RE: Response to Review Comments—Stormwater 2nd Peer Review cmts dated 17 May 2019
Site Plan Application—A.L. Prime Energy Consultant,Inc.--1725 Turnpike Street
We received HorsleyWitten 2nd Peer Review comments via email from Staff Planner Monica Gregoire
and are providing the following responses to those issues that remained outstanding after the response
to the 15t Peer Review:
- Standard 1, item b.,—"The Applicant has stated that it has met with MassDOT. If there is any
written documentation from MassDOT regarding the suggestion to leave the current ROW
conditions adjacent to the site as-is HW recommends providing the documents to the Town.
There is no written documentation available from MassDOT regarding this
suggestion;it was made verbally during a meeting at the District 4 offices.
- Standard 2-- item a.--"... for documentation purposes, HW recommends that the Applicant
adjust the plans or the HydroCAD model for consistency."
The elevation indicated on the plan detail is correct so the elevation in the model
has been changed to match.This will not change any results of the model.
- Standard 4, item_c.-"...HW recommends that the Applicant present its reasoning to the
Planning Board for discussion."
A.L. Prime is prepared to present its reasoning at the next hearing. Basically, it is felt
that the risk associated with potential direct injection of any contaminant outweighs the
benefits of increased TSS removal and GW recharge.And,that even with acceptable state
of the art industry standard treatment systems there is always a possibility of long term
accumulative negative effect of such discharge.
- Standard 5, item a.—same comment and response as previous for Std 4, item c.
- Standard 8, item a.—"The Applicant has noted that the work at the fueling area is below the
existing and proposed base course and therefore there is no potential for runoff from these
construction areas. However," _"the Applicant describes the storage of materials to be kept on
site during construction. HW recommends adding additional erosion control measures at all
downgradlent boundaries or eliminating the stockpiling of materials on site."
it should be clarified that the proposed work on site does not include replacement of
the tanks or any significant excavation work associated with the fueling system. The concrete
paving will be replaced creating the lower area of the excavation in which there will be some

shallow trenching(approx. 24"deep) associated with rerouting the piping and electrical
conduit to the new dispenser locations. Most of the spoil will be existing pea-stone from
around the existing piping and will be stockpiled within the fueling paved area to be reused to
cover the new piping.Any stockpile of fill or removed material outside of the excavation will
be minor and very temporary(less than one week,usually less than 48 hrs).Additional erosion
control barrier is proposed around any such stockpiling, including notes regarding the
requirement to cover and maintain maximum slope of any stockpiles.
Standard 8, item c.--"HW recommends that the Applicant verify that runoff from adjacent
properties does not flow onto the site during construction."
A note has been added to the Eft-1 drawing that a temporary construction-phase shallow
diversion trench is to be installed along the west property line edge of pavement and in the
area where encroaching pavement is to be removed for the purpose of channelling state
forest land runoff southerly along the property line to the SW corner of the property and
prevent such runoff from running across disturbed areas on the property.
- Standard 8, item c.—"The Applicant has described the storage of potential pollutants and how
they will be managed during construction.The Planning Board may choose to include the
Applicant's response as a condition of approval."
A.L. Prime has no issue with including such a condition of approval.
- Standard 8, item d.—"A note has been added to Sheet ER-1 stating that the construction
entrance will be monitored and cleaned of sediment as needed on a deafly basis.The Planning
Board may choose to include this note as a condition of approval"
A.L. Prime has no issue with including such a condition of approval.
- Conclusions--"HW recommends that the Planning Board require that the Applicant address the
remaining comments as part of the Board's review process.The Applicant is advised that
provision of these comments does not relieve him/her of the responsibility to comply with all
Town of North Andover Codes and By-laws, Commonwealth of Massachusetts laws, and federal
regulations as applicable to this project..."
We hope that the comments and revised attachments provide satisfactory response to the 2"d
Peer Review comments,A.L. Prime intends to comply with all Town of North Andover Codes
and By-Laws.
Attached are ER-1 plan and Stormwater report revised as mentioned above.
