot buffer zone.
In order to protect the safety of the general public, pools shall have a fence surrounding
them at all times with a looking gate. As with most lots, 35 dale street currently has a
fence in the rear portion of the lot. This area is within the 1 00-foot buffer zone.
The front yard is just outside the 1 00-foot buffer zone, but it is steeply graded and can
not be fenced in with a Suitable fence. The side yard is also not suitable for fencing and
has an existing sewer easement that cannot have a Pool Situated upon it.
This leaves the rear portion of the lot as the only suitable area for this project.

Re: Nitrate Level
Dear Ms. Enright,
This project involves building and above ground pool and filling it with chlorinated water.
Chlorine and Nitrates do not occur together. Nitrogen and Nitrates are detrimental to
chlorinated pool water. Therefor no Nitrates will not be created from the operation of a
chlorinated pool and no nitrates will be released into the ground down gradient to the
project.

Wetlands Delineation
Dear Mr. De Bernardo:
As you requested, I have evaluated the wetlands on and adjacent to the property at 35 Dale
Street in North Andover, Massachusetts, My delineation was performed oil October 9, 2017.
The parcel contains a single family residential dwelling, with a paved driveway located oil the
south side of Dale Street, at the intersection with Marbleridge Road. An intermittently flowing
stream channel runs east to west across the lot, and leaves the site beneath Dale Street through
a 24 inch rcp culvert, after taking a "dogleg" turn to the north. This stream has an expansive
system of Bordering Vegetated Wetlands located on either side of the waterway. The following
photos characterize the intermittent stream,just below Dale Road, looking northerly and southerly,

I have reviewed the USGS topographical locus for the property , and find that the stream running
through the property is not shown on the quadrangle sheet. As such, the stream will be
considered as an intermittently flowing waterway, and will not have an associated Riverfront Area
resource area.
The photo below shows the character of the wetland system bordering the waterway. The
resource area is a wooded swamp, with a Red Maple (Acer rUbrum) and Norway Maple (Acer
platanoides) overstory. The understory is relatively sparse, due to the density of the canopy and
is characterized by Honeysuckle (Lonicera tatarica). Understory vegetation includes a variety of
woodland ferns.

The delineation concerning the extent of wetland resource areas was based on the physical
features and vegetation found along the waterway. Due to the gentle slopes of the terrain
between the yard area and the downgradient wetlands, I used soils to assist in my determination
of the Bordering Vegetated Wetlands at the southern and eastern portions of the property. The
resultant delineation created jurisdictional areas on the 3 McIntyre Drive property. The flags are
pink and with Mack printing, and are consecutively numbered running from the northeast corner to
the southwest corner of the lot.
The delineation of Bordering Vegetated Wetlands included evaluation of existing plant
communities and the apparent hydrology, in accordance with the performance standards found at
310 CMR 10.54. The following is a list of plant species that were used in my determination of the
upland plant communities in the area of wetlands:

The Wetland Indicator Status, noted in the chart above, has been derived from U.S. Fish and
Wildlife Service National Wetlands Plant List: Lichvar 2012. The following key is a rough
interpretation of the Indicator Status-,

FAC-sometimes found in wetlands
FACU-seldom found in wetland
UPL -upland species, never or very rarely found in wetlands
NA-insufficient data for determination

I have reviewed the FEMA mapping for the Town of North Andover, and no portions of the lot are
mapped as containing areas subject to the inundation in the 100 or 500 year storm events. I have
also reviewed the DEP Priority Resource mapping for the site. Based on these maps, it does not
appeal* that there is NHESP Priority or Estimated Habitat of Rare Wildlife in Wetland Areas within
the project locus, nor are there any known vernal pools. FEMA mapping for the property has
been attached to this report, as well as a USGS locus and NHESP locus map.
