RE: 565-575 Turnpike Street Site plan review for additional 9 parking spaces.
We have visited and reviewed the proposed site plan for 9 additional parking spaces within the
roadway easement off of hillside Road. The current easement roadway does not provide our fire
apparatus with sufficient turning radius. We have to back out apparatus up from that point on
Hillside Road to either the entrance/exit of the Chestnut Green Complex or to Bucklin Road off
of Hillside Road.
The additional proposed parking spaces will not impede our response to this complex.

Rebecca thank you for resending the aforementioned narrative. The turnaround is for emergency vehicles, and to the
best of my knowledge can not be compromised. Fire Prevention would respond as to the dimensional requirements. I
believe this turnaround serves the development as well as the office park. Although as much as I would like to see
more parking along with accessible parking, if the nine spaces in question compromise the the turnaround thereby
compromising life safety I would not be in favor of the additional parking.

This easement not being a thruway, is the turnaround for the fire access that was designed along with the
development, if so the proposed parking would compromise fire access.
Having a Registered Design professional (RDP) provide this information would afford a proper response.
for the aforementioned concerns but not limited to; I would need more information prior any hearings. Please feel

Please find the attached application and Site Plan for 565/575 Turnpike. The Applicant is looking to add 9 parking
spaces to Chestnut Green. Initial concerns are the roadway easement and fire truck accessltumaround for the
houses at the end of the Hillside Road. The hearing will open on December 6th and we would appreciate any
comments and or/concerns related to this application to be sent before November 29th.

don't have anything formally for the board, but I do advise adding a condition to the site plan approval that the applicant
shall convey an easement in the parking area, to be reviewed by Town Counsel and that the easement shall be recorded
at the registry of deeds at the time the site plan is recorded.

Hi Rebecca:
This is our guard rail. Some discussion is required prior to any plan to move it. There is some recollection about this
tract having been considered for lease, rent, or sale in earlier times. It may have been before the Selectmen meeting.

Thus far, preliminary research on the Registry Site, Mass Highway, and in our office, has not revealed anything to
indicate that the unpaved section of Hillside Street was abandoned or conveyed to other parties.
Significantly, town water and sewer ARE located under the right-of-way. If an abandonment is in the discussion,
consideration of these utilities is imperative.

Site Plan Review
Dear Jean,
As requested, Tim Willett the Operations Manager and I have reviewed the proposed site plan
application originally submitted in March 2016 and resubmitted in November 2016, for the
construction of nine (9) additional parking spaces to be located at the Chestnut Green
Condominium Buildings at 565/575 Chestnut Street, as prepared by Merrimack Engineering
Services, and submitted on behalf of the Chestnut Green Condominium Association,
We offer the following comments on the proposed site plan application:
1. The proposed location for the nine (9) new parking spaces is located off of Hillside Road
within a roadway easement developed to allow for the turning of motor vehicles, including
public safety vehicles, when the outlet of Hillside Road onto Route 1141Turnpike Street
was removed in the early 1980's. Based on a review of the proposed parking space
layout, all of the proposed parking spaces are located within this roadway easement area
but off of the existing edge of the pavement. Since the proposed spaces are located
completely off of the existing edge of pavement, the DPW does not have any concerns
with the proposed parking layout.
2. With regards to the existing roadway easement area, as identified on the submitted "Site
Development Plan of Land" dated April 20, 2015, according to the supplemental
information submitted by Merrimack Engineering Services dated November 2016, there
appears to be no deeded easement to the Town of North Andover for access to this area.
However, upon review of the master deed for the condominium association (Book 1928,
Page 309) (2) "Description of Land" points to "Exhibit A" on page 321 indicates "...subject

to and have the benefit of, as the case may be, the easements, encumbrances, restrictions
and appurtenant rights set forth and contained herein and in Exhibit A". Where Exhibit A
(Book 1928, Page 321) points to "Plan of Land in North Andover, Mass., drawn for The
Newport Group, Elm Sq., Andover, Mass,1"=40', April, 1984, Merrimack Engineering
Services." filed as Plan 9538 and shows "Line of Roadway Easement". The DPW
recommends that a deeded easement to the Town of North Andover, for the area identified
as "Roadway Easement" be developed to clarify the roadway easement access rights for
all parties and the deeded easement be recorded at the registry of deeds.
3. The Applicant shall confirm acceptance of the proposed parking layout from the North
Andover Fire Department.

Hi Rebecca,
Just want to let you know that I have reviewed this application and did a brief site visit. I don't really have any
issues with the design —the soils In the area are not great, but the porous pavement has enough void storage
to capture most, if not all of the runoff and will certainly be better than the impervious pavement that is there
now. My only comment is that there needs to be a provision for maintenance of the porous pavement over the
long term, and sealcoating of the surface should be specifically prohibited. UNH Stormwater Center has some
