Installation of Playset w/ Associated Frame & Rubber Mulch
Conservation Conditions of Approval, NACC #299
Pursuant to section 4.4.2 (A) of the North Andover Wetlands Protection Regulations,
Andrea Ravenelle, filed for a Small Project Permit to install an approximately 14' x 15' playset
surrounded by a 6-foot play area around the set. The total perimeter dimensions of the play area will
be approximately 20' x 21'. No excavation will take place,but a layer of weed fabric will be laid on
the lawn, a border will be installed around the perimeter, and a layer of eco-friendly rubber mulch
laid within the framed area. Two possible locations for the play area have been identified as noted
on the approved GIS map,both are outside the 50-Foot No Build Zone. Work at its closest point
will be approximately 51-feet from the BVW associated with Mosquito Brook, based on
Conservation Department staff measurements. All work will be occurring within previously
disturbed areas within the 200-foot Riverfront Area to Mosquito Brook.
During the November 16, 2022 public meeting, the North Andover Conservation Commission
(NACC) found this project to qualify as a Small Project Permit and voted unanimously to approve
this project as proposed under Category"L"— Othersimilarprojects ofminimal impact, as determined by the
North Andover Conservation Commission subject to compliance with the conditions listed below. Both
Option #1 and Option #2 (as shown on the record GIS aerial map) have been approved. The
project is approved only as it relates to the Conservation Commission and any and all other
approvals should be obtained by the applicant/homeowner.

The following conditions are hereby mandated:
CONDITIONS:
1. Pre-construction meeting with the Conservation Department to review means and methods
of proposed work.
2. Allow for either location shown on the GIS Aerial Plan (Option #1 or Option #2) since
both are outside the 50' NBZ and in the lawn (whatever works for the applicant and
neighbor).
3. If neither of the proposed locations outside of the 50' No-Build Zone (NBZ) are feasible
and the play set needs to encroach into the 50' NBZ, the applicant shall file a Request for
Determination of Applicability (RDA) permit application with the Conservation
Commission.
4. If the playset is abandoned, rubber mulch shall be removed and disposed of properly.
5. Post-construction inspection with the Conservation Department to verify compliance
**The applicant, homeowner and their contractors are advised that NO other work on the
property is allowed under this permit. The NACC has jurisdiction over all the wetlands,
associated 100-Foot buffer zones and 200-Foot Riverfront Area on site and any work
that involves ground disturbance or changing the current conditions in these areas will
require permitting with the NACC. This includes, but are not limited to, house additions,
pools,patios, decks, sheds, fences, garden beds,landscaping and bridge installation, tree, or
vegetation cutting/pruning. These activities shall be held to the current standards under the
Bylaw and WPA.
