FINDINGS & SPECIAL CONDITIONS
10 Commerce Way,North Andover
At the November 16,2022 public hearing,the North Andover Conservation Commission (NACC) voted to issue a
Negative#3 Determination of Applicability approving the project at 10 Commerce Way based on its findings
below and subject to conditions listed below. The Commission determined that since no footprint change to the
existing conditions were proposed, a new wetland delineation was not required. The following is a description of
the project:
• This is a car wash facility that recently changed ownership, The interior of the building is being rehabbed.
• The project involves removal of existing car cleaning vacuums in the paved parking area and installation of
17 new vacuums,with overhead piping and underground electrical.
• The vacuums will be supported by poured concrete sonotubes that will be 4' below grade.
• The vacuums will have small trash receptacles attached to them and will reportedly be emptied daily into
the dunipster.
® At the front and rear of the carwash building concrete pads will be replaced.

The following special conditions are mandated:
1. Prior to work, wetland markers shall be installed along the edge of the NDZ. Markers shall be
spaced every 30 feet,on 4x4 posts, mature trees, or fencing as conditions dictate and per the
Conservation Administrator's direction,
2. Prior to work, three "no dumping" signs shall be installed, evenly spaced, on the chain link fence
behind the proposed vaCULUn stations. The signs shall read "No Trash or Dumping—Protected
Wetland Resource".

3. Prior to work, the duitipster shall be enclosed to protect the wetland and buffer zone from errant
trash escaping from the dumpster.
4. Prior to work, bills of lading for CB and vortech cleaning shall be provided to the Conservation
Dept.
5. A pre-construction meeting shall be held to inspect installed erosion controls(12"mulch sock as
depicted on the approved plan) and review the conditions of the permit.
6. All excavated materials shall be immediately containerized and hauled off site, no stockpiling shall
occur on site
7. Post construction meeting shall be scheduled to verify compliance and approve removal of erosion
controls.
8. As an on-going condition, the trash receptacles shall be emptied into the enclosed dumpster on a
daily basis. Errant trash shall be picked tip and disposed of.

and their contractors are advised that No other work on the property is allowed under this

work that involves ground disturbance or.changuig the current conditions in these areas will require perinitting with
the NACC.This includes but are not limited to house additions,pools,patios, decks sheds fences, garden beds
landscaping and bridge ins pi�uning...'Fbese activities shall be held to the current
standards under the Bylaw and WPA.

Negative Determination
Note: No further action Linder the Wetlands Protection Act is required by the applicant. However, |fthe
Department is requested to issue a Superseding Determination of Applicability, work may not proceed
on this project unless the Department fails to act on such request within 35 days of the date the
request is post-marked for certified mail or hand delivered to the Department. Work may then proceed
at the owner's risk only upon notice tothe Department and to the Conservation Commission.
Requirements for requests for Superseding Determinations are listed at the end of this document. �

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office(see https://www,mass.gov/service-detalls/niassden-reaTonal-offices-by-
coLnLngnity)to issue a Superseding Determination of Applicability. The request must be made by certified
mail or hand delivery to the Department,with the appropriate filing fee and Fee Transmittal Form (see
Request for Departmental Action Fee Transmittal Form)as provided in 310 CMR 10.03(7)within ten
business days from the date of issuance of this Determination. A copy of the request shall at the same
time be sent by certified mail or hand delivery to the Conservation Commission and to the applicant if
he/she is not the appellant. The request shall state clearly and concisely the objections to the
Determination which is being appealed.To the extent that the Determination is based on a municipal
ordinance or bylaw and not on the Massachusetts Wetlands Protection Act or regulations, the Department
of Environmental Protection has no appellate jurisdiction.
