AGENDA
Pursuant to Chapter 107 of the Acts of 2022, this meeting of the North Andover Zoning Board of Appeals will be conducted in
person and via remote means, in accordance with applicable law. Specific information and the general guidelines for remote
participation by members of the public and/or parties with a right and/or requirement to attend this meeting can be found on
the Town's website, at www.northandoverma.gov. For this meeting, in person attendance of members of the public and Board
members will be permitted.Members of the public who wish to watch the meeting live may do so on their televisions by tuning
to Comcast Channel 8 or llerizon Channel 26 or online at www.northandovercam.org.Every effort will be made to ensure that
the public can adequately access the proceedings in real time, via technological means.In the event that we are unable to do
so, despite best efforts, we will post on the Town of North Andover website an audio or video recording, transcript, or other
comprehensive record of proceedings as soon as possible after the meeting.If the public would like to participate in public
hearings, but not attend the meeting in person please email your question/comment prior to or during the meeting to
ibattersbyknorthandoverma.gov. The question/comment will be read during the proceedings and responded to accordingly.

3. New Public Hearing of 476 Great Pond Road
The petition of Edward C. Nieburger and Gayle D. Nieburger for property at 476 Great Pond
Road (Map 064.0, Parcel 0022, North Andover, MA 01845 in the R-1 Zoning District.
The Applicant is requesting Variances pursuant to Town of North Andover Zoning Bylaws Section
195-4.19.C.0 Construction of a new permanent structure only after a variance has been granted by the
Zoning Board of Appeals and Section 195-7.4 Table 2: Summary of Dimensional Requirements in the
R-1 Zoning District for the purpose of constructing a new single family house on the lot; specifically,
Applicants have requested a building height needing a relief variance of 3 ft. (building height
proposed is 38 ft.,building height required per Table 2 is 35 ft.).
Notices and agendas are to be posted 48 hours in advance of the meeting excluding Saturdays,Sundays and legal holidays. Please keep in mind the Town Clerk's hours of
operation and make necessary arrangements to be sure your posting is made in an adequate amount of time. A listing of topics the chair reasonably anticipates will be
discussed at the meeting are to be listed on the agenda. Note: Matters may be called out of order and not as they appear in the agenda.

4. New Public Hearing of 170 Pleasant Street
The petition of Vann Oliveira for property at 170 Pleasant Street (Map 070.0, Parcel 0020), North
Andover, MA 01845 in the GB Zoning District.
The Applicant is requesting a Special Permit pursuant to Town of North Andover Zoning Bylaws
Section 195-4.12.I Day-care center by special permit in the GB Zoning District for the purpose of
using the Property as a day-care.
5. New Public Hearing of 15-17 Furber Avenue
The petition of Hassan H. Goaless, Manager of the Al Rayyan Group, LLC for property at 15-17
Furber Avenue (Map 067.0, Parcel 0083), North Andover, MA 01845 in the R-4 Zoning District.
The Applicant is requesting a Special Permit pursuant to Town of North Andover Zoning Bylaws
Section 195-10.7 and Subsection N(2)and N(4)of this section for the conversion of an existing dwelling
to not more than five residential units in the R-4 Zoning District. Specifically, Applicant has requested
to demolish the existing two-unit structure and construct a new three-unit structure.
The Applicant is requesting a Variance pursuant to Town of North Andover Zoning Bylaws Section
195 Attachment 3, Table 2: Summary of Dimensional for a front set back in the R-4 Zoning District for
the purpose of demolishing the existing two-unit structure and constructing a new three-unit structure;
specifically, Applicant has requested a front setback needing a relief variance of 11.4 ft. (front setback
proposed is 18.6 ft, front setback required is 30 ft.).
The Applicant is requesting a Variance pursuant to Town of North Andover Zoning Bylaws Section
195-4.3.N.2.D Residential dwellings in the R-4 Zoning District for the purpose of installing a driveway
for the proposed three-unit structure; specifically, Applicant has requested a side-driveway needing a
relief variance of 6.8 from the lot line(proposed is 3.2 ft.,required is 10 ft.); and a rear driveway needing
a relief variance of 8 ft. (proposed is 2 ft.,required is 10 ft.).
