NORTH ANDOVER SELECT BOARD MINUTES OCTOBER 25, 2022
Call to Order: Chair Janice Phillips called the meeting to order at 7:00PM in the Town Hall Select Board Meeting Room.
Select Board in Attendance: Chair Janice Phillips, Laura Bates, Clerk Rosemary Smedile, Richard Vaillancourt were
present.
Non-Board Members in Attendance: Town Manager- Melissa Murphy Rodrigues and Assistant Town Manager- Laurie
Burzlaff were present.
PUBLIC COMMENT
None
Out of Order: Request of Sasha Weinreich on behalf of North Andover SEPAC to raise the Special Education Parent
Advisory Council flag at the Common for the month of November and to proclaim the 3rd Friday of
every November SEPAC Awareness Day
Courtney Pham and Sasha Weinreich of the North Andover SEPAC were present at the meeting and gave information on
services available for families with children with special needs. Ms. Pham explained that North Andover would be the first
town in Massachusetts to have a dedicated SEPAC date.
MOTION: Mr. Vaillancourt motioned to approve the request of Sasha Weinreich on behalf of North Andover SEPAC to
raise the Special Education Parent Advisory Council flag at the Common for the month of November, except from November
10-13, and to proclaim the 3rd Friday of every November SEPAC Awareness Day. Ms. Bates seconded. Motion approved 4-
0.
Update-Multi-Family Zoning Requirement for MBTA Communities/Section 3A Final Guidance
Andrew Shapiro was present at the meeting and gave a presentation on the multi-family zoning requirement for MBTA
communities/ Section 3A. Mr. Shapiro explained North Andover is not considered a rail community any longer, but now
classified as an adjacent community. Ms. Smedile asked what kind of land are they looking for. Mr. Shapiro stated land that
can be zoned to a Section 3A a unless it is unusable land. Mr. Shapiro mentioned North Andover needs to show economic
feasibility. Ms. Smedile asked who determines the feasibility. Mr. Shapiro stated need to be a discussion to seek out technical
guidance to help determine the feasibility. Ms. Smedile asked if these units would count towards North Andover's affordable
numbers. Mr. Shapiro stated he believed so, but only the affordable units. Ms. Rodrigues stated unless a builder was building
under 40B it would not count. Ms. Rodrigues stated best to use what North Andover already has and build off of it. Mr.
Vaillancourt asked about the special permit requirement enacted a few years ago. Ms. Rodrigues stated yes, it is a tool that
may be pulled back for multi-family development. Ms. Bates asked if could use the 50 acres in one zone. Mr. Shapiro stated
yes, but not sure if 50 acres are available in the one area. Mr. Shapiro stated there is language for not allowing for a single
project.
Update on Senior Center
Ms. Rodrigues gave an update on the Senior Center. Ms. Rodrigues stated they are looking at opening the Center late
winter/early spring. The Friends of the Council on Aging started a fundraiser and were looking for a way to recognize the
funds they are receiving. Ms. Rodrigues showed plaques that another community has used and asked whether to place it in
the front door or several within the Center in the different rooms. Ms. Smedile suggested one plaque, Ms. Bates agreed. Mr.
Vaillancourt asked about the time limit to get the names on the plaque. Ms. Rodrigues stated she would check to see if there
is a plaque that could be added to. Mr. Vaillancourt suggested the smaller plaques for ease of adding on and distributing
around the senior center.
Master Plan Implementation Committee quarterly update
Andrew Shapiro gave an update on the Master Plan Implementation Committee. Mr. Shapiro stated there is a webpage
dedicated to the progress that the committee has made.

LICENSING
MOTION: Mr. Vaillancourt motioned to open a meeting of the North Andover Licensing Commission. Ms. Bates seconded.
Motion approved 4-0.
Application from Paul Gallant on behalf of Merrimack College for a one day all alcohol liquor license for a grand
opening celebration on November 4, 2022 from 5:00PM to 9:00PM
MOTION: Ms. Bates motioned to approve the application from Paul Gallant on behalf of Merrimack College for a one day
all alcohol liquor license for a grand opening celebration on November 4, 2022 from 5:00PM to 9:00PM with a police detail,
subject to obtaining the occupancy permit prior to the event. Ms. Phillips seconded. Motion approved 4-0.
MOTION: Mr. Vaillancourt motioned to close a meeting of the North Andover Licensing Commission. Ms. Bates seconded.
Motion approved 4-0.
Request of Keith Connors on behalf of North Parish Church to use a parcel of land on Academy Road for their
annual Red Bow Fair on December 3, 2022 from 8:00AM to 4:00PM
MOTION: Ms. Smedile motioned approve the request of Keith Connors on behalf of North Parish Church to use a parcel of
land on Academy Road for their annual Red Bow Fair on December 2 & 3, 2022 from 8:00AM to 4:00PM. Mr. Vaillancourt
seconded. Motion approved 4-0.
FY24 Budget Policy Statement
MOTION: Mr. Vaillancourt motioned to approve the Budget Policy Statement for FY2024. Ms. Bates seconded. Motion
approved 4-0.
Sign Warrant for election on November 8, 2022
MOTION: Ms. Smedile motioned to approve and sign the warrant for the election on November 8, 2022. Mr. Vaillancourt
seconded. Motion approved 4-0.
Approve charge and membership of Middle School Building Committee
Charge: The Middle School Building Committee shall be charged with the oversight,
management and administration of the construction of the North Andover Middle School
in accordance with the Facilities Master Plan II and 2022 Town Meeting vote.
Prior to finalizing any design, the Committee shall solicit input from stakeholders and building
occupants.
The Committee shall expire at the conclusion of construction of the Middle School.
Membership: Members of the Middle School Building Committee shall be appointed by
the Select Board and shall be comprised of:
Assistant Town Manager/Director of Operations
Facilities Director
Superintendent of Schools or his designee
Middle School Principal
One Middle School teacher designated by the Middle School Principal
One Select Board member
One School Committee member
One Middle School parent
One Resident with engineering/construction experience

MOTION: Ms. Bates motioned to approve the charge and membership of the Middle School Building Committee. Mr.
Vaillancourt seconded. Motion approved 4-0.
Approval of ARPA funding
1. COVID Impact on Employees program
Ms. Rodrigues explained the program and the cost of $3000.00 to conduct the employee training and intervention.
2. Conversational Spanish training
Ms. Smedile expressed her concern with the amount being spent for employee training with the current conditions of the
residents that are in need. Ms. Rodrigues explained the concern for the employees’ resources for mental health during these
difficult times. Ms. Smedile asked to have resources like tutoring available for the school aged children to help them with
their test scores and knowledge. Ms. Rodrigues stated the School Department has their own fund to assist them for needed
programs for the school aged children. Ms. Bates mentioned the School Department has created additional classrooms to
keep the classrooms sizes smaller and give more personal attention to each child.
MOTION: Mr. Vaillancourt motioned to approve the funding from ARPA for a program to address the COVID Impact on
Employees and approve the funding from ARPA for conversation Spanish training for employees. Ms. Bates seconded.
Motion approved 4-0.
CONSENT ITEMS
A. Accept donation in the amount of $100 from Smart Start, LLC to the Fire Department
MOTION: Mr. Vaillancourt motioned to accept consent item. Ms. Bates seconded. Motion approved 4-0.
APPROVAL OF OPEN SESSION MINUTES OF OCTOBER 3, 2022 AND OCTOBER 11, 2022
MOTION: Mr. Vaillancourt motioned to approve the Open Session minutes of October 3, 2022 and October 11, 2022 with
amendments as stated. Ms. Smedile seconded. Motion approved 4-0.
Town Manager’s Report
- Discussion on recent trash collection issues
- Recognition of David Rand and Joe LeBlanc for their work with the Veterans
Select Board Report
- Ms. Smedile mentioned the Holiday Wreath sale
- Ms. Bates thanked Sustainability Committee for the recent energy and recycling event
- Ms. Phillips thanked Rick Green for his part in the new cross-country course
- Mr. Vaillancourt thanked Terry Holland for his help with the new cross-country course
- Ms. Bates and Ms. Phillips mentioned the ribbon cutting of the new Upper Crust pizza restaurant

ADJOURNMENT
MOTION: Ms. Smedile made a MOTION, seconded by Ms. Bates to adjourn the Select Board meeting at 8:58PM. Motion
approved 4-0.
