Road and Osco Drug, Mr.Kelley stated that if a car was traveling south on Rt. 125 they would
have to make a U-tum to access the building, Ms.Lescarbeau slated that they could make a right
turn only exit if they did a curb cut after the island on Rt.125. Mr. Kelley stated that it is very
rare that the state would let you access a no access line, Mr.Rowen asked what plans would you

that he would put a right turn only sign at the exit. Mr. Simon asked if they could put a curb cut
into where the island ends. Mr. Kelley stated that he could go back to the state and ask, Mr.
Kelley suggested that they put a Do Not Enter sign at the back entrance to Chestnut Green. Mr.

Nardeila asked Mn turn Kelley if he thought there was an access to tu out to Rt, 125 would that
alleviate congestion on Hillside Road. Mr.Kelley stated yes. Wayne Gendran asked when the
count was taken. Mr.Kelley stated one count was taken on March 13, 1998 and the other was
taken March 24, 1998 and it was when Merrimack College was in session. Jim Tobin 19
...... Meadowood Road asked what time they did the counts. Mr.Kelley stated that they were done at
7-9 a.m, and then 4-6 p.m. Mike Rosenberger of Bucklin Road stated that he got a list together
with the other neighbors and they also did their own traffic study and they counted 1300 cars.
Mr.Rosenberger asked if they counted the number of vehicles that enters Hillside Road. Mr.
Kelley stated that he did not count that. Mr.Rosenberger stated that they did their study from
12,00 p.m.-6,30 p.m.and they found 3 cars per minute that go through Hillside Road and 76%
were=s cutting through. Mr.Rosenberger stated that the cut through was left there for
emergency access only,per the safety officer. Mr. Rosenberger stated that the parking now in
)f Chestnut Green is insufficient and people are parking on'WdIside Road. W.Rosenberger stated
that it is very difficult pulling off of Rt, 125 onto Hillside Road as it is and there are also snow
ne issues and rain issues. Ms. Lescarbeau asked if there is a no parking sign on Hillside Road. Mr.
Rosenberger stated no,and there are also school buses that travel down the road. Mr.
Rosenberger stated that there have already been four accidents reported and our other concern is
people coming out of the other exit of Meadowood. Mr.Rowen stated that he does not think

they will use the other exit. Mr.Rosenberger asked if they considered Stop&Shop. Mr.Kelley

stated that they considered Stop&Shop and Forestview, Mr,Rosenberger stated that there arc

stated that if the no access line was not there it would be all right but,they need to evaluate the

Paul Marchionda was present to represent Executive Quarters, Mr.Rowen stated that Ms,

were the mass and the scale of the building, Tony Mesiti showed the-Board a revised copy of the
architecture of the building. Mr,Mesiti stated that they added pointed peaks,pillars and smaller
windows to the building, Mr.Mesiti stated that they did not color the plan because we wanted

off the first floor. Mr,Mahoney stated that these buildings don't have to fit in with others and I

Board. Mr, Weinmeyer stated that there would be a buffer on Hillside Road. They will be meeting

Ms.Colwell questioned HVAC units. Mike Madderos stated that they are not typical air
conditioners,they are air chillers which are enclosed like a dumpster. Ms.Colwell asked if there
were any rooftop units. Mr.Madderos stated that there are none,
s Ms.Colwell questioned the lights on the site. Ms,Colwell stated that we don't want to see the
d lights on all night long,maybe just a light over the door. Anthony Mesiti stated that we could put
t the lights on a timer. Ms.Colwell suggested that they work with the Police Department for
security reasons. Mr.Rowan stated that the light couldn't leave the property. Mr,Mesiti stated
is that they could work with their electrician.
Simons questioned the sign. Mr.Madderos stated that it would be put on Rt. 125. Mr.
Marchionda showed the Board a draft plan of the sign.Mr.Mesiti stated that they are working
with a sign company to make sure we go by the Town's sign bylaw. Mr. Simons asked what the
sign was trade of. Mr.Marchionda stated that they are still working with the company on that.
Mr. Simons stated that he hopes the sign is consistent with the building, Mr.Simons stated that

he hopes the sign is subdued. Mr.Mahoney stated that Butcher Boy has an attractive sign,
M.: Dermit Kelly stated that he spoke to the Fire Department and Fred Soucy of the Police
Department and they have no problems with the plan. Mr, Kelly stated that they spoke to Mass
Highway today and they are going to be doing a study on this.intersection in the next year. Mr.

w. Mr. Simons questioned whether Mr.Weinmeyer has ever seen islands in the road landscaped.
Mr.Weinmeyer stated that he has seen islands with Rosarugueso on Cape Cod. Mr, Simons
y stated that he thinks it is a fabulous idea if the applicants would like to consider it.
Ms.Colwell stated that she needs a final elevation plan. Mr.Mesiti stated that for the next
meeting they would have the sign details and parking lot lighting, Mr.Rowen stated that lie

would recommend Ms.Colwell draft a decision for the next meeting.

Dave Willett of Marchionda Associates and Mike Madderos of Mesiti Development were present
to represent Executive Quarters. Mr.Willett stated that the proposed sign is 145 SF free

homes and one in the far parking lot which will be facing down on the parking lot so that none of

Ms.Colwell had questions regarding the ventilation of the parking garage, Mr.Madderos stated

The Planning Board makes the following findings as required by the North Andover
Zoning Bylaws Section 8.3 and 10.3;

1. The specific site is an appropriate location for the project as it is adjacent to an
existing office park and is zoned for business;
2. The use as developed will not adversely affect the neighborhood as a sufficient buffer
from lighting and noise has been provided;
3. There will be no nuisance or serious hazard to vehicles or pedestrians as a separate
turning lane onto Rt. 125 will be created;
4. The landscaping approved as a part of this plan meets the requirements of Section 8,4
of the North Andover Zoning Bylaw;
5. The site drainage system is designed in accordance with the Town Bylaw requirements
and has been reviewed by Town's engineering consultant;
5. The applicant has inet the requirements of the Town for Site Plan Review as stated in
... Section 8.3 o£ihe Zoning Bylaw;
1. Adequate and appropriate facilities will be provided for the proper operation of the
proposed use.
Finally the Plawr ng Board finds that this project generally complies with the Town of
North Andover Zoning Bylaw requirements as listed in Section 8,35 but requires
conditions in order to be£ally in compliance. The Planning Board hereby grants an
approval to the applicant provided the following conditions ate met;
SPECIAL CONDITIONS.
1. Prior to the endorsement of the plans by the Planning Board,the appllcant
must comply with the folbwing conditions.

a) The location of the entrance sign and a detail including size and materials
must be added to the plan.
b) The final plan must be reviewed and approved by the Town's engineering
consultant,DPW and the Town Planner and subsequently endorsed by the
Planning Hoard,The final plans must be submitted for review within
ninety days of filing the decision with the Town Clerk.
c) A bond in the amount of tee thousand dollars(S10,000)shall be postal
for the purpose of insuring that a final as-built plait showing the location of
all on-site utilities,structures,curb cuts,parking spaces and drainage
facilities is submitted The bond is also in place to insure that the site is
constructed in accordance with the approved plan. This bond shall be in
the form of a check made out to the Town of North Andover. This check
will then be deposited into an interest bearing escrow account.
2. Prior to the start of construction:
a) A construction schedule shall be submitted to the Planning Staff for the
purpose of tracking the construction and informing the public of
anticipated activities on the site.
b) Orange construction fence must be placed along the drip line of the trees to
be preserved as shown on the plan.As shown on the Landscape Plan,all
trees proposed within 25'of the wetlands are to be saved. Existing trees s'
adjacent to Hillside Road must also be preserved.
c) This line must be reviewed and approved by the Town Planner prior to
construction.
d) The erosion control barrier must be erected along the 25'wetland buffer as
shown on the Guiding Plan. This barrier is to delineate the limit of work
beyond which no clearing is to be done.

a) The applicant must submit a letter from the architect or engineer of the project

Plarming Board. The landscape buffer along Hillside Road must shield the
adjacent homes from the glare of the headlights of the cars in the parking lot.
b) The applicant must submit a letter from the era& engineer of the project
staling that the so layout m*atandally complies with the approved
"Conceptual Access Plan - Al. 4" referenced at the end of this decision as
endorsed by the Planning Board,
c) An 8' tall stockade fence must be constructed as indicated on the plan as an
enclosure for the dumpster and air conditioning unit.
d) The Planning Staff shall approve all artificial lighting used to illuminate the
site. All lighting shall have underground wiring and shall be so arranged
" that all direct rays from such lighting f&entirely within the site and shall
r be shielded or recessed so as not to shine upon abutting properties or
^'s streets. The Planning Staff shall review the site. Any changes to the
approved lighting plan as may be reasonably required by the Planning Staff
shelf be made at the owner's expense.
e) The building must have commercial fire sprinklers installed in accordance
with the North Andover Fire Depmtrnent.
S. Prior to the finei revw of security:
a) The Planning Staff shad review the site. Any screening as may be
reasonably required by the Planning Staff will be added at the applicant's
expense,
. b) A final as-built plan showing final topography,the location of all on-site
utilities.structures,curb cuts,Parking spaces tuxl drainage facilities must
W` be submitted to and reviewed by the Planning Staff and the Division of
Public Works.
b, Any stockpiling of materials(dirt,wood,construction material,etc.)must be
shown on a plan and reviewed and approved by the Planning Staff. Any approved
piles must remain covered at all times to minimize any dust problems that may
accur with adjacent properties. Any stock piles to remain for longer than one
week must be fenced off and covered,
7. In an effort to reduce noise levels,the applicant shall keep in optimum working
order,through regular maintenance,any and all equipment that shall tunanate
sounds from the structures nr site.

8. All site lighting shall provide security for the site and structures however it must
not create any glare or project any light onto adjacent residential properties,
9. Any plants,trees or shrubs that have been incorporated into the Landscape Plan
approved in this decision that die within one year from the date of planting shall be
replaced by the owner.
10. The contractor shall contact Dig Safe at least 72 hours prior to commencing any
excavation,
11. Gas,Telephone,Cable and,Ekctric utilities shall be installed underground as
specified by the respective utility companies.
12. No open burning shall be done except as is permitted during burning season under
the Fire Department regulations.
13. No underground fuel storage shall be installed except as may be allowed by Town
Regulations.
14. The provisions of this conditional approval shall apply to and be binding upon the
applicant,its employees and all successors and assigns in interest or control.
15. Any action by a Town Board,Cornmissiotk or Department that requires changes in
the plan or design of the building as presented to the Planning Board,may be
subject to modification by the Planning Board.

16. Any revisions shall be submitted to the Town Planner for review.If these revisions
are deemed substantial,the applicant must submit revised plans to the Planning ce'
Board for approval.

(two years from the date permit granted)unless
